A Division bench of the Bombay High Court at Goa comprising of Justice R.S.
Dalvi and Justice F.M.Reis has quashed and set aside the order which had
regularized the 599 sq mts of Serula Communidade land on Chogm Road at
Porvorim which was encroached by Goa Tourism Minister Dilip Parulekar.



The High Court in its judgment has ruled that the order passed  by the
President of the Administrative Tribunal on September 27th 2012
regularizing the land in favour of Dilip Parulekar was bad in law and could
not stand judicial scrutiny.



In a blatant misuse and abuse of power Tourism Minister Dilip Parulekar, in
connivance with his Under Secretary Irene Sequeira who was also the
Administrator of Communidade of North Zone, and Peter Martins the attorney
of the Communidade of Serula conspired to fraudulently hand over to the
Tourism Minister on a platter, valuable Communidade land at a throw away
price in the guise of regularizing his encroachment to the extent of 599 sq
meters.



As per clause 1 of Article 380 of the Code of Communidade, regularisation
is possible only in cases of land which is valued at less than 1800 escudos
or Rs 300. The market value of the area encroached by Dilip Parulekar is
more than Rs. one crore and the Communidade had illegally given it away to
him for a mere Rs 3,41,320/- .



The encroachment made by Dilip Parulekar could not have been regularized
under law. The entire process initiated for regularization commencing from
the resolutions of the Communidade to the order of the Administrative
Tribunal granting permission was void being entirely without jurisdiction
and contrary to the Code of Communidade.



The misuse and abuse of power could not have been more apparent. The whole
malafied process of giving away this prime land to Tourism Minister Dilip
Parulekar smacked of the malaise of corruption which had to be nipped in
the bud before it further spread and destroyed the very fabric of society.

Alberto Sylvester Fernandes is a successful Goan in Kuwait, having landed in 
the country in 1980. A down to earth and a religious person, as he is, he 
hails from Cansaulim, Salcette, Goa.  It’s a proud statement to make that he 
own his own “Workshop with the latest mechanical and electronics equipment 
and gadgets” where he specializes in maintaining and undertaking specially 
focusing on “repairs and modifications” for German-made SUVs and high end 
luxury cars, more specifically for his favorite “Porsche” cars. His clients 
are 95% Kuwaiti nationals who come to repair their cars only to his garages 
at Al Rai. He leaves no stone unturned to praise God for blessing him and his 
family in abundance.

Alberto is the nephew of The Trio Kings stalwart of Konkani Stage Anthony 
D'Souza, a much feared political singer (of his time from early 1960’s and up 
to the present). Though he had intentions to perform on stage but since his 
first love to be in a mechanical line and being a football enthusiast (who 
turned also for his second love for the ‘love of the game of football”, he 
took up a job in a workshop with Books in his hand.

He just entered the workshop and asked the person interviewing him with the 
chief foreman if there exists any vacancy, at once the foreman told him to 
join from Tomorrow due to his aptitude for hard work. That was the day that 
changed his life for betterment. He did not turn back and moved forward and 
learnt diesel and petrol mechanic work.
 
 
Luck was on his side and he landed on Kuwait soil on 13th July 1983 in the 
summer heat. He took up work in Ajwan Garage Shuwaikh and worked there for a 
lucrative salary.  He contributed his 11 valuable years to Royal Garage at 
Shuwaikh. His mind was disturbed as he always wanted to start his own 
business. He started his own garage Dynamic garage in shuwaikh and later 
moved to Al Rai and started the garage with a different name under “Alberto 
Garage and since that day, has completed 10 years.

He initially took loan to start his own business and after repaying the 
financial institution, he was blessed and fortunate as luck was on his side, 
he won the Dubai Duty Free (DDF) hamper 2001 - a Porsche Car Carrera!  
Incidentally when he and his family were called to ‘pick’ the next draw, the 
same German person won the ‘grand hamper’ who had hand-picked his lucky 
number!
Alberto's wife, Cynthia, is his strong pillar of support. She always stood by 
him and assisted him in his business and personal life who incidentally is 
also a sports lover (football in particular). Blessed with two daughters 
Veronica Fernandes and Vanessa Fernandes pursuing their education in Medical 
Sciences (including physiotherapy) in India, horse riding and athletics is 
their love, following in their parents footsteps.

