I was looking for something similar a while ago for a different project and found nothing free. There are plenty of paid datasets. I do think there should be some kind of open retailer database that lists locations and operating hours of places. It wouldn’t be too difficult to index most major retailer sites to get this information. It really should exist separate from openstreetmap. Every site targeted at a German audience*, including non-commercial ones, is required to have a so called Impressum stating who operates the site etc.. If you scroll down to the bottom you will find the link that will give you everything you want to know and more. As to the legality, there is just no way POIs from 4sq can be copied into OSM. However I suspect what the operator is simply doing is linking from the OSM POI to the corresponding 4sq meta information which is likely OK from an OSM pov, and maybe it is OK with 4sq too. YAPIS is something that can assist in it. I don't know the project well but it seems to extract POI from Foursquare and GeoCaching and something else. Examples: POI from Foursquare for Bonn http://yapis.geoclub.de/foursquare.php?lat=50.7358511lon=7.1006599 POI from Foursquare for Kópavogur http://yapis.geoclub.de/foursquare.php?lat=64.0886611lon=-21.826357252719 Users can use this info to add to the map using normal OSM editors, I just noticed a couple of these yesterday in Kópavogur. Are you sure the data is appropriately licensed? The URL suggests that the data has come from foursquare which almost certainly means it can't legally be added to OSM. However, I was able to click around on that website and was able to create a single poi in osm based on my personal knowledge. Other than coupons (which would do better in a separate database, not as part of OSM, since they are likely to change often), OSM already has tags for all of these pieces of data. Some mappers are capturing this information, but I am not aware of a project aimed specifically at capturing business data as opposed to non-business data.
