Goa is without the much needed and so vital Lokayukta for almost six long
months. The government must with all sincerity act promptly to fill this
unacceptable vacuum.

The Lokayukta at the State level investigates cases of corruption and
ensures transparency in the administrative machinery that has to be citizen
friendly. Public grievances must be taken cognizance of promptly,
skillfully and expeditiously through a simple informal mechanism devoid of
technicalities.

The Institution of Lokayukta is a step forward in ensuring an Open
Government where there is due respect for the rule of law while propagating
the prevention of corruption, inefficiency and mal-administration in
governance. But to achieve these desired results, it is paramount that the
autonomy and the total independence of the Lokayukta must be ensured with
no interference whatsoever by the government of the day.

In 2013 Karnataka’s former formidable Lokayukta Justice Santosh Hegde had
suggested that some provisions be incorporated to strengthen our Lokayukta
Act but all those views were consigned to the racks. More recently our now
retired Lokayukta Justice P.K Misra had taken the pains to also propose
some much required amendments which also met the same fate.

An already weak Goa Lokayukta Act with so many deficiencies has now through
those controversial amendments which were bulldozed by the Government in
January this year rendered the Lokayukta totally redundant and powerless.
So it is no surprise that nobody wants to accept this farcical and
toothless position.

So this current imbroglio must be sincerely resolved by the Government by
swiftly bringing the much needed amendments to arm and empower the
Lokayukta with the required powers and teeth to tackle corruption and bad
governance in the State.

In this direction the assistance of a legal luminary possibly of our
retired Allahabad High Court Chief Justice Ferdin Rebello could be sought
to draft the required changes to the current Goa Lokayukta Act which once
finalized could be brought into force quickly by way of an ordinance so
that in public interest the functioning of the Lokayukta is restored.

But if the government lacks the intent and will to have a sturdy and
empowered Lokayukta, the only prudent option is to wind up the now sham
Institution of the Goa Lokayukta and save the exchequer a whopping 1.8
crores which is the annual expenditure incurred in running that body which
in its present form will serve no meaningful purpose whatsoever but only
act as a white elephant being an unnecessary financial liability to the
already overburdened taxpayers.

The Office of the Lokayukta was a slim hope for Goans to achieve some justice. 
Unfortunately its powers were diminished and now Goans have less access to 
justice. What Goa needs is many Lokayukta judges to handle all the cases and 
massive scale of corruption. Primarily, land corruption is the source of all 
Goa's problems. The pandemic and closing of courts worked in the building 
mafia's favor. Every significant land transaction in Goa should be subject to a 
fully-empowered Lokayukta review. Also, isn't one of the problems lawyers 
involved in these land transactions? Are they part of the problem? Are they 
assisting the building mafia, politicians, panchayats, sarpanchs in the illegal 
transactions? Is there a list of honest lawyers in Goa who will refuse to be 
involved in selling Goa to the highest bidder? Please advise.

The notification by the Ministry of Home Affairs dated 4th March, 2021 putting 
curbs on OCI card holders has unnecessarily alienated and placed obstacles that 
should not be the case, since the OCI in itself granted a few entitlements on 
the card holder that were bestowed in the absence of dual citizenship. 
Initially, there were two cards namely `Person of Indian Origin" (PIO) and the 
`Overseas Citizen of India' (OCI), the former being merged to form only OCI 
card holders. Exchanges for the purpose of research, journalism and mission 
work as well as money transfer with limits not being subject to Foreign 
Exchange Management Act (FEMA) would be a global facility that would facilitate 
smooth and cordial relations with persons of Indian origin and overseas 
citizens of India as the world has now become a unified entity and at least for 
those originating from India should be given preferential treatment. It augurs 
badly on the part of MHA to consider Indian origin people as `foreigners' and 
not bestow entitlements by virtue of having Indian roots. Not for political 
mileage, but as a matter of cordial relations with people of Indian origin, it 
would be prudent to withdraw the notification forthwith as the same is 
discriminatory towards persons of Indian origin.

Probably to dissuade and keep late Manohar Parrikar’s elder son Utpal
Parrikar away from venturing into State politics, the BJP has appointed him
as a member on that insignificant National Board for Micro, Small & Medium
Enterprises (NBMSME). This board established and notified on 15th May 2007
consists of 47 members of which 18 are Ex-officio members with 29 other
members of which Utpal Parrikar is now one, with tenure of two years.

One of the functions of this Board which is supposed to meet every three
months is to examine the factors affecting the promotion and development of
Micro, Small & Medium Enterprises and review the policies & programmes of
the Central Government with regard to facilitating the promotion &
development while enhancing the competitiveness of these enterprises.  Will
this entire inconsequential role be of any interest to Utpal Parrikar? It
may not be in tune with his ambitions.

Given that Utpal Parrikar has been showing keen interest in Goa’s political
affairs and Panaji in particular, it remains to e seen whether he will
swallow this carrot thrown at him to keep him at bay from the State. His
calm composure is an invaluable asset if he contemplates immersing himself
in public life. Utpal may be young but his comments and reactions though
sharp are well guarded. Having not been exposed to politics during his
father’s innings, only time will tell how he swims with the political tides
which at times can be rough and turbulent. The very fact that he has kept
in touch with his father’s grass root workers, more particularly in Panaji,
it may be difficult for the BJP to distract or dislodge, leave aside uproot
the former Chief Minister’s son from Goa’s capital city.

It will have to be seen whether the BJP has misread Utpal’s mind and how he
plans to Navigate Goa’s political waters of which he has shown no
inclination to stay away from. Being young, Utpal may not be a Man in a
hurry but the BJP for sure cannot afford to sideline or take Manohar
Parrikar’s heir for granted. It remains to be seen for how long Utpal bides
his time and uses this opportunity as a stepping stone to achieving his
goal and usurping the BJP’s token attempts to steer him away from following
in his father’s footsteps.

With the current low profile role that he is playing, Utpal Parrikar must
be cautiously gauging all his options, but a Board meeting in Delhi once
every three months may be of no interest to him while his heart and mind is
in the land of Fish, Frolic and Fun while he charts and wades through his
political voyage ahead.

The idiom ‘’the apple doesn’t fall far from the tree’’ may well come to
fruition and haunt the BJP once Utpal makes his move. For now, he is calmly
taking the advice of Benjamin Franklin, a founding father of America ‘Take
time for all things; great haste makes great waste’!
