Summary

Examination for recruitment to Delhi Higher Judiciary Services is
scheduled to be held on April 6

 Observing that the Disabilities Act made it mandatory for all
government organisations to reserve at least 3 per cent vacancies for
the disabled, a division bench of the Delhi High Court on Tuesday said
the decision of the High Court administration to not include the
disability quota in the upcoming direct recruitment process for the
Delhi Higher Judicial Services was arbitrary and discriminatory.

The non-inclusion of DHJS cadre posts for the purposes of reservation
under the Disabilities Act, cannot be upheld; it amounts to
discrimination, court of Justice S Ravindra Bhat and Justice R V
Easwar said.

The court has also directed the establishment to carry out a review of
the remaining number of vacancies in the DHJS that can be
appropriately earmarked for those with disabilities according to the
total number of sanctioned posts, following which it could recruit
the appropriate number of persons in the next round of recruitments.

The court has directed the administration to carry out a special
recruitment procedure for only the earmarked vacancies falling to the
share of those entitled to be considered under the 3 per cent quota
under the Disabilities Act, within a year of the date of declaration
of results in the current recruitment process.

DHJS refers to appellate courts, which exercise appellate authority
over the lowest level of judiciary. Direct recruitment to DHJS is done
through an examination held by the High Court Establishment (HCE).

The HCE had issued an advertisement for recruitment to 14 posts in
December last year, setting aside four seats for SC/ST candidates and
10 for general category. The examination for these seats is scheduled
to be held on April 6.

The order was given on a plea filed by an advocate who suffers from
locomotor disability, who had alleged that non-inclusion of disability
quota in the DHJS recruitment was contrary to the express provisions
of the Disabilities Act.

Advocate Nishant S Diwan, who has been practising as an advocate since
1998, had also argued that the HCE was under a duty to set-apart
appropriate number of posts having regard to the total cadre strength
of 224 posts in DHJS.

The HCE had taken the decision that the disability quota would not
apply to the DHJS recruitments and would only apply to the magistrates
and civil Judges, since the notification issued by the Ministry of
Social Justice and Empowerment had mentioned only magistrates of the
subordinate judiciary. The HCE had also taken the plea that since the
examination was scheduled for April 6, imposition of any quota at this
late stage would upset the entire timeline and delay the recruitment
process.

The court held that there can be no difference for reservation under
the Disabilities Act between the DJS and the DHJS since the DHJS
officers perform duties and functions similar to those in DJS.

The court directed the administration to set aside one of the 14 posts
for persons eligible under the disability quota, but has directed that
the seat should be kept vacant and should be clubbed with the next
round of recruitment.

Dear all,

All India confederation of the blind has been conducting Intensive
training courses for the benefit of visually impaired girls for last
several years under the sponsorship of Marga Schulze Foundation/CBM(
Germany). The participants are imparted intensive practical training
and theoretical instructions in home management, basic stitching,
mobility, computer applications, self-defence techniques and
leadership skills.

This year the course shall commence from 26th May for five weeks.
Graduate and post graduate girls in the age group of 18-35 shall be
given preference.  Selected candidates shall get free board, lodging
and training facilities.  The best seven participants shall also be
provided Toshiba laptops with screen readers on behalf of Marga
Schulze Foundation/CBM.  Preference shall be given to participants
from other states. The candidates shall also receive Rs. 1200/- on
account of pocket money. The participants shall also receive train
fare at concessional rate by AC 3 tier. Those who are interested

31st March, 2014 along with bank draft of Rs. 1000/- in the name of

Dear Friends,

It is a matter of satisfaction for us to share with you that owing to
some recent advocacy successes of AICB important pronouncements have
been made by the CCPD bringing smiles to more faces. In February this
year, AICB had filed a case against Jamia MilliaUniversity for an
absurd advertisement which was issued by this University. While it
pretended to reserve four vacancies for the visually impaired, three
of these vacancies were reserved in subjects which the blind do not
study in India, for instance, Physics, Civil Engineering as also
Bio-Chemistry. The attempt was obviously to show that the University
was complying with reservation under the PWD Act, but at the same
time, to ensure that no blind persons were appointed.

Owing to our persistence and strong arguments in this case, the CCPD,
who is always sensitive to issues relating to persons with
disabilities, in particular,those pertaining to visual impairment, has
recently quashed the said advertisement and has directed the
University to issue a fresh advertisement reserving vacancies in
subjects which are normally studied by blind persons. This will
provide job opportunities to a number of qualified persons.

2. While this issue was taken care of at the recruitment stage itself,
another employment related matter has been complied with by the
Respondents, the Indian Bank just yesterday. One visually impaired
person belonging to Tamil Nadu was denied appointment letter by the
Indian Bank despite the fact that he was selected. Reason? His
blindness. It was contended by the Bank that the Post of Probationary
Officer was not identified for the blind.

