All those who have power, to implement the law or pass orders citing the law, which includes the so called Hon'ble Judges of the High Court treat the law as their pet dog. "Moti bite that man, he is questioning our authority" or "Moti go to that corner and shut your eyes, this man is my friend, he is from the police". Thereafter they twist their reasonings and cite the law. The law has to be implemented, by using a little common sense, which those in power have but misuse, to favour the corrupt and those, who can provide favours after retirement or even while they are still in the same post. Yes ! the Information Commission is indeed not a part of the judiciary as CIC and SIC falls under the Department of Personnel & Training, as is evident from their websites. Yes ! Information Commission has power to pronounce orders on issues on giving information. It can only pass orders under RTI Act 2005 and can pass orders imposing penalties on those designated as PIO. Yes ! no lawyers need to represent either side on any legal issue arising out of the information needed to be furnished. Yes ! Those aggrieved by Information Commission's orders may go to High Court. But this can be avoided and RTI Activists joined together can convince the CIC to take appropriate action against the PIO or any one else connected to the furnishing of information. We all should have faith in the RTI's Highest authority i.e. CIC. Yes ! your doubt is very reasonable that common citizens believe that the High Court is an effective forum for gaining justice. Yes !
