The bit rate setting in EAC is irrelevant when encoding with FLAC. I assume that the "confidence" number is coming from AccurateRip. It represents the number of rips for that track that others have submitted to AccurateRip. If your rip matches with a confidence level of 1 or higher, you have a good rip (well, it is statistically very unlikely that you do not). If your rip does not match then either it is has errors, or no one has submitted that track from the same CD pressing.
