Remember this is unregulated air-space... Can I sue my neighbor if his wireless leaks onto my yard??? Of course not... It's not that I've had this discussion with any lawyers or anything. But according to the current government regulations and the arguments I've had with the local PD, as long as I'm not trespassing physically, I'm good as gold. What stops anybody from sitting outside your house with a scanner and trying to listen to your phone calls???? Not a damn thing, but if I sit outside your house and crack open your phone box and wiretap you. Well that is ILLEGAL. In my mind it all comes down to not being a dipshit and reading the manual. Anyone can setup a WAP, and anyone can wire up a 240 outlet in their house. But most people would hire a professional to come wire up power at their house instead of getting shocked and or killed. Just because you CAN do something doesn't mean you shouldn't do your research and make sure it's done PROPERLY.
