Corruption in India is ubiquitous and may be broadly
classified as illegal and “legal”. This paper delves into the
typology of legal corruption, which, apart from abuse of
discretionary powers and tactical law and policymaking,
includes use of the information advantage by politicians

Region, it finds that they are much higher than the
market growth rate. The paper recommends enforcing

in power exceed the market growth rate considerably. The
modus operandi used by these politicians to make gains may

lem, which while being difficult, is not complex. Since most
politicians are sensible enough to disclose only those assets
that have been acquired through legal means, the increase in
value of the assets (as given in the affidavits) does not show
the gains that may have been made illegally.32 Thus growth in
asset valuations must be due to practices that fall within the
ambit of legal corruption.

A medical professional in Canada earns less than his counterpart in the US or 
the UK. Medical professionals are highly mobile. If you want them to remain in 
Canada, they have to receive decent wages and/or research facilities. 

Secondly, I want to be treated by a professional who earns a decent wage and 
not by someone who needs a second income from the drug manufactures in order to 
make ends meet.


Thirdly, I believe everyone who earns $300,000 to $400,000 a year richly 
deserves that income. The people who make that kind of money had to overcome a 
lot of barriers to reach there. In the case of medical professionals, the 
barriers are usually in the form of training and examinations.

PANAJI: The Goa state consumers disputes redressal commission has enhanced
the compensation to a 79-year-old woman, who suffered a hipbone fracture
after the wheelchair, on which she was being taken to board an Indian
Airlines/Air India flight from Goa to Mumbai, broke and she fell to the
ground.

The Goa state consumer disputes redressal commission heard the counsels for
the woman and Air India. In their recent order, Justice N A Britto,
president and Vidhya Gurav, member, likened the compensation of 20,000
awarded by the district forum to peanuts.

The commission awarded her medical bill reimbursement of 1,03,680, enhanced
her compensation from 20,000 to 2,00,000 and also awarded her 5000 in
costs. The commission also ruled that the woman was entitled to interest at
the rate of nine percent for the first two sums from the date of complaint
till payment.

On March 13, 2009, Maria Ester d'Abreu Noronha, then 76 years old, and her
retired banker husband Carlos Mauricio, both of Altinho-Mapusa, were about
to board an Air India flight to Mumbai from Dabolim airport.

On her request, the woman was being wheeled to the plane by an attendant
when the right hand arm rest of the wheel chair gave way, the woman fell to
the ground and suffered a fracture to her right hip joint. Due to her 15
days in hospital and subsequent physiotherapy, the couple missed their trip
to Portugal to attend their grandchild's christening.

The couple first wrote to the management of Indian Airlines/Air India,
Chatrapathi Shivaji airport, Ville Parle (East), Mumbai, demanding
reimbursement of 1,03,71.75 plus 4 lakh. They also attached the bills.

Although Air India initially expressed willingness to settle the
legitimate medical bills within the frame work of their rules and
regulations, no response to their reminder prompted the couple to approach
the North Goa district consumer redressal forum on February 5, 2010.

The district forum by order dated January 30, 2012, awarded compensation to
the couple. Against the claim of 1,03,671, the woman was awarded 79,672 and
against the claim of 4,00,000, she was awarded 25,000 by way of
compensation as well as costs. No interest was awarded.

The couple then appealed against the order before the Goa state consumer
disputes redressal commission. The counsel for the couple argued that the
compensation was meagre in view of the seriousness of the woman's fracture
and how the couple missed their grandchild's christening in Portugal. On
the other hand, the counsel for Air India said that the claim of 4 lakh was
outrageous and that Air India was a loss making organization.

Dismissing that argument, the commission noted that the losses should be
the concern of those entrusted with the management of Air India'' and that
the counsel had not placed any material on record to support his claim. In
part the judgment read, we are concerned with an airline who had provided
a wheelchair to one of the passengers and had failed to take adequate care.
They must have certainly paid a substantial amount of air fare. On breach
of duty to take care, an airline cannot be heard offering the same amount
of compensation as would have been offered by a charitable organization
running a dharamashala where a guest was staying on payment of nominal
charges.

