[AI] Decriminalising suicide is not enough, mental healthcare must be more accessible

The bill adheres to the principles of the UN Convention on the Rights of Persons with Disabilities and moves the current mental health care law from a medical to a social model based on human rights. Some of the progressive aspects of the new bill include the recognition of the legal capacity of persons with psycho-social disabilities and of advance directives, as well as the protection of the rights to equality and dignity. But the bill also has several conditions that could negate the guarantee of these rights. In this respect, the bill has been debated intensely within the disability community. One provision of the bill that has been widely publicised is Section 124. It provides that there shall be no prosecution of any person who may attempt to commit suicide and presumes that such a person has a mental illness unless shown otherwise. What is important is that Section 124 (2) goes on to state that, in such a case, it would be the duty of the government to provide the person care, treatment and rehabilitation. This provision seeks to nullify Section 309 of the Indian Penal Code, which made the attempt to suicide a criminal offence. Although Section 309 has been on the statute books, suicide has never really been treated as an offence. There have not been any serious prosecutions of persons who attempted to commit suicide and almost no convictions. Decriminalisation of this offence is still important as this recognises that persons with mental illnesses are susceptible to suicide and that there is a need to provide them care and rehabilitation instead of punishment. The need to decriminalise attempts to suicide have been considered by the courts, but only from the perspective of the right to life under Article 21 of the Constitution, not from a mental health perspective. As far back as 1994, in P. Rathinam vs Union of India, the Supreme Court was of the opinion that Section 309 was a cruel and irrational provision, and it may result in punishing a person again (doubly) who has suffered agony and would be undergoing ignominy because of his failure to commit suicide and recommended that the section be deleted in view of the global trend in criminal laws. Since the 1970s, most criminal statutes the world over have been decriminalising attempts to suicide. However, in Gian Kaur vs State of Punjab, the Supreme Court viewed this differently and held that the Right to life is a natural right but suicide is an unnatural termination or extinction of life and, therefore, incompatible and inconsistent with the concept of 'right to life'. The fact that in the majority of cases, the person who attempted it had some form of mental illness was only recognised in 2010, in the judgment on euthanasia in Aruna Shanbaug vs Union of India, where it was held that a person attempting suicide is in need of help rather than punishment, and recommended that Parliament consider deleting Section 309. The link between mental health and suicide rates is well known. A World Health Organisation report on preventing suicide finds that studies from both developing and developed countries reveal an overall prevalence of mental disorders of 80-100 per cent in cases of completed suicide. It also states that mental disorders are a major factor associated with suicide. Despite this, a substantial proportion of people who commit suicide die without having seen a mental health professional. By recognising this link, the bill is progressive in that it imposes a duty on the government to provide care, treatment and rehabilitation for a person with a mental illness and who has attempted suicide. However, the bill does not give any guidelines on how care and treatment should be provided for such vulnerable persons. Would it be the hospital authorities, police, community health centres or other agencies that would reach out to persons and their family in need of such immediate care? The bill does not clarify these aspects of the law. Chapter V of the bill guarantees to every person the right to affordable, accessible, non-discriminatory and good quality mental health care and treatment. The implementation of these rights will be the real challenge as there is a severe shortage of mental health care professionals in the country. Without guidelines or a mechanism on how care, treatment and rehabilitation should be provided, it is not clear how the full protection of people's rights will be ensured. Mere decriminalisation of suicide, by itself, will not bring about much change. The challenge is for the new Mental Health Care Bill, 2013, to provide an effective framework for access to health care and treatment for all persons with mental illnesses. Co-authored by Reecha Das. September 4, 2013 http://www.thehindu.com/todays-paper/tp-opinion/enabling-judgment/article5091138.ece The case of the 1977-batch Indian Administrative Service officer, whose compulsory retirement on grounds of disability the Supreme Court has overturned, sets a strong precedent on the codification of protections against contingencies that arise during service. A two-judge bench upheld Anil Kumar Mahajan’s appeal against an earlier decision that sought to curtail his tenure by five years. Interpreting the 1995 law on disabilities, the bench ruled that those who acquire an impairment while in service had to be accommodated in a position appropriate to their current condition. Where such adjustment was