Deceitful to say crown land under threat: Williams

CANBERRA, Nov 4 - Claims that native title or other land rights would be
affected if Australia became a republic were
deceitful, Attorney-General Daryl Williams said.
Williams, a 'Yes' campaign supporter, said scaremongering had become a
major tactic to dissuade Australians from
voting 'Yes' in Saturday's referendum.
"The republic model on offer is safe, workable and continues our
tradition of stable parliamentary democracy," he
said in a statement.
"The only change would be to the head of state."
Williams said crown land did not belong to the Queen but was the
property of either the commonwealth or state
governments.
Crown land would remain the property of the government.
A new name would have to be found for crown land but this would involve
simple changes in terminology.
"They would not affect the nature and security of rights over land -
freehold or leasehold or rights to crown land -
held by governments, private individuals and others," he said.
"If Australians vote in favor of a republic, a special savings provision
will be inserted in the constitution.
[ This means that there IS a difference but he doesn't want to admit
it! This raises another question, I thought the constitution could not
be changed without a referendum - I don't remember any mention of land
in the Yes/No booklet. Or am I just being dense? --- Trudy]
"This will ensure the change does not affect the validity or continued
effect of anything done before the change
under the constitution or commonwealth law.
"This means all interests in land on January 1, 2001, will continue if
Australia becomes a republic.
"Any land which is subject to native title or a native title claim will
be dealt with under the law in exactly the same way
as it was before the referendum was approved," he said.
