There are some cases, including the Supreme Court's decision in National Treasury 
Employees Union that suggest that a flat ban on certain types of employee speech are 
reviewed more searchingly than are after-the-fact disciplinary proceedings based on 
employee speech, which are reviewed under the Pickering standard.
