Re: [PSES] Off Topic - Warranty Question

2015-07-01 Thread Ted Eckert
I found a good summary here. It includes a link to the actual Directive.

http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=URISERV:l32022

The summary notes that individual EU members are permitted to enact warranty
requirement stricter than the EU minimum. That would explain the differences
between Italy and the UK.

 Hi Scott,

I had not heard of anything like this.It would seem a very difficult thing to
do since variations between products would result in a real mess of
regulations. Some products should not, in fact, could not, be warranteed for
a specific lenght of time like two years because of the nature of the product.

However, I would like to see a 5 year warrantee on all medical treatements.

Re: [PSES] Off Topic - Warranty Question

2015-07-01 Thread Ted Eckert
I believe that warranty requirements vary from country to country. Italy does
require a 2 year warranty on some product types. I can’t point you to the
specific law, but this link is to a BBC story about a recent incident on the
subject.

http://www.bbc.com/news/technology-16339651

Here is the same manufacturer’s statement on warranty law in the UK. It’s
interesting that England and Wales have different requirements from Scotland.

http://www.apple.com/uk/legal/statutory-warranty/

I intend no offence towards this particular company even though they are a
competitor of my employer. I am providing it only as an example of the
differing warranty requirements and the potential ramifications of
noncompliance.

The laws will also differ in what must be covered. Italy’s 2 year requirement
is more comprehensive than England’s 5 year requirement.

In the United States, you have the complications of different requirements
under express warranties and the implied warranty of merchantability.

The opinions expressed are my own and do not necessarily reflect the views of
my employer. I am not a lawyer and I am not providing legal advice. I recommend
you work with your corporate attorney or outside council to ensure compliance
with warranty law in the jurisdictions where your products are sold.
