RTI ref: bdvcic3 5th February 2008 Mr. P K P Shreyaskar, CPIO, Central Information Commission, New Delhi Dear Sir, With reference to F. No. CIC/MA/A/2008/00088 dated 28/01/2008 from Mr. L C Singhi, Additional Registrar, CIC, New Delhi informing me of fixing the hearing of my second appeal after nearly two months on 4th April 2008 in the matter of RTI Application no. vaghelabdhoq6 and my message to Shri Wajahat Habibullah, CIC, CIC dated 17th January 2008, I wish to reiterate that, time and again I have categorically and specifically conveyed that I do not have any faith in the integrity and impartiality of Prof M M Ansari, IC, CIC; he has not done justice to me and I have no faith in him in giving me the justice (for the reasons already recorded a no. of times). However, hearing of my second appeal by him and not by any other IC of CIC or by full bench of CIC is fixed. Incidentally, this is not the second appeal that I myself have submitted to CIC New Delhi but has been unilaterally transferred by Gujarat Information Commission, Gandhinagar to CIC New Delhi. Complete details of my RTI application, PIO's reply and FAA's response, all these papers submitted to GIC Gandhinagar have been sent by GIC to CIC and are already available with CIC. Neither GIC nor CIC has furnished me the copy of the reply submitted by the PIO / FAA for the RTI appellant to submit rejoinder and without it this hearing on 4th April 2008 has been fixed. With this relevant background, the following information is requested under the Right to Information Act 2005. 1. Section no. of the Right to Information Act 2005 that permits transfer of second appeal or complaint from State Information Commission to Central Information Commission and vice-a-versa. 2. Section no. of the Right to Information Act 2005 that permits acceptance of second appeal or complaint by CIC from any State Information Commission. 3. Section no. of the Right to Information Act 2005 that permits acceptance of second appeal or complaint by CIC from anyone else other than the RTI appellant. 4. Section no. of the Right to Information Act 2005 that specifically prohibits State Information Commission from hearing the RTI second appeal or complaint pertaining to the Central Govt. PSU. 5. Reasons for the proposed hearing of second appeal by Prof M M Ansari, IC, CIC despite my categorical confirmation of having no faith in him and in outright violation of the principle of natural justice. 6. No. of second appeals and / or complaints heard by CIC since inception: a. Without giving opportunity to the RTI appellants for submitting rejoinders to the replies given by the concerned PIOs / FAAs. b. Without informing the RTI appellants and without giving any opportunity to the RTI appellants to remain present during the hearing at CIC. c. With nearly two months advance intimation to the RTI appellants. d. With nearly one month advance intimation to the RTI appellants. e. With nearly a fortnight of advance intimation to the RTI appellants. f. With nearly a week's advance intimation to the RTI appellants. Application fee follows. Kindly expedite the requested information so as to enable me to timely respond to Mr. L C Singhi, Additional Registrar, CIC, New Delhi on his communication dated 28/01/2008 referred to above fixing the hearing of second appeal by Prof M M Ansari on 4th April 2008.