not available, the government was obliged to retain them in a supernumerary status, pending the identification of one, until the age of superannuation. The message emanating from the judgment is unambiguous, even if only a fraction of the disabled, estimated at nearly 10 per cent of India’s population, is in formal employment. It is relevant no less to the large numbers rendered severely impaired for life on account of the notoriously high rates of road accidents, not to mention industrial mishaps. The verdict also drives home the necessity, both within the administration and beyond, to recognise disability as a dimension of social diversity. To the extent that this is a relatively new reality, reflected in the workplace and several walks of life, public and private institutions would have to become responsive. It is hard to conceive of a more effective advocacy on disability than policies of accommodation that can potentially counter prevailing prejudice and stereotypes. As regards recruitments under the Union Public Service Commission, a number of persons with different disabilities have begun to join the ranks in recent times. In fact, the question of identification of suitable placements across different services has come into the spotlight, illustrating the need to fashion a comprehensive approach on the absorption of new appointees. The landmark verdict, if anything, underscores yet again the urgent need for Parliament to enact fresh legislation in this area. This is imperative following India’s ratification, way back in 2007, of the United Nations Convention on the Rights of Persons with Disabilities. It is the way forward on extending legal protection for categories of impairments that are not covered under the current law and give fresh impetus to realise the goals of inclusive education. The newly constituted department of disability affairs in the Ministry of Social Justice and Empowerment should strive towards bringing the law-making process to fruition at the earliest. The Nymi bracelet reads and monitors the wearer's cardiac rhythm, which is as unique as a person's fingerprint, to authenticate who they are. A built-in proximity sensor can then detect where they are, and when the wearer is close to a paired computer, device or car, will automatically confirm their identity and unlock the required hardware or software. Canadian firm Bionym has created the Nymi bracelet, pictured, that identifies the wearer by tracking their unique heart rate, or cardiac rhythm. The bracelet can then be used to unlock paired computers and mobile devices and cars, for example HOW DOES NYMI WORK? When the wearer clasps the Nymi around their wrist, the bracelet powers on. By placing a finger on the topside sensor while the wrist is in contact with the bottom sensor, it completes an electrical circuit. Nymi will then vibrate and built-in LEDs light up to tell the wearer the device has successfully authenticated them. Users will stay authenticated until they remove their Nymi and the electrical circuit is broke. The Nymi functions on a 3-factor security system - the bracelent, a unique heartbeat and an Authorized Authentication Device (AAD), which is a smartphone or device registered with the app. Although other companies are also working on password replacements that use a person's biometric data such as an iris, face, or fingerprint, for example, Bionym founder, Dr. Karl Martin, claims Nymi is even more secure. He told The Verge: 'Your face, your iris — they're all physical features that can be stolen, that you leave everywhere.' The bracelet contains a HeartID that measures the amount of electrical power generated by a human heart, called a cardiac rhythm tracked on an electrocardiogram, or ECG. This ECG differs from person to person and depends on the location and size of the their heart. Nymi only works with a registered person's cardiac rhythm, meaning if the bracelet is stolen it can't be hacked. And unlike photos of people's faces and iris, or fingerprints left on surfaces, a heart can't be copied or stolen. Along with the HeartID and proximity sensors, the Nymi bracelet also has a motion sensor and connects to devices using Bluetooth. The motion sensor can be used to open car boots or doors wirelessly by moving the wrist in a certain direction, for example. Applications on smart TVs can also be controlled using flicks and spins of the wrist. Plus, Nymi can be used to pay for shopping wirelessly and securely. Hi One of the means to achieve this is by making a petition at change.org The default page, in many an occasion has accessibility issues. One should take care to make the petition fully accessible. The second big task is to get people to sign it. DGCA would be the correct authority to address it. I amy add here, DGCA is now pretty sensitive to disabled needs. yes i too was thinking of the signature petition to start with. we can also approach the press in our own capacity, starting with writing letters to reader's columns, and if any1 has contacts in the mainstream media, we could talk to a few people to do a column. meanwhile i'm going to try and talk to a senior airindia official to see whether our grievience can at least informally reach the concerned authority. i think she might also help us get in touch with the right people to voice the issue. After British Airways lost his father's luggage, Hasan Syed didn't just tweet his complaints at the company. He paid for a sponsored tweet to broadcast his