The Fernandes’ couple has assisted many Indian nationals and are supporting 
too many causes – be in sports, cultural as well as in their professional 
trades.  Having a feel of someone just landing in Kuwait, Alberto would 
provide them suitable accommodation and look after their welfare as is 
basically required in the country, and often on short notice, helped resolve 
their financial and if in emergency, arrange for their travel back home on 
short notice due to humanitarian consideration,   extended a helping hand and 
warmth of a true Goan.

 
Alberto supported many Indians including majority of his staff recruited 
directly from Goa to Kuwait to work in his enterprise, and trained them 
putting his time and effort.  However, as in all trades and considering the 
young generations greed and lure of extra money some of them ventured out, 
and some who tried their luck, often returned back, when were cheated by 
their new sponsor. Many are still here and have turned their backs on him. 
Even when he won the Lottery, many people were jealous of him and were 
cooking up stories.

In sports field, Alberto donned the Goalkeepers jersey in Football and played 
for Musudad De Colva in the second division GFA (Goa Football Association 
organized leagues).  Selected directly in the senior division and played for 
Mandovi Shipyard and in Bombay (Mumbai) played for Moraji Mills also, he 
represented the State of Goa and played in Bahrain and was adjourned “the 
Best Goalkeeper” of the tournament.

As a member of only professional Indian Football Referees Association (IFRA) 
in Kuwait, Alberto coached the Goan Cultural Association (GCA)

While I have nothing against AAP and welcome it in Indian politics as a breath 
of fresh air, I am wondering as to why when we have a local GOAN party - GOA 
SURAJ party led by the selfless  sincere, Goan, Floriano Lobo, why do Goans 
have to think and cast their votes in favour of outside parties?

 I urge  all Goans who have a right to vote to vote for Goa Suraj party and do 
all they can to canvass and pass on the word to other fellow Goans.  Maybe some 
Goans would comment that Floriano's party has not won any seat so far  but we 
must remember that there is always a first time, he has a never say die 
attitude  and his party is doing its best for Goa and Goans.After all his 
party is against formidable opposition who have  money clout  as well as muscle 
power and in the past  for well over 50 years  both Congress and BJP have been 
given their chances galore but when elected they have just forgotten their 
promises and all they are interested is in clinging to power by all means and 
continue corruption.Both Congress and BJP are the same stale wine in 
different bottles.  I feel this coming election  may possibly be Goans' last 
chance to save Goa from further destruction  and hence we should do  our best 
to vote Goa Suraj party to power.

Sunday Reflections: Ash Wednesday - Rend your hearts, not your garments! 
Repent and believe the good news!  5-Mar-2014
Joel  2: 12-18;            2 Corinthians 5: 20 - 6: 2;            Matthew 6:

The first reading from the prophet Joel reminds us that sometimes God invited 
the people of Israel to come back to Him through the great disasters that 
befell them. It was after one such disaster that the prophet Joel conveyed the 
message that God would come to their rescue. The disaster that befell the 
Israelites at that time was the invasion of locusts that came in large numbers 
from the desert and devoured everything. The people were devastated and the 
prophet Joel called them to prayer and to penance. He assured them that if they 
came back to Yahweh, Yahweh would provide them with food they needed. He 
reminded them that everyone should do penance, the priests and the laity, the 
young and the old, even the children. They needed to ask God's pardon as a 
family, as one community and God would forgive them all.

Find someone in need
Dr. Karl Menninger, the famous psychiatrist, once gave a lecture on mental 
health, and then answered questions from the audience. What would you advise a 
person to do, asked one man, if that person felt a nervous breakdown was 
coming on? Most people expected him to reply, Consult a psychiatrist. To 
their disappointment he replied, Lock your house, go across the railway 
tracks, find someone in need and do something to help that person. -Don't sit 
and pout. Get up and do something for others!