My view is that the Sanal Edamaruku case should not be adjudicated in a court 
of law but in an open public forum with both sides presenting their views and 
moderated by an independent person. The Indian courts are clogged enough and 
emphasis should be on violent crimes, including where real injury of life and 
limb is suffered like murder, rape, etc. and measurable like financial loss and 
theft of property, etc.

In a democracy, one can make the same arguments in an open public forum, as 
vigorously and robustly as in a court of law. This can be done in a calm, 
civilized manner. Indian courts of law which derive their legitimacy from a 
secular constitution, are still a notch below in matters of truth than an open 
public discussion of such matters, better settled in the court of public 
opinion. Imagine if all of India through public forums, television, newspapers 
engaged in these discussions rather than the narrow confines of a court of law. 
And Sanal and his accusers would be no less wrong or no less right at the end 
of such a forum, where the public can make up its own mind after hearing both 
sides.

Towards this end, I would hope the Christian group withdraws its legal case 
(would that be the Christian thing to do?) and instead makes available a church 
hall and invites Sanal and his colleagues to an open public discussion about 
his statements and about miracles, religious offense, Church impropriety, etc.  
Let each side present its case without fear or favor. The truths which result 
are no less true than those derived in court, but substantially more valid when 
derived in the court of public opinion. And yes, I believe the public is free 
and capable of making up its own mind. That is how democracy should work.

P.S. I have intentionally not used the word debate for such a proposed forum, 
a male-oriented word which implies confrontation as opposed to discussion. In 
fact, most of the voices on this issue are male, and they seem to prefer to 
resolve this issue as they do war - the tone and language unmistakeably 
hostile. Perhaps it is time to seek civil resolutions - again, for one 
aggrieved party would that be the Christian thing to do?

The Panchayat Elections, 2012 has given MOIRA PANCHAYAT  a new face in 
Oswald (Osie) Cordeiro as the Sarpanch (elected for the first time in the 
Panchayat) with another first timer Ms. Sonia Thakur as the Dy. Sarpanch, 
with an old face Sadanand Rahul but of the previous term but last and one 
more new face in Suriakant Batlekar. The other Panch members elected and not 
in the ruling group are Ex Sarpanch Adv. Raghuvir Bagkar; and two other new 
comers who could make the chain of four to rule the Moira Panchayat , 
however much hard they tried.


Whilst congratulating the new managers of the Moira Panchayat, Floriano Lobo 
who stands with this team as a motivated citizen of Moira and not as the 
Officer bearer of the Goa Su-Raj Party told the new team to keep political 
parties at a distance, be neutral and use whatever good the political 
parties want and wish for the Village of Moira. That Politics divide people 
at the grass-root village level in the Panchayat elections and that they 
should not fall prey to these antics even if they be partisan in preference. 
He also told them to value and confide in the  GRAM SABHA and Gram Sabha 
Members  for the full satisfaction of the citizens of the Village of MOIRA.


Needless to say that wishful thinking is one thing and how the MOIRA 
Panchayat functions in the immediate future is another thing. But we 
MOIDEKARS are very optimistic and always so.

Isn't that a British newspaper?  Besides, isn't gmail a Google product, and 
your mail is preserved somewhere even if deleted?

There was a case in one of the Scandinavian countries wherein an individual 
took Google to task for having inadvertently taken a picture of him relieveing 
himself in the backyard :-)
 
Yes, there are those cases. 
 
Then again, there is an offshoot of this technology, at www.nearmap.com. The 
clarity of the roofs needs to be seen to be believed; not only that, you can 
track how your roof / streetscape has changed over the last couple of years. At 
least that is true of major towns of Australia, and I used that site to produce 
plans for installing solar power and solar hotwater (there are tools to 
measure, but not really accurate due to the slopes of the roof). So if you want 
to check out the city of Melbourne from a low-flying plane, use this site and 
key in Melbourne, 3000.

Dear Victor,
 
Thank you for insight. Given your seniority, I would think you were present at 
the time of the independence of India. What is the bone of contention between 
India and Pakistan? Why wasn't the doubt setlled there and then by a 
plebiscite which was been promised but not yet realised? So who or what caused 
the paranoia since then?
 
How come some countries are freer and more trusting than others? If you 
have the answer, then you will know why the paranoia. That goes for the 
ridiculous visa rules too which only India has, and then India cries foul when 
other countries try to play likewise.

