Dear Chief Secretaries

 

 In continuation of my D.O. letter of even No. dated 24th March 2020
requesting you to ensure accessibility of information on COVID 19 for
Divyangjan, I am now writing to you in the context of Ministry of Home
Affairs' Notification dated 24.3.2020 declaring nationwide lockdown on
account of national disaster arising out of the outbreak of Corona Virus for
a period of 21 days.

 

2.  Persons with Disabilities (PwDs) evidently are amongst the most
vulnerable group in situations of risk and many of them need continuous care
and support. While there is no denying the fact that social distancing norms
are followed during this period, at the same time it is the responsibility
of the Government to take measures to ensure that the persons with
disabilities have access to essential support services (even for their daily
living activities like caregiver support), supplies and medical aid at their
doorstep, given the severe restrictions imposed on the movement of people. 

 

3.   With a view to take care of persons with disabilities during this
emergency situation, we have developed comprehensive guidelines for
implementation by the States/UTs, which is enclosed as Annexure. We have
also suggested that the State Commissioner for PwDs should be designated as
the State Nodal Authority so that the State Disaster Management Authority
works in close coordination  with him. However, while implementing the
guidelines, it needs to be ensured that there is no violation of MHA Order
No. 40-3/2020-DM-1(A) dated 24th March, 2020. 

 

4I shall be grateful if you could issue instructions to the appropriate
State Authorities to implement these guidelines. Action taken in the matter
may kindly be intimated to us at the earliest.

I am happy to share with you comprehensive disability inclusive guidelines
issued by the Ministry of MSD and E, Dept. of Empowerment of Persons with
Disabilities, govt. of India relating to the current situation of
nation-wide lockdown in the aftermath of outbreak of covid 19. The said
guidelines speak for themselves. While I am pasting these set of guidelines
at the foot of this email, I am also sharing with you a letter/email written
by Secretary of the aforesaid department to all the Chief Secretaries of all
the states and union territories in a separate mail.

Annexure

Comprehensive Disability Inclusive Guidelines for protection and safety of
persons with disabilities (Divyangjan) during COVID 19.



In view of the pandemic situation due to the outbreak and rapid spread of
COVID19 across the world, the public health has been endangered both
nationally and internationally, necessitating urgent measures on the part of
both the Central and State Governments, aimed at containing the spread of
the disease. The Government of India has declared the situation arising out
of COVID 19 as a National Disaster and necessary guidelines have been issued
under the National Disaster Management Act, 2005.

2.  The Ministry of Health and Family Welfare, Government of India being
the nodal Central Ministry on health issues has issued guidelines for
general public as well as health workers to contain the spread of the
disease. These are available on their website (www.mohfw.gov.in  ) which inter-alia contains:-

●   Awareness material (both in Hindi and English) for citizens and
frontline workers;

●   Advisory on mass gatherings and social distancing;

●   Guidelines and procedure to be followed by hospitals including
telemedicine practices for patient care;

●   Common Helpline Numbers: 1075, 011-23978046, 9013151515

●   Frequently Asked Questions



3.  While COVID 19 is impacting the entire population, persons with
disabilities are more vulnerable to the disease due to their physical,
sensory and cognitive limitations. As such, there is a need to understand
their disability specific requirements, daily living activities and take
appropriate and timely measures to ensure their protection and safety during
situations of risk.

4.Section 8 of the Rights of Persons with Disabilities Act, 2016
guarantees equal protection and safety for persons with disabilities in
these situations. It also mandates Disaster Management Authorities at
District/State/National levels to take measures to include persons with
disabilities in disaster management activities and to keep them duly
informed about these. These authorities are mandatorily required to involve
the concerned State Commissioner for Persons with Disabilities during
disaster management.  In September 2019, National Disaster Management
Authority, Union Ministry of Home Affairs issued National Disaster
Management Guidelines on Disability Inclusive Disaster Risk Reduction
(DiDRR) in line with the above provisions.  Further, recently on 24th March
2020, Ministry of Home Affairs has issued guidelines for various authorities
so as to  prevent spread of COVID 19 for a period of 21 days  starting from
25.3.2020.

5.  While the guidelines  issued by the Ministry of Health and Family
Welfare and Ministry of Home Affairs are applicable to all citizens,  the
following measures are suggested which need to be acted upon by various
State/District authorities to give focused attention to protection and
safety of persons with disabilities during COVID 19.



6. General action points



●   All information about COVID 19, services offered and precautions to
be taken should be available in simple and local language in accessible
formats; i.e. in Braille and audible tapes for persons with visual
impairment, video-graphic material with sub-titles and sign language
interpretation for persons with hearing impairment and through accessible
web sites.

●   Sign language interpreters who work in emergency and health
settings should be given the same health and safety protection as other
health care workers dealing with COVID19.

●   All persons responsible for handling emergency response services
should be trained on the rights of persons with disabilities, and on risks
associated with additional problems for persons having specific impairments.


●   Relevant information on support to persons with disabilities should
be a part of all awareness campaigns

●   During quarantine, essential support services, personal assistance,
and physical and communication accessibility should be ensured e.g. blind
persons, persons with intellectual/ mental disability (psycho-social)   are
dependent on care giver support. Similarly persons with disabilities  may
seek assistance for rectification of fault in their wheelchair and other
assistive devices.

