Court: disability laws protect those unable to have sex
Mcclatchy-tribune
WASHINGTON — A South Carolina breast-cancer survivor has beaten the State
Department and
convinced judges in Washington that the inability to have sex is a disability
protected under federal
anti-discrimination laws.

The new appellate-court ruling gives Piedmont, S.C., resident Kathy E. Adams
another potential shot
at serving overseas. More broadly, the ruling cracks open the courtroom door
for additional legal
challenges by those who are sexually incapacitated.

'I think it's a major victory for former cancer patients, and for anyone who
has had their sex life disrupted,' Adams' attorney, David H.
Shapiro, said Tuesday.

Adams wants to compel the State Department to hire her as a foreign service
officer and provide back pay. She'll now go before a jury and
trial judge, unless the State Department relents first.

In its 2-1 decision, issued Friday, the U.S. Court of Appeals for the District
of Columbia Circuit ruled that Adams has a case against the State
Department. Most significantly, the D.C. circuit court ruled for its first time
that laws that protect people with disabilities from discrimination
cover 'sexual relations.' The ruling overturns a trial judge who'd dismissed
Adams' case.

'At the risk of stating the obvious, sex is unquestionably a significant human
activity, one our species has been engaging in at least since the
biblical injunction to 'be fruitful and multiply,' ' appellate Judge David
Tatel wrote.

Tatel concluded that sex is the kind of 'major life activity' that Congress
considered when it passed the Rehabilitation Act in 1973. The law,
like the better-known Americans with Disabilities Act, prohibits discrimination
against people with disabilities.

Lawmakers defined a disability as an impairment that 'substantially limits' a
major life activity. Courts still struggle to explain what that
means. Last week, for instance, the D.C. appellate court determined that
'sleeping' is a protected major life activity.

Walking, seeing and hearing, among many other activities, likewise have been
identified as 'major.'

The new ruling comes from what's sometimes called the nation's second-highest
court, meaning that many lawyers will be parsing its words.

'As a basic physiological act practiced regularly by a vast portion of the
population, a cornerstone of family and marital life, a conduit to
emotional and spiritual fulfillment, and a crucial element in intimate
relationships, sex easily qualifies as a major life activity,' Tatel wrote.

A State Department spokeswoman said the department was still reviewing the
decision.

Adams couldn't be reached for comment Tuesday.

The Russian-speaking Adams aced the State Department's Foreign Service written
and oral exams in 2002, ranking seventh out of 200
candidates. Living about 15 miles south of Greenville, she was in line to start
training in January 2004.

Before her training started, doctors diagnosed her with breast cancer. She
underwent surgery, but the State Department subsequently denied her entry into
the Foreign Service.

'The department could not guarantee (her) access to the required medical
follow-up and surveillance at all overseas assignments,' a State
Department nurse testified.

State Department officials added, and the dissenting appellate judge agreed,
that the department didn't know about Adams' sexual disability
when it declined to hire her. The court majority, however, reasoned that 'it
makes no difference whether an employer has precise knowledge
of an employee's substantial limitation' so long as the employer knows about
the impairment.

In this case, the State Department knew about Adams' breast cancer but didn't
know how the cancer treatments impaired her sex life.
Adams underwent a mastectomy, had her ovaries and fallopian tubes removed,
gained weight and felt her libido wither.

'I now find that the prospect of dating and developing an intimate relationship
is just too painful and frightening,' Adams, who is single,
stated in a declaration.

Quadius,

The only other compelling reason you may wish to upgrade to
NaturallySpeaking 9.5 is if you use or plan to use MS Office 2007, even on
Windows XP, as the prior versions of NaturallySpeaking including Ver. 9 are
not compatible with Office 2007.

Thanks so much for the information. Like you I have been using Dragon since
version 3.0 and I'm currently using Dragon 9.0 with Windows XP. I just
can't see upgrading to version 9.5 unless I have Vista and a new computer.

I am curious to know if anyone on here has tried Apple
http://www.apple.com/ 's voice-activated software. Let me know if you
have.
Thanks again.

PS for some reason my wireless Plantronics microphone is giving me fits
tonight and it's taking me forever to dictate.

I have to concur with Joan. I have been a Dragon NaturallySpeaking user
since Ver. 3 and currently use Ver. 9 on my Windows XP computers, but the
Speech Recognition application that comes free with Windows Vista is
shockingly good. It's easy to use and learn, especially for those who have
experience with voice recognition software like Dragon NaturallySpeaking,
since the commands are similar if not identical in many cases.

Vista Speech Recognition learns and adapts to your voice while you go
through the interactive tutorials to learn how to use the software, which
only takes about 20 minutes. Immediately after completing the tutorial, I
opened MS Word using voice commands and dictated 4 paragraphs of text and
punctuation. It did not make a single misrecognition.

It works with all Microsoft software and the most other software, allowing
you to navigate menus, Windows controls, etc., all hands free.

Vista Speech Recognition is memory intensive, so I do recommend having at
least 2GB of RAM to use it effectively, especially if you do much
multitasking. I also recommend using a decent quality, noise canceling
microphone, which can be purchased for $20-$30. I also make these same
recommendations for using Dragon NaturallySpeaking.

