[BVARC] Museum Ships Weekend - Report of the confirmation and figuring reconnoiter - Sunday January 15th

  The work day went well on Sunday (1/15) thanks to all who showed up! We had 8 
BVARCians aboard. 
   
   - We were able to remove the broken vertical and trace/test the previously 
installed coax back to the radio room. 
   - We also temporarily hung a wire antenna from the open bridge to the flag 
pole at the bow. We extended one of the coax leads through a porthole we opened 
in the bridge. This antenna was tested and appears to work well.
   - We were pleased to find that the coding closet was already cleaned up and 
organized, and we'll keep it this way. There is a reel of coax there (BVARC's) 
which we'll retain there for future use (maybe elsewhere or in the Cavalla).
   - On leaving, we took down the temporary antenna and removed the scraps of 
the broken antenna.
   - We weren't able to retrieve the box of BVARC "junque" that is stored 
elsewhere on the ship. We'll get that in due course.

For a future visit, we're hoping to install a marine grade VHF/UHF antenna 
where the broken antenna was removed. We're also looking at how we might add 
temporarily, either an HF vertical or 80m long wire (say, to the stern) for the 
MSWE event. We may even try to activate the Cavalla, depending on how other 
We also want to time our visit better that we can do a radio demo for the 
scouts. The visit yesterday, actually wasn't conducive for a demo, due to the 
other efforts we made.

Agree,I'd like him to specifically address these following points (sent 
previously):
   
   - The bill does not address indefinite inaction or delay by an HOA (not as a 
result of failure) to enact reasonable rules and/or permit an antenna. 
   - The bill does not define the steps to HOA approval. In that quixotic 
hurdles can be required of the licensee, as part of the HOA approval process.
   - That guidance is lacking and should be provided "concerning height, 
location, size, and aesthetic impact of, and installation requirements for, 
outdoor antennas and support structures for the purpose of conducting 
communications" before the bill is passed.

This pending legislation is the worse piece of manure I have seen for the 
amateur radio community since the days of Prose Walker and the WR repeater 
license debacle.


To give HOAs such power as proposed is totally against what the original relief 
of the proposed bill was supposed to provide. Amateurs NEED some relief from 
HOAs and this bill does NOT provide it.

 

It must be KILLED or withdrawn and revamped ASAP.

 

As a broadcast engineer and owner (KLLS 1300), I cannot believe this 
legislation was allowed to get this far with the ARRL HQ help.

 

I am a life member of the ARRL and DEMAND the BoD withdraw support for this 
bill and draft a new one in the spirit that this was originally intended; to 
allow amateurs to put up reasonable antennas WITHOUT HOA approval (similar to 
PRB-1 for Over The Air Reception Devices).

 

Otherwise, this proposed bill will kill any chance of an amateur radio operator 
in a HOA controlled area from ever able to install ANY antennas (HF or VHF/UHF) 
and will lead to those who have been operating with stealth antennas having to 
face fines and dismantled such antennas.

 

Shame on the ARRL BoD for allowing this to even get to this point.

have unintended detrimental consequences to the licensee:

To the BOD of the ARRL and others:

This pending legislation is the worse piece of manure I have seen for the 
amateur radio community since the days of Prose Walker and the WR repeater 
license debacle.

To give HOAs such power as proposed is totally against what the original relief 
of the proposed bill was supposed to provide. Amateurs NEED some relief from 
HOAs and this bill does NOT provide it.

It must be KILLED or withdrawn and revamped ASAP.

As a broadcast engineer and owner (KLLS 1300), I cannot believe this 
legislation was allowed to get this far with the ARRL HQ help.

I am a life member of the ARRL and DEMAND the BoD withdraw support for this 
bill and draft a new one in the spirit that this was originally intended; to 
allow amateurs to put up reasonable antennas WITHOUT HOA approval (similar to 
PRB-1 for Over The Air Reception Devices).

