I don't, in fact I still play them quite often and grew up with the kitchensync games as some of my first. Sure, I think that asset steeling can be tacky or lazy at times, but who am I to judge when it comes to older titles especially, given that a wide selection of high quality, legal and properly licensed free sounds was not available back then like it is now, and that people pass around big collections of random SFX with no ill intent all the time and their friends are just happy for the help and completely oblivious to the legal ramifications.This has nothing to do with morals or personal opinions and everything to do with consistency and honesty. No amount of convincing emotional arguments are going to change the facts of the situation, nor how the rules are currently written.@RTT entertainmentYou don't need to convince me... I really need to look into what doing a full backup does - i.e. does it backup the site, forum, sql databases for it all, or just the site database. The next best thing to contacting the webmasters is flat-out relocating, but we cn't relocate and not take this site's 20 year legacy with us, that isn't an option. You have to admit, even though this site is kind of falling apart, it as an independent site has lasted longer than any of your run of the mill social media sites that think they're still soldiering on now. If a game relies on online activation, and even the customers who previously bought the game can't register it, we declare it as abandoned and the distribution is allowed. If, at any point the developer comes back and complains, his requests should be accepted and the game should no longer be distributed, provided the developer can explain the downtime and bring the activation servers back up. I don't see any potential legal issues here, you aren't going against the developer and will accept his takedown requests if there are any. What you could possibly do is write some kind of disclaimer in the rules clarifying this, that the games are distributed only due to the belief that they are abandoned, and if a developer doesn't want his games distributed they can contact the moderation team. Games by VIP gameszone are effectively unusable now, whether online or offline, purchased or demo, you can't do anything because they relied on online servers so much. Thankfully, I don't think you will have to worry about this very often, because games nowadays at least allow registrations offline. I also don't know of any demo that forced you to go online to register it. They've been down long enough, nobody has been able to contact them and we can't even use our registration keys.I think this should count for Rale Racer as well, but the BA card room is still up though no reply about rale racer.Plus RR is our only fully-fledged racing game, and probably the only one we're going to have for a long, long time. AS for Kitchen's games, I think it's fair that we not touch those whatever stance we end up taking. The guy's past away, removing the games of someone who isn't even around to defend it because rules is just being a dick for the sake of being a dick. And Jim Kitchen has a legacy that should not be forgotten/removed, and has long-since earned his place in the audiogame hall of fame if there ever is one, so keeping the games alive on the only official source for audio games is, I'm sure, what he would want.Same with Tom Ward.Besides, the whole cp situation is a result of the game still being actively developed and fervently refusing to quit the piracy charade. God points 60 and 61, this is what is keeping us from just saying screw it and allowing distribution - even though they probably don't have the resources to take anyone to court over it, the law is still the law. I think the thing we need to remember here that doesn't necessarily make us special, but is something to consider, is the fact that there are no publishing agencies here. There is only an individual entity. So is the company closing its doors necessarily by choice? Most likely not, but was it a choice to screw over customers who had actually bought the game by basically vanishing? Absolutely. By not implementing a contingency plan, they had, whether directly or otherwise, choose to slam the door on the ass of customers who had bought the game should the need to close operations arise.I'm tempted to just say let's just toss the damn games, but audiogames games are not disposable and these games weren't all that bad. EA has, as Defender says, a history of pulling down servers without a care in the world. Even abandonware (which btw is a legal gray area, I can think up a handful of software companies who actually asked sites to take down their stuff) hasn't been ruled legal or illegal, but in the vast majority of cases is a cracked downnload anyow for DOS games, or a .iso file.There's whole communities dedicated to abandonware, but the thing people forget is someone, somewhere, owns the rights to the software. Even if the company went out of business, whoever signed the contract may still very well own the rights for that software, or people. So no, I'm agreeing with Defender on this one. Hell, I've been banned from other forums for asking for things I didn't even know were pirated content and didn't even gett a warning, just