Sexually Explicit Material and Illegal Activities content on Google's Android Open Source Project - Issue Tracker

To Whom It may Concern,

iThreat Cyber Group, Inc (“ICG”) has been engaged to help our client, Hyatt 
Hotels and Resorts, to address a series of posts on Backpage and other websites 
including Google's Google Project Hosting, relating to advertisements offering 
illegal services using Hyatt Hotels and Resorts locations and brand name.

The posters falsely state, impersonate or otherwise misrepresent their 
identities and/or associations including, but not limited to, the use of a 
pseudonyms, or misrepresenting their current or previous locations and agency 
names, or affiliations with the Hyatt hotel or entity, past or present. 
Investigation efforts, which included identification of the posters and 
undercover operations, revealed the posters have no direct or indirect 
association to Hyatt Hotels and Resorts. ICG called the phone numbers included 
in listings. These phone calls confirmed that the individuals in the enumerated 
posts are offering sexual services in exchange for cash. Furthermore, ICG was 
able to confirm that these individuals are not located or based from Hyatt 
locations, nor are the phone numbers listed or individuals are linked to an 
employee of Hyatt.

During the course of our investigation, ICG was able to find and confirm that a 
great majority of the posts originated from a singular entity or agency. The 
offending posts claim or use Hotel Hyatt Regency EsℭOℛts or Grand Hyatt 
Santacruz East Escorts or Hyatt Regency Andheri ! Mumbai Escorts or Hyatt 
Regency Mumbai and other similar branding to advertise sexual services of 
women in exchange of monies, usually around 15000.00 Rupees.

To date, the list of active offending posts is as follows:

ICG requests that the above mentioned URL  be disabled or redacted immediately 
based on violation of Google Project Hosting: User Content and Conduct Policy 
which states that users can not misuse services for:

1. Sexually Explicit Material: Do not post content that contains nudity, 
graphic sex acts, or sexually explicit material. Do not post content that 
drives traffic to commercial pornography sites.

4. Impersonation or Deceptive Behavior: Do not use our products to impersonate 
other people.

6. Intellectual Property: Don't infringe on the intellectual property rights of 
others, including patent, trademark, trade secret, copyright, and other 
proprietary rights. For more information or to file a DMCA request, please 
visit our copyright procedures Help Center at 
http://www.google.com/support/bin/static.py?page=ts.csts=1114905.
7. Illegal Activities: Don't use our products to engage in illegal activities 
or to promote dangerous and illegal acts.
ICG requests that these posts, enumerated below, be disabled immediately, based 
on a violation of Google Project Hosting: User Content and Conduct Policy, 
which indicates that Google responds to notices of alleged trademark and 
copyright infringement, and terminate accounts of repeat infringers according 
to the process set out in the U.S. Digital Millennium Copyright Act. The 
offender and account holder is found using Hyatt Hotels and Resorts brand and 
name in the reported post, which is in violation of Google's Terms of Use:

6. Intellectual Property: Don't infringe on the intellectual property rights of 
others, including patent, trademark, trade secret, copyright, and other

Non-open-source project found on Google Code

To whom it may concern,

I believe I have found a non-open-source/proprietary project on Google Code:
http://code.google.com/p/zuma-fpga/

The project, while appearing open on the surface, has only a single
archive file in its GIT tree.  That file is encrypted (!), requiring
individual permission of the author for use, and there is no open-source
license specified for the project as a whole.  To me, this eems to be an
abuse of Google's services and detracts from Google Code as a whole.

Perhaps someone could contact the author and explain what an open-source
project actually is and what running one entails?

This project is not and never an open source project. From the descriptions
on its homepage, we can only read that the author uses Google Code for file
hosting for providing auto-updating related feature (banben.txt in
downloads section, while banben means version in Chinese).

Google folks - do you have any response?  I sent an email to 
google-code-hosting@googlegroups.com on 7/5/12 to the same effect  got no 
response.

Does lack of enforcement/response mean that Google no longer requires 
hosted projects to be open source?

It appears that the btstack project has relicensed to a non-open-source license:

The new 4th condition does not meet the OSI definition of open source as it 
imposes a condition on the kind of use that can be made of the code.

Open source means you are free to edit the source of the program. Linux for 
example is open source but some distributions are not free, you have to pay 
in order to use them but they are still free.

components,, but the source code is not made public (THIS is NOT OPEN SOURCE
project), and the author does not want to provide open access to source of
modified components  does not go to the contact. Just beyond this, in the
that build of Miranda IM will be used fugue icons (
http://p.yusukekamiyamane.com/) which the author also has no right to use,
modified the skins and templates (fromhttp://addons.miranda-im.org/) without
 permission of the authors of these skins and icons. I used skins and
authors demand the closure of the project and author of the ban as not
reliable. Thats very important/

not respond.

You can use Google Project Hosting so long as your source code is open
source.  It is OK if it depends on other software that is not open
source.  In fact, a lot of OSS in the world depends on non-OSS (and a
lot of non-OSS depends on OSS).