It's not anymore about what you or I feel the Canadian medical professional
should earn. That ship sailed when the government realized that there's
little money in the kitty.

The best that can happen for them is that future increases will not be as
generous as in the past. The worst, that current levels will be slashed.
Your theory about doctors fleeing to other jurisdictions is untrue. In the
past several years those who have determined that money is their prime
consideration have already left Canada. The ones remaining have decided for
themselves that their practice or research or quality of family life or
whatever, is best served by remaining in Canada. In fact it is known that
many who left have since returned.

You don't have to worry about doctors' second incomes coming from
pharmaceutical and drug companies. If you have been in the financial sector
in Canada long enough, you would have seen how the Ontario Securities
Commission banned mutual fund companies from plying financial professionals
with all sorts of 'incentives' and payments. There is no reason to see why
the CMA under regulatory pressure can't do the same for physicians.

The bottom line Mervyn is that the Government cannot let us walk away from a
heart bypass costing $150,000 or cancer surgery costing even more with zero
dollars from our pockets. Unless they start making sensible cuts to the
system that will still allow us to enjoy that medical freedom.

A medical professional in Canada earns less than his counterpart in the US
or the UK. Medical professionals are highly mobile. If you want them to
remain in Canada, they have to receive decent wages and/or research
facilities. 
Secondly, I want to be treated by a professional who earns a decent wage and
not by someone who needs a second income from the drug manufactures in order
to make ends meet.
Thirdly, I believe everyone who earns $300,000 to $400,000 a year richly
deserves that income. The people who make that kind of money had to overcome
a lot of barriers to reach there. In the case of medical professionals, the
barriers are usually in the form of training and examinations.

Dear Goans in Diaspora.
 
This is an urgent appeal to all of us - people of Goan origin in
Diaspora to save our mother tongue Konkani. Much has been spoken about
keeping the Konkani language alive and little or nothing has been done to
keep the 
Konkani divo and its flame going.  Goan associations all over the
world and cultural societies need to play a greater part in the campaign to
keep away the natural demise of our beloved language. 
 
A simple example of practise is like studying a second language in
schools where we study French and Portuguese get distinction and once we
complete our studies we tend to forget the language for lack of practise.
 
We have people from Kerala and Gujarat who have learned the language
and speak fluently in Goa and we do not easily see the difference.  As Goans
in Diaspora we are in greater numbers than those Goans who work
and live in Goa.  Therefore, it is imperative that we Goans in
Diaspora keep our mother tongue alive at least to speak the language.
Writing books in English is fine but there should be some pages devoted to
our mother
tongue.
  
It is clearly evident that our language will not survive unless we
in Diaspora do something about it.  The onus to save our language therefore
rests with Goans that have spread throughout the length and breadth 
of the universe. Goans by nature are voyagers like Vasco De Gama.
But the voyage does not mean that we forget our language! Seven Konkani
Martyrs laid down their lives on 23 December 1986 for the sake of Konkani 
language during the height of Language agitation on 23rd of December
1986. Blood was spilt to maintain our language and this needs to be
respected in maintaining our Konkani as our Mai Bhas.  Konkani received
recognition as a language in the eight schedule of the Indian
constitution making Konkani one of the official languages of India.
 
To all those who speak or avoid to speak Konkani because of lack of

Something to think about:  When we visit France, the French speak or

capable of absorbing three languages at a time. Since the very first thing
we do is
suck milk from our mothers' breast and that is the time our mothers
spoke to us in Konkani Dol moje bai, nind moje bai, pipit adtolo
pai,...
 
Of course the second and third generation may not want t speak in
Konkani yet they desire to visit Goa for holidays.  They could start
practising Konkan from the above link for the next visit to Goa and the
adults could
in the meantime brush up our mother tongue.

Your rationale is all very good, George, but my gut feeling is that any such 
discussion would very soon come to an exchange of verbal and physical 
violence. 
 
That which we see on Santosh's private email list (to which I've been added 
unasked) is only between half-a-dozen folks; imagine what the result would be 
if you get the whole nation involved in such a discussion in a place where 
democracy has degenerated into a mobocracy.  That's my point of view anyway.

