With Legacy closed, check your data folder for lock files 
*.ldb and delete them. Some may have been left 
behind if Legacy crashed.

Note (1): (IMPORTANT) this only seems to be a problem when the
parent’s marriage record is blank in the Source file.

Note (2): This problem occurs for all families included in the merge
criteria where the marriage record is blank.

Note (2): this problem never occurred for me in earlier versions of
Legacy.

I am also reporting this problem to support.