a straight up get out of our forum response. I have no idea how, the chocolate just mysteriously disappeared, one minute it was there, the next it was gone! I suspect time travel might be involved somewhere .To be serious for a second, whilst I was administrator, the policy such as it was, was basically that people couldn't' pass cracks of the bavisoft games around on the forum, but wouldn't be penalised for asking for them either. At that point though, things were a lot more relaxed as regards the copywrite issue, and we hadn't had any of the cloned code debacle, so it was easier to sort of just bend the rules, rather than try and make specific new rules. I personally love the idea of the games being hosted for all the reasons Munawar outlined above, and because yes, I would actually like to play the games I paid for myself.Indeed, I will admit to having the Bavisoft cracks , simply because it's easier than hunting out the old cds, though again, a very disappointing fifty bucks worth methinks.I would personally suggest that a very strict ruling needs to be put in place as regards firstly how long the developer's website has been off the internet, secondly details that every effort has been made to contact the developers in question, and thirdly and most obviously, a cast iron rule that one word from the actual developers and everything could be taken down at a moment's notice. So, even developers who are at the moment less than activesuch as code factory would have their past work protected, but those cases where devs have literally sunk without a trace, their work won't be lost entirely. just a shame the same can't be done for Ios and games like the somethinelse titles, but Apple are nice like that . Given Code Factory actually employed Starforce DRM (which actually has a nasty history of mutilating you cd drive's hardware drivers itself) I'd say they're a close second, only reason being that they had only deployed the disk drm in one game out of their many. I'd like to play Galaxy ranger and Lords of the galaxy again myself, I have fond memories of both as I said, as well as all my old purchase information and even copies of the setup files. It would also be nice to get x hour working, though imho that one was slightly less unique.Actually, since when I first bought the games in 2006, I was still living in college, whose wifi network wouldn't let me play online, I mostly just played the computer. the Ai was rather pathetic and I got to slaughtering it on insane level of Galaxy ranger fairly quickly, but I had fun anyway . That was why I didn't'! buy super football, given that by the end of the three day demo, I'd already distroyed the computer 14 to 1 on hard difficulty .unfortunately, my xp desktop which I'd had since 2008 went to wherever good computers go in 2016, and obviously by that point Vipgameszone and their server were long gone. I did have a copy of Galaxy Ranger 1.0 at the time, but even that one you had to register. So if yours runs without registering that would have had to be them doing what APH usually does with their cd distribution, i.e. not requiring a disk.I'm honestly not sure how we can approach this one. The Bavisoft games for example, have aparently made their way into the Internet Archive where anything preserved is pretty much future-proof there. The entity who uploaded them identifies themselves as Bavisoft, though whether or not they actually are is certainly up for question. The disks have apparently been up since 2015 and there have been no complaints or takedown requests. So if the site is down, the team is totally unable to be contacted, and yet they've made their way on to the internet archive, I'm wondering what that means in terms of distribution. Baring in mind the fact that this grayarea is reserved for games that have an obvious status of being out of print/circulation, which Bavisoft and VIPGameszone certainly fall under that category. When it gets to the point where even legitimate users are impacted by game breakage due to the registration drm, that could be evidence to counteract any potential complaints if they even were to come our way. Actually, while I wasn't as keen on their sports titles, I did enjoy their other games, Galaxy ranger was not only a strategy at a time when audio strategy games were at a minimum, but also had a rather fun mix of arcade action and map exploration, whilst X hour had a few interesting little minigames throne in. I never actually finished that one, though I did make it to episode 3 I remember. Philip did do beta testing for Super Tennis, but I highly doubt anyone has personal contact details for these folks - Justin Daubenmire might, considering he was the only developer Igor actually collaborated with full-time as a programmer for HUnter, but although I was able to get his permission to host the games, I doubt he will be able to do anything regarding VIPGameszone titles. He was never able to make arrangements for 15 numbers to be included in the closing deal or the unlock code generator anyway. Unfortunately, I'm not aware of any way, and to make things worse, even that 3-day trial required internet activation making 90% of all their games, with the exception of super Tennis, xHour and the free titles completely unplayable.