The Gospel of today speaks to us of three paths that can lead us back to God: 
prayer, fasting and almsgiving. However Jesus reminds us that these three 
practices by themselves will not lead us to God unless we perform them with a 
humble heart. We can perform them diligently but from the wrong motives; so 
that others may notice our good works. Lent is a time for renewing our prayer 
life. We are reminded in today's gospel. But when you pray, go to your private 
room and when you have shut the door, pray to your Father, who is in that 
secret place, and your father who sees all that is done in secret will reward 
you. Is Jesus against praying in public with the community or prayer group? 
Are we putting on a performance to make an impression on others? Would we do 
the same if no one was watching? Our community prayer life needs to be balanced 
with private and personal prayer. The second practice recommended is fasting 
and abstinence and again we are reminded
 that how we do it is more important than what we do. If fasting makes us 
irritable, if we fast with long faces and put on a gloomy look and make all 
around us miserable, there is something wrong with that kind of fasting. The 
heart of fasting is to do without something that we like and believe we can't 
do without, in order to realize that God can supply our every need. We may 
observe the letter of the law but have missed out on its spirit. What about a 
weekly fast from our favourite TV serial? The third practice of the devout Jew 
was almsgiving. Again the admonition is the same: So when you give alms do not 
have it trumpeted before you to win men's admiration... your left hand must not 
know what your right hand is doing, your alms giving must be secret. By alms 
is meant any kind of help, material or spiritual we give to our neighbour. We 
could help our neighbour in need, we could give them encouragement, we can 
appreciate the goodness in others, we
 can help someone in spiritual danger.  Are we bringing people to Jesus by our 
words, our good example and our deeds?

Ready to change?
Once, a king was walking through the streets of the capital city when he came 
upon a beggar who immediately asked him for money. The king did not give him 
any money. Instead he invited him to his palace. The beggar took up the king's 
offer. On the appointed day he made his way to the royal palace, and was duly 
ushered into the king's presence. However as he came into the king's presence 
he was acutely conscious of his rags and felt ashamed of them. They were an 
eloquent symbol of the wretchedness of his life. The king, an exceptionally 
kind man, received him warmly, took pity on him, and among other things gave 
him a new suit. However, a few days later the beggar was back to begging on

Since the beginning of history, the world's end has been predicted by several 
fringe groups, quite a few of them in the US. Normally sane people get taken in 
and then of course taken out.

The Bible of course predicts it and the legendary Nostradamus has his own cult 
following with prophecies so vague, it could fit any situation.

However since the past 5 years or so protestant mainline churches have been 
hinting but not saying directly about the impending end of the human race and 
quoting bible prophecies, often convincing and mostly from the last chapter - 
The Book of Revelations, to prove their projections. 

No body of course is giving any timeline because that will entail a complete 
loss of cedibility and these churches are far too sophisticated to indulge in 
potentially faith-destroying beliefs. Mind you, they do not harp on this 
direction mentioning that as good Christians it should not matter whether the 
world ends tomorrow or after a couple of million years.

Here are some of their indications:
Annihilation of many species of flora and fauna.  
The instability of the global economy and global currencies.
Erratic weather and climate conditions never seen before.
Frequent wars in several regions and mass killings of innocent people.
Wide disparity in wealth such as never witnesses in any human age and I could 
go on and on.

The scientists including those among us will pooh pooh all these fears and the 
gullible will beleive all that is theorized in totality, but as it usually 
does, the truth lies somewhere in between. 

If you are a man of faith, you know that none of the great books of religion 
have given men any but the most vague predictions of anything for they must by 
necessity remain so and if on the other hand if you are modern man, sceptical, 
analytical and logical on a practical level, you do know that the way we are 
wasting and destroying the earth's non-renewable or resources that took 
millions of years to be created, or polluting the planet with non-degradable 
toxic wastes, we cannot for sure have a unlimited block of time left.

Meanwhile leave your fears aside, do what you can for Mother Earth and perhaps 
She will not be as unforgiving as she would have been.

You may have heard it being said that in mathematics India gave the world zero. 
  If you agree, without this zero 0 nothing can move, you can either be zero 
plus or zero minus.  Sometimes this is not such a bad thing because in Goa you 
can find both, zero plus and zero minus with more of the minus as can be 
observed on the landscape of houses in disrepair and even the thinking in 
government administration including people behaviour.

I have to agree with Abby Aguirre who wrote an article titled Goa's colonial 
estates, lovingly restored which was published in International New York Times 
Travel Weekend Supplement Saturday-Sunday 15-16 February 2014.   She referred 
to Goa as India for Beginners that is missed out by visitors staying in 5 
star fortresses.   The real charm of Goa can be found in Siolim House, once 
owned by the Governor of Macau.   She also mentions In part because foreigners 
who buy a Goan home must operate a business on the property as a condition of 
the sale, it is not uncommon to find inns and villas owned and run by 
Europeans.  This has enabled their guests to find the real Goa.

