The whole thing was a complete nightmare and illustrates quite clearly how poor
the service can be from an insurance company.
The car was removed from a locked garage I was renting sometime after I had
moved to N. Yorkshire, I posted it on the forum that it had been taken and
after a short period of time got a call from Steve Kodz saying that he had been
offered the car. He put me in touch with the guy that was selling it. I
contacted the police to tell them where the car was and notified RSA ( the
insurer that was underwriting the footman james policy at the time). They said
that they would recover the vehicle so we could decide where to go with it. As
the insurance company had said they were going to recover the vehicle the
police changed the marker to recovered. In the meantime I had sent the
requested documents, licence and keys to RSA so that they could progress my
claim. A couple of weeks later I spoke to them only to be told that they hadn't
recovered the vehicle as the lady they spoke to on the phone number they had
claimed to know nothing about the car. I checked with them that they had the
right number and it was the one that Steve had given me. They said that they
would contact me if there were any further problems. About a month after that I
got a letter from them repeating the request for the documents and keys. I
called them and was told that they hadn't received them, my proof of posting
(advised by the post office as suitable) was not considered acceptable and they
denied the claim saying that I had failed to cooperate with their request for
keys and/or documents. Some time passed and i was going through the appeal
process with them when I got a letter from the DVLA saying that someone had
requested a duplicate logbook for the car. I immediately called RSA to find out
why they were selling/ had sold my car when it was still subject to an
outstanding claim only to be told that they had never collected it.I called the
police again to inform them that it had never been recovered so should still be
showing as stolen, they said that they were informed it had been recovered and
I would need to report it stolen again.  following a prolonged conversation
with the officer he agreed to contact the DVLA to get the details of who was
trying to register the car, it is my understanding that he contacted Steve, who
had purchased the car believing that everything had been sorted and got his
consent for me to contact him. ( correct me if that is incorrect Steve, my
memory is a little fuzzy about that time as a lot was going on with the car and
the business). I spoke to Steve, who agreed to keep the car for me until I
could get down to collect it, which I did in July of last year. The police
never took any action against anyone as it was the owner of the garage had sold
my car and they said it was a civil matter as I had 'left it in his care'. He
had spoken to someone at my old pub and been told that I had moved out of the
area with no intention of returning so had broken into and cleared the garage I
had rented from him. I lost a lot of IT kit and my model aircraft collection
when he did that. I spoke to a solicitor about a civil case against him and was
told it was an i said/he said case which could go either way so wouldn't take
it on a no win no fee basis which meant I couldn't afford it. RSA eventually
said that they had no liability in respect of the claim so my losses were the
keys, Steves out of pocket expenses, about £100 in phone calls and about £5k in
computer gear and model aircraft. All in all a bloody nightmare. As an aside my
dogs are insured with RSA through homebase and they couldn't have been better
when it came to paying out for their (very expensive) treatment for dysplasia!
one company like chalk and cheese in two claims! Mark Miles

Hi Mark, Just looked at your previous emails and i see 419 was stolen in
2013What’s the story behind you getting it back ? I started a H4 donor 1.6
Zetec Mk3 Fiesta the other day, must have last been started 10 years ago when i
parked it where it is.It also started first turn of the key (on a jump pack).
Such a difference with fuel injected and electronic ignition cars compared with
those with carbs and points. They are hard to start after 6 months. Jim  From:

started this morning on the first 'turn of the key', Frankly I was amazed. She
hasn't been started since Sept 2012 and is only back in my possession following
help from Steve Kodz. I finally had a chance to look at her today and thought I
should find out if the engine ran, it is as smooth as when I drove into the
garage in Sept 2012.

Now starts the work to get her roadworthy again,  the first issue I face is not
having keys, the ignition is not a problem but what is the fuel cap from as I
will have to break that off. Looking forward to the bruised knuckles and
inevitable bumps and cuts that will go with this but getting out on the roads
of N Yorkshire will make it all worthwhile. Mark--
