Respected Madam,

As regards the enclosed media news - Guj HC Grants CIC one Month - on
working of CIC, I wish to share my experience of CIC as under:


   1. During the year 2005-06, I filed 37 RTI complaints / second appeals
   against IOC Mumbai and Delhi.

   2. Prof M M Ansari IC CIC New Delhi heard the cases in September 2006
   without getting me replies of PIOs / FAAs of IOC.

   3. Prof M M Ansari IC CIC New Delhi heard the cases without giving me an
   opportunity to submit rejoinder to reply by IOC. Presence of the PIOs / FAAs
   was also not ensured.

   4.  Prof M M Ansari recorded his decision after six days and as mentioned
   in his decision of 28th September 2006 (copy enclosed) heard 35 cases. He
   has, despite requests not informed which two balance cases have remained
   pending.

   5. Prof M M Ansari, however, recorded decision for only four cases in his
   decision of 28th September 2006 out of 35 cases said to have been heard
   though not heard. He heard my cases hurriedly in an hour so without the
   presence of PIOs / FAAs of IOC.

   6. In his decision of 28th September 2006, Prof M M Ansari recorded
   outright wrong, baseless and outrageuos allegations against me that I
   strongly refuted later in my review petition.

   7. As I did not get the requested information for all my RTI applications
   (and has still not got) from IOC and principle of natural justice was
   seriously been violated, I submitted review petition on 2nd February 2007 to
   CIC requesting for a full bench rearing. Copy enclosed for kind perusal.
   So far, my reasonable request has not been considered by  Prof M M Ansari /
   CIC.

   8. I then made efforts to get justice filing RTI application to CIC and
   then, as suggested by CPIO CIC, once again made request to Prof M M Ansari
   to hear the cases (forwarded herewith) but there has been no response from
   him / from CIC.

   9. On 12th September 2008, I personally met Mr Wajahat Habubullah  in his
   office to help me in the long pending matter.

   10. As directed by him, I  went to Pof M M Ansari to personally request
   him and his secretariat staff then directed me to first look at the papers
   lying in his office.

   11.  On going through the papers, *I observed that no. of my second
   appeals / complaints that Prof M M Ansari mentioned as disposed off have not
   been even been given file nos. / not registered at all. They were lying as
   it is unattended even after more than two years.*

   12. Incidentally, as was requested by CIC during 2005-06, I had submitted
   five sets of my second appeals / complaints and *total weight of those
   coipes was about 2.5 kg.*

   13. After going through the papers, I made one more effort to see Prof M
   M Ansari the same day before leaving Delhi to apprise him of the status and
   personally request for hearing the cases.

   14. I then met Prof M AM Ansari and politely told him about what I had
   observed in his office on my cases lying unattended. However, he flatly
   refused to entertain my request for hearing of the cases against IOC. *He
   told me that he had cleared the cases and he had now nothing to do with
   them.*

   15. I wish to bring to your kind notice that Prof M M Ansari is well
   known for availing hospitality of IOC at IOC cost.

   16. Incidentally, IOC management has been harping, in large no of
   communications to GOI agencies and even PMO that Prof M M Ansari had cleared
   all my cases through his decision on 28th September 2006 and IOC had
   furnished all the information to me *when the cases have not even been
   registered*, have been lying there unattended till 12th September 2008
   when I saw them with my own naked eyes. All the requested information has
   not been furnished to me by IOC though repeatedly and wrongly claimed by IOC
   management in various communications.

   17. Despite large no of serious violations by PIOs / FAAs of IOC, Prof M
   M Ansari  did not impose any penalty for the erring PIOs / FAAs of IOC in
   his decision of 28th September 2006 for the reasons best known to him.

   18. Having seen the state of affairs at CIC myself, *I strongly apprehend
   that hundreds of such cases may be lying unattended / unregistered at CIC
   * as *CIC has no system of acknowledging the cases filed by RTI
   applicants.*

   19. During the last more than two years, I had been repeatedly informing
   and *requesting DoPT / CVC / PMO that CIC has become a hotbed of corrupt
   practices*. No corrective action seems to have been taken to contain
   corrupt practices / malpractices.

In view of the above, *I hereby request for vigilance investigation, on
priority, into the registration of RTI cases by CIC of RTI applicants from
all over India* and their hearing by CIC, by violating principles of
justice, to give justice overdue to the RTI applicants.

While concluding I wish to quote Mr Wajahat Habibullah -"Sorry! I'm not in
the business of getting you 'justice'. That is the business of the
courts. Ican only get you information. Wajahat
."

in the interest of saving the Right to Information Act 2005 and in the
interest of transparency and accountability in public administration.