Customer services at Symtravels.co.uk report that their customers highly 
complimented Air India for their hasle free daily flights from London Heathrow 
to Goa and other parts of india.

Have any of you received this? Do you think the government would be
effective in its stated goals? What are the possibilities of such data be
misused if it lands into the wrong hands?

It might make more sense if the Goa government simply tightened up its act
against the thieving of land at this end (illegally done or otherwise), and
specially the double-role played politicians-realtors.

In the past, there have been allegations that certain politicians have
informally threatened to acquire land under the draconian Land Acquisition

seriously contemplating enactment of a suitable legislation whereby the

and PIOs of Goan origin. For this purpose, it is proposed to create a data
bank of all the landed properties of NRIs and PIOs of Goan origin who are
willing to register their properties with the Government. This will enable
the Registration Authorities to prevent manipulation of such land records
and execution of fraudulent Sale deeds.

[Goanet] DISPROPORTIONATE ASSETS CASE AGAINST SPEAKER RAJENDRA ARLEKAR: HEARING ON FEB 28th

The Special Court under the Prevention of Corruption Act will on Feb 28th hear
the petition seeking directions to the Anti Corruption Branch (ACB) to
register an F.I.R. against Speaker of Goa Legislative Assembly Rajendra
Arlekar in the disproportionate assets case. At the last hearing the Court
gave the ACB a last opportunity to file its reply.



By a sale deed dated 26th August last year Speaker Rajendra Arlekar
purchased from a Delhi based journalist Dharmanand Kamat a 500 sq mt plot
at Porvorim on payment of a whopping Rs 72 lakhs and the sale deed does not
reveal the mode of payment as to whether the amount paid by Rajendra
Arlekar was in cash, cheque or draft. Besides those 72 lakhs Rajendra
Arlekar also paid an amount of Rs 2,52,000 towards stamp duty and a further
Rs 2,16,280 as registration and processing fees of that Sale deed.



In an affidavit filed by Rajendra Arlekar on 9th February 2012 he had shown
his income for the year 2010-2011 as Rs 2,76,671 and that of his wife
Anagha Deshpande Arlekar who is a school teacher as Rs 5,87,186. The
purchase of that plot for 72 lakhs by Rajendra Arlekar is therefore clearly
disproportionate to his last known source of income.



Rajendra Arlekar on 9th February 2012 in his affidavit before the Goa's
Chief Electoral officer had shown his total liabilities by way of loans etc
as Rs 30,54,314 and further liabilities by way of Government dues as Rs
2,64,734 but his statement of assets and liabilities filed on 31st July
2013 before the Goa Lokayukta does not show any liabilities. Mr. Arlekar
should explain as to how within a short span of just over a year after
becoming Speaker of the Goa Legislative Assembly he was able to clear his
huge liabilities of Rs 30,54,314 and also liabilities by way of Government
dues of Rs 2,64,734.



Rajendra Arlekar in his affidavit on 9th February 2012 had shown his total
income for the year 2010-2011 as a mere Rs 2,76,671. This prima facie
reveals that Rajendra Arlekar concealed the real income earned by him from
his HP petrol pump dealership Om Shree Vetobaa at Vasco. It is also
surprising as to how the total income of Rajendra Arlekar's wife Anagha
Deshpande Arlekar who is a school teacher which was Rs 5,87,186 in
2010-2011 had shot up to Rs 9,32,278 in the year 2012-2013.



As ACB officials are acting as caged parrots in shielding Rajendra Arlekar,
directions of the Court have been sought that  Rajendra Arlekar be booked
under Section 13 (1) (d)  (e) of the Prevention of Corruption Act 1988 and
Section 120-B of IPC along with Section 34 of IPC.


Meanwhile, the ACB will on 3rd March record the statement of Delhi based
journalist Dharmanand Kamat from whom Rajendra Arlekar purchased that 500
sq mts plot at Porvorim for 72 lakhs. ACB officials were scheduled to
proceed to Delhi but Dharmanand Kamat has volunteered to come down to Goa
and assist the investigation.  While the Income Tax authorities are
carrying on with their probe, the Hindustan Petroleum is examining as to
how Rajendra Arlekar continues with the petrol pump dealership illegally
after becoming an MLA and Speaker of the Goa Legislative Assembly.

 Administrator of Communidade of North Zone, and Peter Martins the attorney
 of the Communidade of Serula conspired to fraudulently hand over to the
 Tourism Minister on a platter, valuable Communidade land at a throw away
 price in the guise of regularizing his encroachment to the extent of 599 sq
 meters.