We took up this matter with the CCPD. In our petition, through various
arguments we proved that this post is actually deemed to be identified
for the blind.

The notice was issued by the CCPD and just yesterday, the Indian Bank
has issued an appointment letter to the concerned person, the only
earning member of his family.

While we continue in our efforts to fight against discrimination
against the visually impaired, we look forward to receiving more such
issues from you.

Dear Colleagues,
You may be aware that we had
announced All India Madanlal Khandelwal Essay Competition, 2013 in the month of
May and last date for receipt of Braille essays was given 31st August.
 Some of our friends have been
approaching us to extend the date and accordingly we are pleased to announce
that the date has been extended upto 15th September so that more
blind brothers and sisters in junior and senior groups could
participate.  You are therefore requested to inform the
interested persons in this regard on priority basis.
For your convenience we give below
the rules and regulations and topics for junior and senior groups and hope you
will motivate blind brothers and sisters to take part in the competition.

1.There
will be two groups of competitors—one Junior group up to the age of 25 years
and the second Senior group from the age of above 25 years.
2.The
participants can write on the following topics:

Junior group (Hindi): “Swarg mein sthit Louis
Braille ke naam ek patra.”
Junior group (English): “A letter to Louis
Braille in his heavenly abode.”

Senior group (Hindi): “Drishtibadhitaon ke
liye Riyaten—Samanta Ve Samaveshan ke liye khan tek Sarthak?”
Senior group (English): “Concessions for the
blind Vs. equality and inclusion.”


3.The
essay should be written by the blind participants in Hindi, English, Tamil,
Marathi and Kannada.
4.Essays
should be written in uncontracted Braille in Indian languages.   For
English, the essays should be written in
contracted Braille (grade-2).
5.Essays
should be written by Braille slate or Braille typewriter/Perkins
Brailler.  In no case should the essays be entered on
the computers and converted into Braille through a translation software.
6.Essays
should be written on one side of the sheet only and each page number should be
marked in continuation at the top right-hand corner.
7.Minimum
length of the essay for junior group
should be between 600-800 words and for senior group between 800-1000
words inclusive of applicant’s name, age, address phone No., topic of
the
essay.  The essays not written as
per the prescribed word limits shall not be included in the competition.
8.The
Competition has certificates and three cash prizes of Rs.  6000,  4,000
and 2,000 for junior group and Rs. 8000, 5000 and 3000 for senior group in each
language.  Thus, in each language there
shall be 6 cash prizes for the winners.
9.The
essays must be completely original in nature.
10.The essays in each
language shall be examined by reputed persons and their decision shall be final
and binding for all.
11.For determining the
best three entries in each language group the following shall be kept in mind:
  i.Content
ii.Language
and style
   iii.Braille
proficiency and neatness
12.On each envelope
language of the essay and junior or senior group should be mentioned.

Relief for Hundreds of Visually Impaired Special Educators Looking for
Employment: Important CCPD Judgment in a Case Filed by AICB

Dear Colleagues,

It is a well-known fact that the blind and the low vision
children studying in inclusive schools are in most need of support from Special
Educators trained to teach them. The irony is that though hundreds of visually
impaired persons hold diplomas/degrees in special education and are competent
to work as Special Educators, they are often denied employment because as per
the 2007 identification list of MSJE, the post of Special Educator is not
identified for this disability category.

As AICB had received a number of complaints from the blind
and the low vision persons in this respect, we filed a case in the Court of the
CCPD contending that as per a notification of May 2001, a post with a different
nomenclature but having similar functions to an identified post, is also
considered to have been identified. Therefore, we argued that the post of the
Special Educator, in effect, is identified for the visually impaired and,
reservation and employment cannot be denied to them.

During the case hearing on Monday, 17th June,
2013, our Vice President, Dr. Anil Aneja, while strongly arguing this case in
favour of the blind and the low vision, put forward many weighty grounds. In
addition to the above contentions and among various arguments, he contended
that the RCI is the statutory body to govern professional standards in the
field of disability and the RCI conducts only disability specific courses in
Special Education. The visually impaired, like other persons are registered as
“Special Teachers to Teach the Handicapped” in category 5 of the
CompositeRehabilitation
Register of RCI. This is the only category of CRR in which the special
educators are registered, and thus, certified and registered as qualified to be
Special Educators, the visually impaired cannot be denied their right of
employment and reservation on the post of Special Educator. Further, Dr. Aneja
stated that there is no course in Special Education which is designed for
educating a person to teach students belonging to all disability categories.
Therefore, the assumption that a Special Educator can teach students with
various disabilities, is erroneous, illegal and therefore wrong.

