Minutes of the Meeting dated 18 08 09

Agenda Item 1: ATR on the IAOIA dated 04 08 09
The Commission noted the ATR on the MOM dated 04 08 09.
Agenda Item 2: Demonstration on web based work flow system regarding the 
complaints for non compliance received by the Commission
A presentation on the web based work flow system regarding the complaints for 
non compliance in pursuance to the decision of the Commission in case no. 
CIC/WB/C/2008/00859, 00862 & 00863 was made. The presentation generated some 
discussion as to whether the complaints for non compliance should be registered 
afresh or should it be dealt in with the old file itself. It was decided 
finally to register the cases of non compliance and the web base work flow 
system was approved.
Agenda Item 3: Note of IC (SG) for discussion
a.   The Commission desired that the legal opinion on the concern raised by one 
of the members regarding writs against the decisions of the commission in 
various courts be taken. The Commission reiterated the requirement to invite 
Professor Nigam, Legal Advisor in every first meeting of the month.
b.   A note on the penalty imposed and the recoveries made was presented before 
the commission. It was intimated to the Commission that so far around 77% of 
the penalty amount is accounted for. In remaining cases action has not been 
initiated either since their status is not known or   they   have   still   
not   matured.   It   is   further   observed   that   the compliance of the 
decision of the Commission regarding recovery of the penalty generally takes 
3-4 months as per the available trend.   In other cases, where the Commission 
has directed the recovery in
installments, it takes up to 8-9 months (assuming the amount to be recovered in 
5 monthly installments). The Commission will review recovery of penalties every 
quarter.
c. The delays in distribution of dak from the central receipt to various units 
is a serious problem. The Commission directed the Administration to ensure in 
first phase that the dak is diarized and distributed in 3/4 days of its receipt 
and finally the time period be reduced to 24 hours by which time the dak should 
be distributed.
Agenda Item 4: Progress on the proposed convention, 2009
The Commission desired that a scroll on its website be run indicating that 4th 
Convention of the Commission will be inaugurated by HE President of India and 
the Valediction will be presided over by HE Vice President. The key note will 
be delivered by Lord Meghnad Desai. Commission was informed about the progress 
made so far on the spots on RTI being prepared by the DAVP.

information.