This is to inform you all that learned counsel Jayna Kothari, a good friend
represented Mr. Sidaraju in the case relating to reservation in promotion
where she succeeded in obtaining a landmark judgment which will have
far-reaching impact on persons with disabilities. Learned counsel Rajan Mani
had represented Mr. rajiv Kumar gupta in Rajiv Kumar gupta Vs. Prasar
Bharati  and others the judgment of which came out in June 2016 and which
was affimed by the recent judgment in the matter of sidaraju Vs. the state
of Karnataka and others.

I just heard that the supreme court of India pronounced a judgment on 14th
January, 2020 in a similar case of reservation in promotion in the matter of
Sidaraju Vs. the state of Karnatka. So far, I have not been able to lay my
hands on that judgment if any such judgment exists. Maybe, our practicing
advocate friends who are part of this list can throw some light on the issue
to set the confusion at rest. I too hope to be able to get more information
regarding the matter, maybe by next week or so. Currently, I am out of the
country for a while.

Warm greetings from New York. 

My understanding  in respect of the matter under discussion is as follows:

1.  This discussion got kickstarted as a result of a news item link of 
Hindustan Times which went viral only recently. However, I could not ascertain 
the date of the edition of the said newspaper in which the news item under 
discussion appeared. I could open the link and read the news item.
2.  
I however crosse-checked with an advocate and came to know that this judgment 
relates to a civil appeal No. 821 of 2008  between Shri Rajiv Kumar Gupta Vs. 
Prasar Bharati and others.

3.  Going by the news item referred to above, Advocate Rajan Mani 
represented the petitioner Shri Rajiv Kumar Gupta.
4.   I could locate a copy of the said judgment from a website the link of 
which can be found at the bottom of this mail.
5.
 Towards the fag end of this judgment, it has been stated that another civil 
appeal  No. 5389 of 2016 is also accordingly disposed off. Details of 
petitioner in the said other civil appeal No. 5389 of 2016 could not be 
ascertained from the said judgment as posted in the website the link of which I 
am sharing. 

6. The news item of the Hindustan Times referred to above mentions the name of 
Advocate  rajan Mani as counsel appearing for the  petitioner Shri Rajiv Gupta; 
and does not mention the name of any other counsel.

Looking behind at the decade gone by and looking forward towards this new
decade, my thoughts linger on a few aspects.
I invite you all to crystal gaze on what we can look forward in this decade.

We got the new RPD act. Railways have seen noticeable developments in
accessibility. Banking has been a mixed bag with more accessible ATMS
available to us but accessibility of Banking portals and apps has been
inconsistent.

Currency notes has taken a nasty beating in accessibility.
 There are signs that coins may be now accessible. However I feel the role
of currency notes and coins will give way to digital transaction in this
coming decade.
Transportation by and large will become more accessible and friendlier to
the disabled. Many more cities will have metros running.
We can look forward for Bullet trains and even hyper loop trains.

There would be drop in petrol and diesel driven vehicle with electricity
driven vehicle taking its place and of course the self-driving cars would be
a reality.

I anticipate that synthetic vision will to a good measure minimize visual
disability.

I guess work related travel will be considerably reduced. Working
environment will also see changes. I anticipate the working hours could
shrink.

Some job types could be lost and hopefully newer ones will take its place.

Drones will be visiting us bringing all the essentials to us instead of the
delivery boys.

I see serious concerns on privacy and it will be challenging to have control
of our mind. Our mind will be highly influenced by technology and substances
That independent thought and opinion will be an highly endangered specie.
The state and corporates will have a larger say and influence on us. This
would not be desirable at all.

I feel even AccessIndia will have little need to be around and I don't think
it could sustain over this decade.
These are my own thoughts and you are free to differ with all or any of
these.

 persons with visual impairment by giving this assignment to me. Effective 
 August 1 '07, I am joining this Company back as Senior Manager Seccurity 
 Administration. My position will be No. 2 in the Division which looks 
 after the Seccurity and Administration of Tata Steel, Community Services, 
 and Land, Market,  Estate belonging to Tata Steel at Jamshedpur. I will be 
 reporting to Chief Seccurity Administration. I joined Tata Steel in 1992 
 and left the same in 2005 to work as Head Business Excellence for JUSCO.

hello there!

Just in case you're interested--The Ministry of Social Justice and Empowerment, 
Govt. of IIndia is holding a consultative meeting on the amendments to be made 
in the existing Pwd Act. The said meeting, I understand, is for the northern 
and central India; and it is being held in Delhi on the 14th of August next. 
This will be followed by a similar meeting for the Western zone of the country; 
but the date for that meeting is yet to be finalised. In case, you are 
interested, you may like to explore the possibility of getting invited with the 
concerned ministry. I personally feel that since this act has direct 
implications on our lives as blind persons, we need  to actively participate 
and significantly contribute to the exercise; and for this, to my mind, it 
would be expedient if we do our homework well. Here, we can only ill afford to 
lose sight of the fact that any amendments in the said Act will have to be in 
consonance with the UN Convention on the rights of persons with disabilities.

In the meantime, The disability rights group led by Javed Abedi is also 
organising a national level meet on the said Convention in Delhi on the 27th 
and 28th instant. You may like to contact him for further information on this.

respondents were given so time to file counter afidavits which they had not 
till I last spoke to my counsel. However, I will get in touch with him soon