Upholding our contentions, the Chief Commissioner for
Persons With Disabilities, Mr. P.K. Pincha passed a landmark order soon after
the hearing in the Court itself. He held that as per the Principles enshrined in
the said 2001 notification, the post of Special Educator is deemed to be
identified for the visually impaired, and therefore, he directed the Department
of Education, Government of National Capital Territory of Delhi, to consider
identifying this post for the visually impaired within a period of two months
and report the action taken to the Office of the CCPD. Mr. Pincha further
directed that even if a vacancy is not reserved for the visually impaired, they
cannot be denied their right to compete in the open selection, a practice which
was hitherto being followed by the Delhi Government and was a barrier for
scores of blind and low vision persons.

While we express our indebtedness to the CCPD, we are sure
that the entire visual impairment sector would join us in welcoming this
judgment which will benefit hundreds of visually impaired
persons and also the blind and low vision children studying in inclusive
schools.

office stating that IIBF is not prepared to accept the Guidelines
issued by the Department of Disability Affairs in connection with
extra time and scribe.  Accordingly, our Vice President and Chair of
the Advocacy Committee, Dr. Anil K. Aneja took up the issue with IIBF
authorities as well as Chief Commissioner, Disabilities.  Both have
taken affirmative action.  I enclose herewith letter dated 7th May
received from IIBF which meets the requirement of our friends.

Sub: Inadequate Extra time while using a scribe during the JAIIB/CAIIB
Examinations
This has reference to your letter AICB/A-4/2013 dated the April 29,
2013 in the captioned matter.
The Institute has considered the representation of our visually
impaired member candidates to you and decided to provide 20 minutes
extra time per hour from current 10 minutes per hour.
At present 82 visually impaired members/candidates are taking the
examinations from different centres across India. Institute is
conducting examination in more than 300 centres all over India and you
will appreciate we require time to make arrangements for visually
impaired members. If our members feel that 2 months period is too long
a time and causing difficulties to make arrangements of scribe, we
will consider their request for scribe even if sent to us 1 month
before the date of examination.
Institute is bringing the above changes to the notice of our
respective Zonal Offices and also the  Examination Centres.
Institute having existence of more than 84 years is equally concerned
about hardship and disadvantageous position of our visually impaired
member bankers and would assure to do whatever possible to overcome
the difficulties faced by them.

Sub:  8th Onkyo Braille Essay Contest in the Asian Region.

Dear colleagues,

Asian Blind Union’s Secretariat has informed us that they propose to
hold 8th Onkyo Braille Essay Contest in collaboration with Braille
Mainichi Newspaper Company, Japan in the Asian region.  Information in
this regard has recently been received from the Secretariat.
Participants who are interested to take part in the essay contest,
they should send their essays to All India Confederation of the Blind,
Behind Rajiv Gandhi Cancer Hospital, Sector-5, Delhi-110085 latest by
31st May, 2013.  No essay thereafter shall be accepted.  On the
envelop name of the competition (Onkyo Braille Essay Competition) must
be mentioned.

The detailed rules and procedure for the Contest are given below:

(i) The participants can write on any one of the following topics in
Hindi or English:

a)  Inclusive society for persons with visual impairment, How?
(Drishtibadhit vyakatiyon ke liye samaveshi samaj—Kaise?)
b)  Access to information and knowledge resources, are there priorities
and how? (Gyan aur soochna ke sadhno tak pahunch--prathmiktaen hain
aur Kaisa?
c)  What are your priorities as a political international leader, how?
(Ek anterashtriya netaa ke roop mein aap kee kya prathmiktaen hain aur
kaisa?)
d)  Social media and blind community. (Samajik media aur drishtibadhit 
samuday).

(ii)The Essay should be written by the blind participants in English
or Hindi in Braille on Braille slate or Braille typewriters and not on
computers.

(iii) Maximum length of the Essay should not exceed to
1200 words.  The Essay should also include   applicant's name, age,
title and other details to be covered within the maximum number of
words (1200) allowed.

(iv)There will be two groups of competitors—one Junior
group up to the age of 25 years and the second Senior group above the
age of 25 years. We suggest that the visually impaired participants
from junior group should also be motivated to participate in the
context.

v) The Essays must be completely original in nature.

vi)  The Competition has separate prizes for junior and senior groups.

a)  First prize of USD 1000 for overall best entry from senior or junior 
group.
b)  Second prize of USD 500 for one winner from senior group and one
winner from junior group.
c)  Third prize of USD 200 for one winner from senior group and one
winner from junior group.

You are requested to give widest possible publicity to this event so
that Indian participants could take part and win the prizes.

accept whatever he said is correct. He should apologise for his loose
talks.

