Quoting the provisions of The Persons with disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 a bench of Justice GS Singhvi and Justice SJ Mukopadhyaya held that if a person is found unsuitable for the post he or she holds on account of acquired disability during service, he or she should be moved to another post suitable to his or her state. The bench further held that under section 47 of the Act if it wasn't possible to adjust such a person against any post, the government authority ought to keep him or her on a supernumerary post until a suitable one is available until the employee attains the age of superannuation. With these observations the court recently directed the Union Ministry of Department of Personnel and Training (DoPT) to pay consequential benefits to a 1977 batch IAS officer, Anil Kumar Mahajan, who was compulsorily retired from service on October 15 2007 after a disciplinary inquiry declared him insane. The inquiry report came 11 years after it was instituted in 1993 when he worked with the Bihar government. At the time of inquiry the officer was placed under suspension twice. His representation for a voluntary retirement was turned down by the DoPT on the ground he hadn't completed the minimum service of 20 years. Later, however, the ministry compulsorily retired him. Mahajan later challenged the findings of the disciplinary proceedings before the Central Administrative Tribunal, which turned down his plea. However, on his appeal the SC set aside the order of compulsory retirement and said: The appellant was appointed in the service of respondents as an IAS officer and joined in the year 1977. He served for 30 years till the order of his compulsory retirement was issued on October 15, 2007. It is not the case of the respondents (DoPT) that the appellant was insane and in spite of that he was appointed as an IAS Officer in 1977. Observing some problem was going on between the appellant and authorities of the state (Bihar), the court said: In view of the aforesaid finding, we are of the view that it was not open to the authorities to dispense with the service of appellant or to compulsory retire him from service. The court further said: The High Court also failed to notice the relevant fact and without going into the merit allowed the counsel to withdraw the writ petition merely on the basis of the finding of Inquiry Officer. Since in normal course Mahajan would have retired from service on July 31, 2012, the SC directed DoPT to pay him the full salary, except the subsistence allowance already received, for the period from the date of initiation of departmental proceeding till his date of superannuation. You need to set VLC Media Player as the default player for FLV files. Follow this procedure: 1. Select the file that needs to be open. 2. Press APPLICATION key and select Open With sub menu and open with RIGHT ARROW. 3. Hit DOWN ARROW and select Choose Default Program from the list and press ENTER to open it. 4. Press V until you reach to VLC Media Player application in that list. 5. Press TAB and tick the checkbox Always use the selected program to open this kind of file with SPACEBAR. 6. Raising Cane Lynne Tatum I've used a white mobility cane for over twenty years and I can't thank my friends enough for advising me to begin doing so as a device for identification and safety. It's been a lifesaver on many occasions and I never leave home without it. Much like guide dog users, we cane raisers have our preferences. Back in the day, my cane was at recommended height, somewhere near my sternum, with a small tip. For years, though, I've used a cane that reaches just under my nose and I feel more secure as it indisputably parts the pedestrians on our crowded streets. I once met a woman shorter than I who used a cane that was taller than she. I thought that a bit odd but who am I to judge? You might find it amusing that I sometimes talk to my cane as if it's human, thanking it for doing a good job of getting me safely around an obstacle or scolding it after I've whacked my noggin into an object that it smoothly slid right under. These scenarios are more likely to happen as New York City has more construction going on than ever. Currently, I use a cane with a rather large ball on the end, finding it extremely useful here in the city for identifying the multitude of dangerous cracks and uneven parts of our sidewalks. The ball also adds extra weight to the cane, which I like, but others might find too heavy to swing. An amusing aspect of this cane is the fact that it attracts small children and dogs. They all want to play, and parents and owners must call them back from trying to chase it. Last Summer I thought I'd use my cane as a climbing tool. Thinking I'd reached our favorite fried chicken establishment, I began walking my cane up a fence. A kind gentleman came along to rescue me, propelling me towards the store entrance. That is what I get for allowing my talking to distract me. To date, I've had only one dangerous experience while using my cane. As I crossed a small familiar street, a young man came upon me, pushed me to the ground, grabbed my cane and went who knew where with it. Thoroughly shaken, I struggled up; dusted myself off and wondered what I'd do next. I didn't have to wait long as a woman arrived, handed my cane to me and assured me that I could go on my way. She had witnessed the incident and gathered people to help collect it. She even hailed a cab for me. An Urban Angel, I'll never forget her. In that case you need to enable it. You can get the add on window with the keystroke ctrl+shift+a. If none of the above mentioned is the reason, this is going beyond my knowledge. Hello sir, if you are using ms word 2010, you no longer need any third party software. Just open the word document you want to convert in .pdf format, now click on save button. And in the files of type: combobox, choose .pdf. and save it.
