Dear Mr.Sarbajit, Thank you. May I request you for a clarification ? With the documentary evidences gained through RTI I have complained against certain government servants before the Hon'ble Lok Ayukta. After preleminary hearing the complainat was admitted for hearing before its Divison Bench and hearings proceeded with. But the Government Pleader is preventing the government servant respondents from attending the hearing and defend the complainat in adition to his obligatory role to protect interest of government. When I could not get a coment as to "Speciic Admission" or "Specific Denial from the maladministration alleged government servants, with leave of the Lok Ayukta I have resorted to discovery by interrogatory. Though the government pleader did not object when it was considered for approval, he objected it when I complained about non-furnishing of answer. At that stage I objected government Pleader defending maladministration alleged government servants. It was replied that Government means "Government servants also" and hence hecan defend them suo moto contrary to Order XXVII Rule 8 and 8B CPC. I insisted that in such case the respondent has to obtain prior sanction of the government . The Lok Ayukta did not agree with me. This, accoding to me is not in confirmity with the ARC's recommendation under which the institution of Lk Ayukta is created. In this case the government at its own expense defend the maladministration alleged government servant at par with government. My plea that government means Agents of government and authority to which the power to act on behalf of the government vested etc., etc., is not sustaining. The Supreme Court CPIO, High Court PIO etc deny my application on a plea that what I am seeking is interpretation of Government that that does not fall under information defined in 2(f), though I have been seeing certified copy of etc., etc., containing etc...Even the State Government Law Department, GAD and Vigilance Dept of govt. plea that the information not held. Of cource the case with Lok Ayukta is now posted for arguments and I will be seeking completion of steps including my views on government defending the corruption of govrnment servants at govt.expense on a plea that government means government.servants