We, south indians are not partial. But as far as I've noticed, this
list is being bit relaxed with it's rules to the north indians and
being very rigid to the south indians. I was told many south indian
list members' messages are not reaching the list and even after they
are sending many complaining messages to the moderator. I can give you
one example, Nagarajan from madurai said that his messages are not
reaching the list. Likewise, I was told by many as their messages are
not reaching. but they are getting all the list messages. I wonder
whether south indian's messages are being filtered?

i do wonder what do you mean by third party messages? The subject raaj
was asking clarification is with regard to disability. and that's no
way going beyond the list's guidelines. If you moderate that message
by telling it's beyond the list's guidelines, I don't think this is
not the list for discussing disability related issues, then. While
saksham is announcing their RNIB products available for sale, while
helpdesk is announcing the vacancies, what's wrong in asking
clarification about disability commission?

I'm seriously confused with your hidden secrets aka justification of
your decision with regard to this. Are you trying to say that we
people shouldn't ask any clarifications? or, are you against
disability commission? I guess you might've noticed a few others were
also telling that those officials are being rude with them as well. In
such case, why don't we discuss about it here?

I dono whether I'm gona get banned out of this list or whatever, but
I'm straight with my point. Modeerator or whomever it is, that was a
loose talk for sure. asking a list member as is this a branch office
of disability commission? If I was the moderator, I could've seriously
gone for an apologise for that. You're acting like a politicians.
rules are all for the poor but we politicians can do anything in
India. eh?

status enabled.  And I finally clicked closed and opened the internet

Hello,
The notice board installed on such counters clearly displays the
categories of persons who can book there tickets through such special
counters.
In New Delhi, there is a special counter exclusively for the disabled.
In other small places, disabled have to share the facility with senior
citizens and in some cases with ladies as well. Pertinent to mention
that all the places you don't find this facility. However, if one is
very assertive, not require to stand in queues as disabled do not have
the facility to book their consessional ticket online while others do
have such facility.

However, I think they cannot curtail encashment merely because the

Well, at RBI I had made representation permitting me to a) travel 
additional distance, B. Travel in a higher class and C. Take an 
escort upto the extent of myeligibility. All the three were 
considered and it is now encorporated in the Master circular on LFC.

Dear All,

We are happy to share with you an important order of the CCPD
concerning the problems being faced by the visually impaired in the
recruitment processes of the Staff Selection Commission. AICB had
brought these issues to the notice of the CCPD by filing a public
interest matter in March, 2010.

As you may be aware that a substantial number of recruitments for
groups B, C and D services of the Central Government are made through
the Staff Selection Commission. The visually impaired persons face
considerable problems while taking the skill tests for these posts
because screen reading softwares are not provided and/or allowed by
the S.S.C. Instead, a reader is allowed to read out the screen to them
which negatively impacts their typing performance. This year, the
S.S.C. has insisted on using only inscript keyboard whereas a large
number of blind persons have learnt typing on other keyboards. As the
skills tests are to begin during this fortnight, the CCPD was
requested to hear the matter on an urgent basis.

The hearing took place on 5th January, 2012. After hearing the
arguments of our Advocacy Chair, Dr. Anil Aneja, important directions
have been given to the S.S.C. regarding accessibility provisions for
the visually impaired while taking the skill tests. The choice of
keyboard has been allowed rather than insisting on a specific
keyboard. Also, the Staff Selection Commission has been directed to
either provide appropriate screen reading softwares on the computers
for the test or allow the visually impaired candidates to use their
own computers during the test.

This order of Mr. P.K. Pincha, CCPD will significantly ease testing
conditions for the visually impaired resulting in their better
performance. AICB will continue its fight to ensure full accessibility
in all testing processes relating to employment and education.

As the skill tests of the S.S.C. are to commence very soon, you are
requested to give wide publicity to this information so that the
concerned visually impaired candidates can avail of the benefit of
this order by producing it at the testing centres.

(AICB) will start publishing in Braille three mainstream magazines in
five regional languages. from January, 2012. These magazines are:

Mangayar Malar in Tamil.

The first Braille editions of these magazines will be released on 4th

I faced the same issue and solved by doing the following:

1. When JAWS becomes speechless after pressing the browse button,
press ault+F4 to come back to the browse button.
2. Unload the JAWS without closing the webpage.
3. Go to the desktop and click the JAWS icon again.

When JAWS starts, you should be able to use the browse button without
any problem.

P.S. A suggestion: When someone faces issues of this kind, it is a
good idea to give ellobrate suggestion rather than stating that it's a
configuration problem. The concern person would have corrected it had
it been known to him. Isn't it?
