Sounds like you're a victim of getting a valid folder item to something you did NOT ask for
Is this your problem (it happens with "new folderitem" as well)

the killer here is that you get a valid folderitem with exists = true and pretty much have to check that the path is what you gave it (in some fashion) to see if you got the right item