frustration directly to British Airways 302,000 Twitter followers. Don't fly @BritishAirways, Syed tweeted Sunday following a trip from Chicago to Paris this weekend, Their customer service is horrendous. Syed paid for his complaint Tweet to appear in the Twitter feed of @BritishAirways, where it could be seen by their over 302,000 followers. The tweet, for which Syed paid an undisclosed sum, appeared prominently in the company's Twitter feed and was read by thousands of other users. Syed followed up his original message with others. One drew a comparison to the airline's baggage system and a photo of a horse and buggy. Hi, It's been a few years since I did c programming. Even then, it was c plus plus. I think you need to do something like this: int main() or, since main isn't returning anything, you can do void main() also, not sure, but is it possible to mix ints and floats? try to use all floats and see if it helps. Usually, when you do anything you should make sure all types are the same. I used to use a program called djgpp when programming in dos/windows. it's only a compiler and so you need to write the program in notepad and compile on the command line. Not sure if that's still around... [AI] Managing folders and files on desktop in Win 7
Dear friends, Can we arrange files and folders on the desktop in such a manner that the last created file/folder appears at the bottom right corner of the grid? CAPTCHA technology under fire CAPTCHA distorted-letter security test poses unacceptable difficulties for visually impaired users, says Australian Communications Consumer Action Network. It is one of the frustrations of the internet: trying to read those distorted letter puzzles that appear when signing up for an email account or web service. Now, consumer groups are calling to abolish those blurry - and often illegible - words known as CAPTCHA (Completely Automated Public Turing test to tell Computers and Humans Apart), which are supposed to be easy for humans to read, but difficult for computers. CAPTCHA tests stop spam by prompting consumers to prove they are human by retyping jumbled letters when signing up to new online accounts or posting online messages. They are also used to stop scalpers from scooping up thousands of concert tickets using automated software. A mix of hard to read CAPTCHAs from the web. But thousands of Australians who are blind or vision impaired are blocked from accessing websites that use CAPTCHA because they - or their screen reader software - cannot read the letters. Advertisement Teresa Corbin, chief executive of the Australian consumer group ACCAN, said that people with and without disabilities are increasingly frustrated by the use of these letters as online security tests. “They fundamentally fail to properly recognise people with disability as human,” said Ms Corbin. A CAPTCHA generated on Google's website for sign up. ACCAN is joining with other groups such as Blind Citizens Australia, Able Australia and the Australian Deafblind Council to call on organisations to phase out their use. A new kill CAPTCHA petition has been launched on change.org and has received dozens of signatures from people affected by accessibilty problems. ACCAN disability policy advisor Wayne Hawkins, who is blind, said the letter tests disenfranchised large sections of the population and make it difficult for people with disability to access online government services. Annoying: a campaign has started to kill off these fuzzy words. I have been blind for about seven years and CAPTCHA has fast become one of my most hated aspects of the web, Mr Hawkins said. I'm constantly frustrated when trying to book concert tickets online, contribute to online forums and email politicians through the contact forms on their websites. He said audio CAPTCHA, which was supposed to solve the problem for blind or vision impaired people, is almost as inaccessible as the visual alternative. But security experts say it is essential in preventing cyber criminals from creating thousands of rogue accounts on the internet. It is an inevitable safeguard, says AVG security advisor, Michael McKinnon. If we didn't have it we would be lowering the bar for criminals to be able to automate a lot of the work they do. He said that some organisations have worked out how to subvert the safeguards, such as paying workers in low-cost labour countries pay people a few cents to answer CAPTCHAs for them. The reality is that even before we get to that stage there are so many websites that have no accessibility at all. Targeting CAPTCHA is unfair because disadvantaged users often can't even get that far. The official web standards body, the World Wide Web Consortium, said there are many CAPTCHA alternatives, including simple maths questions, trivia, the use of sound files and even biometric technology such as fingerprints and retinal scanning. Microsoft have launched a substitute called Asirra (Animal Species Image Recognition for Restricting Access), that asks users to identify photos of cats and dogs instead of letters. Asirra - which uses more than three million photos of cats and dogs - could be a simpler system as computers find it more difficult to recognise images rather than text. These alternatives show that there is no excuse for the continued use of this technology,” Ms Corbin said. The Australian Disability Discrimination Commissioner, Graeme Innes, said he is unable to use text based CAPTCHA because screen readers can't recognise them.
