Death penalty looms as Bashir faces confident prosecutors

THE radical cleric Abu Bakar Bashir is facing the death penalty after being
charged with founding and financing a terrorist cell uncovered in the
Indonesian province of Aceh.

Amid heavy security in a Jakarta courtroom, the elderly militant, who gained
notoriety for his anti-Australia polemics and support of the Bali bombers,
listened impassively as prosecutors read the indictment.

''The harshest allegation is that he incited others to commit crimes of
terrorism, which carries the death penalty,'' said a senior prosecutor,
Mohammed Yusuf. ''We want to try him very quickly.''

Other allegations centre on the substantial funding Bashir's Jamaah Ansharut
Tauhid organisation gave to the terrorist cell.

Bashir refused to sign the indictment and declined to speak about his case with
the media.

His only remarks were to offer support for another alleged terrorist arrested
on Friday, Abu Tholut. ''He is a fighter, he is my friend,'' Bashir said.

Through his lawyer, Bashir pleaded not guilty.

The trial, expected to begin in two months, is the third for Bashir in recent
years. He was acquitted of a slew of serious offences including masterminding
the bombing of churches in the first trial in 2003, although he served a brief
prison sentence after being found guilty of rebellion.

He was found guilty after a second trial for conspiracy relating to the first
Bali bombing and the first Marriott Hotel attack in 2003, but the charges were
later struck out on appeal and Bashir was released from prison.

Prosecutors are far more confident this time. Police spent months building a
case against him before he was arrested in August.

To maximise the chances of a guilty verdict, his trial has been deliberately
held back until other members of the terrorist cell have faced justice.

Bashir, 71, is of Yemeni origin and was a founding member of the Jemaah
Islamiah organisation that was behind both Bali bombings and other attacks
across Indonesia.

Bashir's alleged cell was discovered in Aceh in February, where a
military-style training camp had been set up. More than 100 alleged members of
the cell have been arrested and more than a dozen killed.

Among those slain was Dulmatin, a leading figure in the first Bali bombing and
one of the most wanted men in south-east Asia. According to police, Bashir
personally appointed Dulmatin as field commander of the new cell.
