I would like to point out that CHRI receives funds from both Indian and foreign donor agencies for advocacy, capacity building and monitoring work on access to information and access to justice issues. We also assist citizens with their RTI applications and appeals. We do this as and when asked and subject to time and the importance of the case to furthering RTI and do not take payment for this. Brig. Ujjal Dasgupta's matter relates to the ability of a person to mount the best defence allowed at law under our system of criminal law. He has been an under-trial for more than two years. His trial is stayed because of the government's refusal to provide him access to documents he believes to be crucial to his defence. This despite the Delhi High Court ordering their disclosure. This is the matter we are assisting with. We work from the legal position that it is for the court to decide the matter of guilt or innocence after a fair trial. This is the position at law. We do not conjecture on his innocence or guilt. Making that judgement is the job of a competent court. It is also entirely immaterial to the issue of his right to access information important to his defence. At present no court has declared him to be a foreign spy and I believe it may be defamatory so to conjecture. If perchance Mr. S D Sharma were to find himself in any difficulty with the law I am sure he would want the same presumption of innocence to extend to him. As usual, should there be at that time any RTI related matter on which Mr Sharma feels we are competent to provide advice we would be happy to provide it. He is nowbeing represented by more foreign funded intelligence fronts like N.C.P.R.I and C.H.R.I. who deputed Venktesh Nayak and Shekhar Singh to assist him. Can there be any better proof than this of his guilt. The CIC has rightly thrown all off their arguments and denied information.
