When I was attending MIT in Cambridge MA there was a sign on Mass Ave just as 
you crossed the bridge coming from Boston, right in front of campus, that said 
“Cambridge is a Nuclear-Free Zone”.  About 1/4 mile on down was the MIT 
research reactor. The irony was always refreshing. 

At some point they put up signs that said “Cambridge is a Domestic Violence 
Free Zone” but they were in the hoity-toity parts of town not the towny part of 
town, e.g., where the marathon bombers Joker and Speedbump lived. I don’t think 
those signs worked either. I did always wonder if the violence was free, or it 
was a free zone, or what.

Our other house is in a subdivision and it has covenants, but they are not 
enforceable because we do not have a HOA. If the majority of the lot owners 
wanted to form one they could but can’t force owner into it that do not want to 
be part of it. Now out here at Okie acres, there is nothing regulating 
anything. I suppose if I tried to put up a nuke plant or something, somebody 
might say something but otherwise no.

Our subdivision has no HOA but there must e some sort of covenant that
prevents people from erecting fences in their front years because there are

One of my neighbors is rehabbing a house. He’s a general contractor and owns a 
house in the “rich” part of the country club, where he’s an HOA member - but 
not at the house in my neighborhood. I talked to him about the situation and 
his attitude was to just ignore the HOA and go through the motions as 
necessary. He’s convinced they don’t care about our part of the community since 
they don’t do any enforcement of the few homes that are in the HOA here besides 
mine. He seemed to think our efforts to get out of the HOA would be challenged 
for fear it would set a precedent.

We’ll see.

I went through the plan approval committee last year to get the OK to put 
stairs on the back deck. I couched my request with the suggestion that there 
were concerns about safety since there is no way down from there, and the only 
other exit from that room is to go through the house to one of the exterior 
doors. They approved, no comments. Took maybe a week.

Been there, done that. The HOA is supposed to be having their title agent look 
as well. No one can find anything. And do understand that they will be coming 
around on occasion with “special assessments” when they need money. Long term 
it will be more than just $350/year, I’m betting.

For that matter, I had to pay for a survey of our property. Now on the surface 
that wouldn’t seem like a big deal, right? I mean, everyone gets a survey done 
when they convey a property to someone else, right?

Nope.

No survey on record for my lot. Anywhere. Sure, the lot is on the plat filed by 
the developer with the County. But there’s no individual surveys as a part of 
that.

Lucky for me, a neighbor works for a local survey firm. His lot is surveyed, 
and he recently surveyed the lot two doors down across the street. That gave 
him some monuments to work from, and about 90 days and $1300 later, I have a 
“real” survey of my property, with all of the corners marked and recorded. Of 
course now that I’ve done my survey, it makes it a lot easier for adjacent 
property owners to do theirs since me and my neighbor did a lot of the 
foundational work. Whatever.

to them, and that you are OK with or maybe even want yourself, and then omit it 
from your plans. The hope is they will focus on that, you can acquiesce, and

change. That and I’ve been assured by neighbors who are in the know and not 
members that the HOA pays little mind to our street because of the lack of 
members and the age/area. That said, it’s not a bad neighborhood or run down. 
With a couple exceptions, all of the homes are well cared for and in good 
condition.

My only concern will be when we decide to migrate permanently we will be 
putting an addition on the house and likely expanding the garage. Our lot is 
well over 1/2 acre, so that’s no big deal. The City is real easy to work with 
on this sort of thing, especially if we’re adding an ADU (accessory dwelling 
unit) which we would be in the garage. However, we have to get the plans 
approved by the HOA, which I see no reason why they would care, but…

CC In other words, once the property is “in”, any future owners are, too. 
No choice.

of sight. Next door neighbors might not like it, but I don’t think they’re in 
the HOA, so they can’t complain.

Without getting into details, my HOA was voluntary at one time, so not every 
property in the neighborhood are members. As a result the HOA itself doesn’t 
pay a lot of attention to our neighborhood as we’re the “old section”. They 
tend to ignore us.