My view is that the Sanal Edamaruku case should not be adjudicated in a court 
of law but in an open public forum with both sides presenting their views and 
moderated by an independent person. The Indian courts are clogged enough and 
emphasis should be on violent crimes, including where real injury of life and 
limb is suffered like murder, rape, etc. and measurable like financial loss 
and theft of property, etc.

In a democracy, one can make the same arguments in an open public forum, as 
vigorously and robustly as in a court of law. This can be done in a calm, 
civilized manner. Indian courts of law which derive their legitimacy from a 
secular constitution, are still a notch below in matters of truth than an open 
public discussion of such matters, better settled in the court of public 
opinion. Imagine if all of India through public forums, television, newspapers 
engaged in these discussions rather than the narrow confines of a court of 
law. And Sanal and his accusers would be no less wrong or no less right at the 
end of such a forum, where the public can make up its own mind after hearing 
both sides.

Towards this end, I would hope the Christian group withdraws its legal case 
(would that be the Christian thing to do?) and instead makes available a 
church hall and invites Sanal and his colleagues to an open public discussion 
about his statements and about miracles, religious offense, Church 
impropriety, etc.  Let each side present its case without fear or favor. The 
truths which result are no less true than those derived in court, but 
substantially more valid when derived in the court of public opinion. And yes, 
I believe the public is free and capable of making up its own mind. That is 
how democracy should work.

P.S. I have intentionally not used the word debate for such a proposed 
forum, a male-oriented word which implies confrontation as opposed to 
discussion. In fact, most of the voices on this issue are male, and they seem 
to prefer to resolve this issue as they do war - the tone and language 
unmistakeably hostile. Perhaps it is time to seek civil resolutions - again, 
for one aggrieved party would that be the Christian thing to do?

IMHO, both Roland and Mervyn have raised important points. They are also points 
which the public and Govt will try to duck as long as possible.

There is no doubt that: 

1: IF high calibre professionals feel constrained (by way of unreasonable 
taxation and salary caps), they will move to other jurisdictions, OR take 
vacations when a certain financial bar is reached ( as I believe happens in 
Canada). The lack of funding issue is something which has also affected the top 
UNIs in the UK.  They have lost some of the top profs to UNIs in the US. 

Besides, It cannot be that politicians and professional sportspersons can earn 
ad infinitum, but not  doctors.

2:  Doctors too, have to be reasonable with what they charge their patients - 
or else, ethics apart, patients too can (and do) move to other jurisdictions. 

3: Professionals and the general populace would have been more accommodating IF 
Govts had moved out of the Tax and Wastefully Spend routine they presently are 
engaged in.

In short, Govts should stay clear of controlling health care delivery or 
education except in the case of those who cannot really afford it.

Controlling professionals is highly unlikely to succeed esp in the presence of 
unreasonably high Tax and Waste and in an environment of inefficiency

through the medium of personal or mass meditation in the fields. The
yogic practice involving positive thoughts releases electro magnetic
power into the plants. Scientific research has demonstrated the effect
of thoughts on water. Water stores thought energy and thus energy
impacts whoever and whatever use it. The positive thoughts subjected
to water had been found to form beautiful crystals and water exposed
to negative thoughts form either no crystal or deformed ones. The

If the news reports are to be believed, then it would seem that Goudinho had
a big hand in ensuring that the Cortalim by-election would be without a
contest.  It should be remembered that, right after the election results
were declared, Goudinho had claimed that his supporters are insisting that
he should come out in support of Parrikar.

 

Recently, Mickey Pacheco had announced that his party would join the ruling
coalition.  At the time, I had said that perhaps Goa has the misfortune of
seeing another Babush coming up.  It would seem that the woes of Goa are not
ending.

On the contrary, I feel that I have to tell the Govt what services I require 
and where they need to stop wasting money. I am a frequent user of the health

 Your theory about doctors fleeing to other jurisdictions is untrue. In the
 past several years those who have determined that money is their prime
 consideration have already left Canada. The ones remaining have decided for
 themselves that their practice or research or quality of family life or
 whatever, is best served by remaining in Canada. In fact it is known that
 many who left have since returned.


A few years ago, a Canadian nurse earning US$50,000 working in Florida was 
actually earning CAD$80,000 because of the exchange rate. The US currency has 
been debauched since and exchange rates are now at par. This is one of the main 
reasons why Canadian medical professionals have returned from the US.


