Re: PESO - A Lichen Garden
Come on Ann, isn't age just a number? Most of us are past the three score & ten. You're wider awake than most. Everything you ever learnt or experienced is somewhere in your cranial database - you just have to get it out. To add to my previous bit, with thousands of algae & fungi species around, the chances of two lichens in the wild being the same is very remote. Spectacular combinations like the British Soldiers are propagated for posterity. Getty won't settle for an apology or anything but money if it's their image. Copyright lawsuits are a significant source of income for them now, since the stock photo business has taken such a hit. However... Getty is currently being sued for *selling* images that are actually in the public domain! They even tried to get money from one photographer for her own image! http://observer.com/2016/07/getty-sued-for-1b-for-selling-public-domain-images/ So first order of business is to find out if it's one of these public domain images that Getty has been trying to foist off as one of their own. Re: Demand letter from Getty for use of image
If your client is a mom/pop shop, tell Getty to take a hike. Its not worth their lawyers time to go after them with the risk that they might lose if the images are widely available on other sites and have no watermarks or ownership stamp on it. Let Getty go after the place your client got the images from, its more likely that they have more exposure. Bigger fish. On Fri, Sep 23, 2016 at 1:36 PM, Daniel J. Demand letter from Getty for use of image
Travel agent client maintains a website and newsletter featuring vacation travel venues. Client makes every effort to use only public domain images. Client received a letter from Getty Images, claiming a particular image used by client was a rights managed image controlled by Getty. The image in question was no longer on the website,, but still appeared on a FaceBook account. Client immediately removed it. The Getty letter states that removal of the image will not resolve the matter, and demands a monetary settlement for past usage. Has anyone handled this sort of claim, with Getty or another stock agency? Will they accepts an apology and an agreement to take reasonable steps to prevent future inadvertent infringement in lieu of payment? But it does make me wonder why they only started with numbers in the seventh month. Why aren't January - June numbered rather than having names? Re: Enablement!
Man, what's it like you've living in the jungle, did you notice any Japanese holdouts while you were there? Really the changes from the *ist-D series of cameras to the K20D was immense. The change, except in resolution, from that to the K-5II was almost as big. For you it will be like moving up from a go-cart to a Porsche 911, which of course wouldn't have made you a better driver either. The biggest impact will be that you need more hard drive space to store your images, unless like me you don't upgrade your photo computer until you absolutely have to, in which case you'll have to upgrade that as well, trust me. Larry is right you'll be amazed how bright and clear your crappy pictures can be, except that every, up to now, trifling defect in technique will will become glaringly obvious.
