Hey Eric, the only issue would be around the use of RTMP, which is what we
allude to in the link Dominick passed along.  It's legal for you to use
Red5, and our methods of discovery to recreate the RTMP protocol are all
documented and completely legal.

Adobe has never endorsed or "ok'd" us, or OpenAMF or AMFPhp, however, it
seems clear that they embrace some of it.  They've published articles on
usage of AMFPHP on their site, they're actually VERY involved in Open Source
efforts and promote a pretty healthy existence with OS tools and
technologies.

FMS is a fine product and they offer support, so that's something to
consider.  Red5 is still in Beta (v0.6 Rc2 is due out Feb12th), and largely
untested and we're hoping that v0.6 final will be the version we can finally
put some performance numbers to.

Eric,
We (the Red5 team) do not believe you will get into any trouble with
Adobe, or we probably would not be developing this server. The bottom line
is that if you feel that you are in the wrong you should bite the bullet and
just pay for FMS.
