If it's possible, you might try ignoring Track 1 Index 0 (and starting the rip/cuesheet at Track 1 Index 1). Red Discs have audio starting at Track 1, Index 1. Red Book compliant players are supposed to start there (although many start at Track 1, Index 0, these are easy to spot if you have an ECD since it's kind of obvious when they "play" the data track :) )
