North-west WA native title
claim to be heard 

The Federal Court will sit in the Pilbara for the
next two months to hear evidence in the second
native title claim to be heard in Western
Australia.

About 25,000 square kilometres of land around
the townships of Karratha, Roebourne,
Wickham and Dampier, including surrounding
ocean, make up the claim.

The area includes at least 10 pastoral stations
and part of the Millstream-Chichester National
Park.

As well as the Ngaluma-Injibandi claim, Justice
Robert Nicholson will also hear several smaller
overlapping claims made by the Yaburara,
Mundudhunera and Wongootoo people.

The area is significantly larger than that claimed
by the Miriuwung-Gajerrong people in the
Kimberley, who were the first to successfully
claim land in mainland Australia.

A decision on the claim is not expected until the
middle of next year.

The Pastoralists and Graziers Association
(PGA) says the pastoralists whose land is
covered in the claim are anxious about the
outcome of the hearing.

Two pastoralists will have the cost of public
liability insurance covered by the PGA after
they threatened to prevent the Federal Court
conducting part of the native title hearings on
their land.

PGA spokesman Geoff Gare says irrespective
of the legal outcomes of the case, pastoralists
still want political amendments to provide
certainty on the issue.

He says until that occurs, there is little incentive
for pastoralists or claimants to negotiate on
native title outcomes.