 You don't have to worry about doctors' second incomes coming from
 pharmaceutical and drug companies. If you have been in the financial sector
 in Canada long enough, you would have seen how the Ontario Securities
 Commission banned mutual fund companies from plying financial professionals
 with all sorts of 'incentives' and payments. There is no reason to see why
 the CMA under regulatory pressure can't do the same for physicians.


I believe you are comparing oranges to bananas. 
The state sponsored medical industry is to ensure that guaranteed and stable 
medical services are available for all residents. This is why medical staff 
should be adequately paid. The financial industry on the other hand, is for 
risk taking. Risk takers are rewarded or left to die. When the financial 
service people ply the govt or politicians with incentives and payments, you 
usually wind up with the situation of the good ol' USSR or the current USA 
where a company can be deemed 'to big to fail.' The failed management is then 
kept in place and given a licence to continue wasting resources.


 The bottom line Mervyn is that the Government cannot let us walk away from a
 heart bypass costing $150,000 or cancer surgery costing even more with zero
 dollars from our pockets. Unless they start making sensible cuts to the
 system that will still allow us to enjoy that medical freedom.


I beg to differ with you on this one. A sound health system, one that also 
conducts annual examinations, can detect and offer preventive services for a 
fraction of the cost of treating a person in the advanced stages of any 
disease. For those who are unaware, Toronto banned smoking in pubs a few years 
ago. Three years later, hospitalizations for heart conditions in Toronto fell 
by 39 per cent and for respiratory conditions by 32 per cent. The number of 
heart attacks also declined 17 per cent. This is just one example of how one 
can reduce medical costs without the need for more contributions from the 
healthy.

Also keep in mind that there are Canadian residents who have been faithfully 
paying into the health system for the last forty years. It would be against all 
norms to cut medical services to them just at the time when they begin to need 
it

Lastly, I have no problems paying a few more dollars in taxes so that my fellow 
residents can get the same medical, educational and job creation services I 
expect. The good folks in Montreal pay the highest tax rates in Canada and are 
now protesting that the govt is not providing them the services they want. If 
the current (socialist) govt there cannot understand where the people want 
there taxes spent, that govt is a failure and ought to fall.

Even individuals of our respective seniority should be able to work it out that 
there is NO real interest in settling any doubt.  Ask yourself the following 
questions:

a: what was the main impetus for the European nations coming together, albeit 
imperfectly?

b: which category of individuals (in both the countries - now, perpetually in 
doubt ) have the greatest interest in keeping the doubt unsettled ?

It must be stated, however, that many nations with grouchy and avaricious 
neighbors struggle to keep peace with this set of folks I call 'kestaumkars' 
who can suddenly decide that they want to take control. Credit is due to the 
Indian politicians. They have thus far managed to keep them at bay. The Pakis 
have not been so lucky, the Bonglabandhus  neither.

And, India has opened up significantly over the past 2 decades. 

As an aside, the very nation which caused the other nations to come together to 
form the precursor of the EU, is now controlling the EU by way of finances.

Two Rajasthan health service officials must be regretting their greed in
demanding an extra Rs 25 instead of 2 kg of laddoos which a patient's
relative was offering for issuing a discharge certificate from a hospital in
1994. 

 For their avarice they would now serve six months in prison as the Supreme
Court on Friday upheld their conviction under the Prevention of Corruption
Act. 

 However, the court took pity on the health condition of the convicts and
reduced their sentence to 1 year from 2 years awarded by the trial court.
During the trial, they had served six months in prison. Now they would be
taken back to prison to serve remaining sentence. Rafiq's father was treated
as Shahadat Hospital, Tonk, for urinary track infection from October 24,
1994 to November 12, 1994. He offered Rs 75 and two kilograms of laddoos to
the health official, Mukut Bihari and Kalyan Lal, for issuance of a
discharge certificate. But, the health officials declined to accept the
laddoos and told him to give Rs 100. 

 Rafiq informed the anti-corruption department, which laid a trap and
arrested the two officials accepting the bribe amount of Rs 100. The quantum
of money and long period of trial did not help the accused in convincing the
apex court to take a lenient view of their corrupt action.
