Welcome to the gulag. Uncle Joe would be so proud. No mounties involved. Just regular police and animal enforcement officers. Basically this legislation defines a pit bull as one of several specific breeds or anything that even looks like one of those breeds. It's now illegal to buy, sell, breed or import a pit bull. Any animal born prior to the legislation (2005) is "grandfathered" and may be kept but it is not allowed off the owner's property without a leash (less than six feet) and a muzzle. If a dog is found in breach of the statute a "destruction order" ~must~ be ordered by a Justice of the Peace. There is no explanation allowed, no defence possible. This is an absolute liability offence. In addition law enforcement officers are given ~very~ wide-ranging powers of search and seizure (more so than in criminal matters) and getting a search warrant is streamlined. It's scary stuff. A recent case had a pit bull getting loose after neighbour kids opened a gated yard without the knowledge of a homeowner. Pit bull got out, did nothing, was found by owner without incident, but a neighbour called the cops when they saw the dog out of the yard. The dog was ordered destroyed. No defence or explanation allowed at law. No mounties involved. Just regular police and animal enforcement officers. Basically this legislation defines a pit bull as one of several specific breeds or anything that even looks like one of those breeds. It's now illegal to buy, sell, breed or import a pit bull. Any animal born prior to the legislation (2005) is "grandfathered" and may be kept but it is not allowed off the owner's property without a leash (less than six feet) and a muzzle. If a dog is found in breach of the statute a "destruction order" ~must~ be ordered by a Justice of the Peace. There is no explanation allowed, no defence possible. This is an absolute liability offence. In addition law enforcement officers are given ~very~ wide-ranging powers of search and seizure (more so than in criminal matters) and getting a search warrant is streamlined. It's scary stuff. A recent case had a pit bull getting loose after neighbour kids opened a gated yard without the knowledge of a homeowner. Pit bull got out, did nothing, was found by owner without incident, but a neighbour called the cops when they saw the dog out of the yard. The dog was ordered destroyed. No defence or explanation allowed at law. Let's see... A weekend in Colonial Williamsburg with the extended family to celebrate my spending six decades on our planet; Then, after 2 nights at home, off to the English Midlands for a week of archive-diving (connected to my wife's research), a weekend in York (the Saturday very well spent with Bob Walkden), and then 3 days of walking in the Yorkshire Dales. The 3-week-old K-5 now has over 3800 exposures on it (~1000 of them of 15th-17th century documents, for spousal research); and after initial culls there are about 2000 images on the hard drive. Yikes. The only clear days were the three days walking in the Dales. The rest of the time it rained or was showery. The highest temperature the whole time was 17C/62F. Right now in Philly it's 29C/84F. Back to work tomorrow. Yikes again! It's more of a public nuisance/disturbing the peace ordinance. They already have a law on the books that prohibits cursing in public, but they can't (and never have) enforce it due to First Amendment protections. It's just another example of charge stacking where they'll throw several related charges at you so that even if one gets thrown out in court, they'll have backup charges to prosecute you on. It's the same concept with adding laws to cover specific actions rather than simply allowing a single umbrella charge.
