Bug#751871: libjava3d contain is non-free codes (BSD + additional restriction)

2014-06-18 Thread Emmanuel Bourg
This issue has been discussed on debian-legal two years ago:

https://lists.debian.org/debian-legal/2012/09/msg00034.html

The common interpretation is indeed a warranty disclaimer and not a
usage restriction.

Its non-free, Violate DFSG 6.

1. Remove non-free codes and rebuild.

2. Replace DFSG-Free codes.

3. Remove to archive.

4. Move to non-free.

Thanks.

The exact mention after the BSD license is:

You acknowledge that this software is not designed, licensed or
intended for use in the design, construction, operation or
maintenance of any nuclear facility.

I think licensed is this context should be read as certified by an
official administration for use in the nuclear field. See for example
this document detailing the certification criteria in several European
countries:

Licensing of safety critical software for nuclear reactors
http://www.onr.org.uk/software.pdf

With this statement the copyright holder waives any responsibility if
this API is used in a nuclear facility, but he doesn't forbid such a use.
