Interesting -- I just looked at a couple of bookmarks I have. It looks like the FRA reg allows the railroad to determine whether they flash or not. See the FRA regulation here (Section 229.125 -- see subsection (e)) -- it reproduced about half way down the thread):
http://cs.trains.com/trn/f/111/t/167554.aspx And a look at a relatively recent GCOR here: http://www.blet75.org/rulebook.htm in section 5.9.5 doesn't seem to specify any requirement for flashing of ditch lights. So it looks like this might be a railroad decision and/or based on how the loco is configured. In some quick internet research I did see a note that CSX and NS have ditch lights that pulsate, while UP, BNSF, CN and CP generally do not (except for some for SP units now re-painted in UP livery). All the references to the flashing aspect seem to indicates that some railroads have adopted this to increase crossing safety.