 As per clause 1 of Article 380 of the Code of Communidade, regularisation
 is possible only in cases of land which is valued at less than 1800 escudos
 or Rs 300. The market value of the area encroached by Dilip Parulekar is
 more than Rs. one crore and the Communidade had illegally given it away to
 him for a mere Rs 3,41,320/- .



 The encroachment made by Dilip Parulekar could not have been regularized
 under law. The entire process initiated for regularization commencing from
 the resolutions of the Communidade to the order of the Administrative
 Tribunal granting permission was void being entirely without jurisdiction
 and contrary to the Code of Communidade.



 The misuse and abuse of power could not have been more apparent. The whole
 malafied process of giving away this prime land to Tourism Minister Dilip
 Parulekar smacked of the malaise of corruption which had to be nipped in
 the bud before it further spread and destroyed the very fabric of society.

This has reference to the news report coming from Navhind Times dated
27th Feb 2014.

We all know that the heritage site needs to be protected by all means,
but when it comes to garbage dumping the authorities forget these
rules, especially when comes in the case of Bainguinim. This dumping
of garbage was quite long time decision which several bodies like
church, Old Goa village Panchayat, people living in this area, are
been opposing to the plant coming up at Bainguinim whether it is state
of art or otherwise. They are all now for a fight toot and nail to
shift the plant somewhere else at safer place. The CCP Mayor Surendra
Furtado,  is upto his arms that the funds of 70 crores received from
the Centre under the Jawaharlal Nehru Renewal Mission ( JNNRM) is made
use for this project without much thinking that there are schools ,
religious structures in the vicinity. They even forget that the trucks
plying all the way from different localities may be Panjim, St Cruz,
Merces Ribandar, Chimbel, Carambolim, Caranzalem D.Paula and many
other places which will give the public a nuisance of dirty smell and
loads of garbage littering all around the way to Bainguinim. Just for
the sake of using these funds it does not mean that they should damage
the environment and people living in this area with fresh air. Let
them use these funds somewhere else or return back.
It is better that the CCP think of shifting this plant somewhere else
where there is no objection from anybody.

OLD GOA: The people living under the jurisdiction of Old Goa village
panchayat have been opposed to setting up of a sold waste management
plant at Bainguinim.

Sarpanch of Old Goa panchayat Nilkanth Bhomkar told The Navhind Times
on Wednesday evening that they are totally opposed to the plant at
Bainguinim whether it is of state-of-art, or otherwise.

We are prepared to fight tooth and nail to shift the plant from here
to some other place suitable for it, he said.

Stating that the panchayat has been opposed to setting up of the plant
for quite sometime now, Bhomkar said there are schools and religious
and heritage structures in the vicinity.

The CCP project on solid waste management plant at Bainguinim has been
sanctioned a fund of `70 crore by the Centre under the Jawaharlal
Nehru National Renewal Mission.

The area surrounding the proposed site for the garbage plant boasts of
heritage structures, which has been declared as World Heritage Site.

The panchayat insists that the authorities should set up the plant at
a place where it will not affect neither people nor environment.

In the recent past, the panchayat functionaries had called on Chief
Minister Manohar Parrikar who had advised them to go by decision of
gram sabha of the village body.

The villagers informed that they are all with the panchayat's decision
on the issue  and that there cannot be division on gram sabha
resolution.

Santano Oliveira, a businessman of the area, opined that the area has
religious importance to people of all faiths:  there are temples,
mutt, churches and mosques in the area.

The garbage management plant will be located on the top of the hill.

Oliveira felt that the plant would create noise pollution due to
movement of trucks, and the road leading to the plant will have
litters everywhere.

The area will be pervaded by strong stench, he said.

Why should Bainguinim people suffer from nauseating stench for no
fault of theirs? Bhomkar asked.

The Old Goa panchayat, in accordance with the Supreme Court
guidelines, has decided that henceforth a construction plan will not
be approved if garbage management plant is not shown in the plan for a
building project.

Oliveira opined that the plant could be shifted to the area opposite
Kadamba bus terminus or behind Hera petrol pump in Panaji city, where
stench could be absorbed and lessened by sea breeze.

The plant will also affect people from Karambolim, Ribandar, Merces
and Chimbel, and may pose threat to water bodies and paddy fields of
the area, he said.