Otherwise, this proposed bill will kill any chance of an amateur radio operator 
in a HOA controlled area from ever able to install ANY antennas (HF or VHF/UHF) 
and will lead to those who have been operating with stealth antennas having to 
face fines and dismantled such antennas.

Shame on the ARRL BoD for allowing this to even get to this point.

[BVARC] HR 555

To whom it may concern:
   I have  had a non partisan attorney look at HR 555 as to what 
rights it gives a armature  radio operator.  There are some grave concerns. 
Most notable is that  there is NO definition of what is reasonable as to 
height. Also there seems  to be no pressure on the HOA's to accommodate the HAM 
in a timely manner.  HOA's have deep pockets and can drag any resolution out 
for years in which the  HAM is hung out to dry. If this bill passes I do not 
see that the ARRL has  served the members and am hearing rumbling that many 
LIFE members are willing to  terminate there membership as they feel that 
you are not listening to them or  representing them.

This is an EXCELLENT e-mail.  I too sent one, but didn't think to c.c.the BVARC 
Reflector.

 

There is one error in your e-mail.  At the TDXS meeting, you heard John 
Stratton cite that the law is not grandfathered and with the mere existence of 
the law you are in violation of a federal law as soon as it becomes law.  You 
can't leave the antennas up pending disposition of your application.  

 

You are not alone.

 

I'm confused with Scott's e-mail.  I don't understand it's purpose.

Gentlemen,

 

I am a radio amateur.  

 

I have successfully operated within my HOA controlled subdivision since 2008 
without any consequences.  However, the provisions of HR 555 would require me 
to get approval from my HOA for my existing antennas.  If the HOA should not 
approve them, I would have to take them down or be in violation of FCC 
regulations, according to HR 555

 

Presently I invested over $10,000 in station equipment in joyful pursuit of my 
hobby. If this bill should become law, my equipment will be useless without an 
antenna.  So where can I send the ARRL the bill for all the equipment I can no 
longer use?  HR 555 requires the HOA to approve any antenna system.  Every HOA 
has an architectural committee which approves all property improvements.  Do 
you think they are going to like my three element Yagi on a 30 foot pole or 
even a simple vertical antenna 30 feet in the air?  To HOA’s, structures like 
that are anathema.  

 

Having been involved in an HOA, I know that this kind of request means nothing 
but delay at best.  They receive the request; consider for some time; a very, 
very, very long time. You, the ARRL Board, know this too, or perhaps you never 
had to deal with an HOA?  How do you expect an HOA committee of laymen 
determine what constitutes an effective antenna? 

 

What are you thinking? There is nothing in H.R.555 to motivate an HOA to behave 
otherwise. There is nothing in this bill that that gives the amateur any right 
or leverage to pursue our on-the-air activities without approval from the HOA.

Here's my contribution. 

Dear ARRL Officials and Fellow Ham Radio Enthusiasts: 

The way I read HR 555, home owners associations will hold all the cards in 
determining whether or not we amateurs are allowed to have an amateur radio 
antenna at our homes. If it is not withdrawn and/or modified, it looks to me 
like amateur radio as we know it will soon begin to fade away. Very few of us 
can live in remote locations where there are no rules regarding antennas. 

I realize we don't have a lot of lobbying power, but I suggest seeking the help 
of local county Homeland Security officials across the country. Ask them if 
they want to go forward without the help of amateur radio operators when 
disastrous events destroy power and communications infrastructure. I doubt they 
will be okay with that idea. But I also doubt many of them are even aware of 
this horrible legislation. And I'd be willing to bet that radio and antenna 
manufacturers and vendors would happy to help sway opinions as well. They have 
everything to lose. 

I'm sure HR 555 was negotiated in good faith, but I implore you to look at it 
from a more realistic point of view. I am new to ham radio, but I already have 
a substantial investment in this wonderful hobby and I look forward to helping 
local emergency officials in times of need. In truth, I believe our country 
needs us. Please don't allow the narrow focus of property values to ruin this 
wonderful hobby.