I would at least try Vista Speech Recognition before investing money in any
version of Dragon NaturallySpeaking.

Regards,

Steve

Dana

I tried dragon 9 with Vista, and decided that I like Vista speech
recognition better. I did not want to spend the money buying dragon 9.5. I
would be interested in seeing a comparison between the two. As I've stated
before, I really like Vista, maybe I've become too complacent? It definitely
self trains itself as I dictate, and after using a new word several times it
figured out how I want that spelled and corrects itself.

say they hire handicapped people. Don't forget to give them a parking permitt
so their genitals don't fall off in the parking lot. When I started seeing

Court: disability laws protect those unable to have sex

Mcclatchy-tribune

WASHINGTON - A South Carolina breast-cancer survivor has beaten the State
Department and

convinced judges in Washington that the inability to have sex is a
disability protected under federal

anti-discrimination laws.

The new appellate-court ruling gives Piedmont, S.C., resident Kathy E. Adams
another potential shot

at serving overseas. More broadly, the ruling cracks open the courtroom door
for additional legal

challenges by those who are sexually incapacitated.

I think it's a major victory for former cancer patients, and for anyone who
has had their sex life disrupted, Adams' attorney, David H.

Shapiro, said Tuesday.

Adams wants to compel the State Department to hire her as a foreign service
officer and provide back pay. She'll now go before a jury and

trial judge, unless the State Department relents first.

In its 2-1 decision, issued Friday, the U.S. Court of Appeals for the
District of Columbia Circuit ruled that Adams has a case against the State

Department. Most significantly, the D.C. circuit court ruled for its first
time that laws that protect people with disabilities from discrimination

cover sexual relations. The ruling overturns a trial judge who'd dismissed
Adams' case.

At the risk of stating the obvious, sex is unquestionably a significant
human activity, one our species has been engaging in at least since the

biblical injunction to 'be fruitful and multiply,' appellate Judge David
Tatel wrote.

Tatel concluded that sex is the kind of major life activity that Congress
considered when it passed the Rehabilitation Act in 1973. The law,

like the better-known Americans with Disabilities Act, prohibits
discrimination against people with disabilities.

Lawmakers defined a disability as an impairment that substantially limits
a major life activity. Courts still struggle to explain what that

means. Last week, for instance, the D.C. appellate court determined that
sleeping is a protected major life activity.

Walking, seeing and hearing, among many other activities, likewise have been
identified as major.

The new ruling comes from what's sometimes called the nation's
second-highest court, meaning that many lawyers will be parsing its words.

As a basic physiological act practiced regularly by a vast portion of the
population, a cornerstone of family and marital life, a conduit to

emotional and spiritual fulfillment, and a crucial element in intimate
relationships, sex easily qualifies as a major life activity, Tatel wrote.

A State Department spokeswoman said the department was still reviewing the
decision.

Adams couldn't be reached for comment Tuesday.

The Russian-speaking Adams aced the State Department's Foreign Service
written and oral exams in 2002, ranking seventh out of 200

candidates. Living about 15 miles south of Greenville, she was in line to
start training in January 2004.

Before her training started, doctors diagnosed her with breast cancer. She
underwent surgery, but the State Department subsequently denied her entry
into the Foreign Service.

The department could not guarantee (her) access to the required medical
follow-up and surveillance at all overseas assignments, a State

Department nurse testified.

State Department officials added, and the dissenting appellate judge agreed,
that the department didn't know about Adams' sexual disability

We American have a way of telling other countries how to lead their lives,
government and establish their laws. Maybe that is why we are often
considered Ugly Americans as we travel abroad. When you leave the
protection of
American soil, you also lose the protection of the Americans With
Disabilities,
along with many other laws of our country.

It is also pretty common with the human population that what we don't
understand, we fear. And that which we fear, we reject. I personally don't
know
the person in Finland who has chosen to respond to your posted question in a
Finland newspaper. Actually, I don't know you that well, with all due
respect. I do know that long before July of 1992 there were many people in
this
country that felt the same way and would have responded to your posting in an
American Newspaper in like fashion. That is purely... human nature. Granted,
its not very nice, but very human.

For me personally, I choose my battles here in the USA. I'm not going to go
abroad and tell those in another country that I wish to enter their country
and live as I did in Good Ole USA. To some personalities, it is considered
baiting and you will received some emotional responses as you have witness.

Could you possible imagine someone in South America, in a wheelchair,
posting in an American Newspaper inquiring about Quick Entry into the United
States. I would imagine the very same kind of response as you witnessed in
Finland.

I wish for you the very best and much success in your endeavor to live in
Finland. But I won't hop the International Band Wagon and challenge those in
other country about their laws and practices. I sincerely hope that you and
your new spouse will do well and that you will find a rewarding occupation
while a member of the Finland Population. But getting involved in your
argument... no thanks.

Steve,
I really appreciate the heads up. To be perfectly frank, I am more than a
little peeved at that NaturallySpeaking would unveil their version 9 just
before Windows Vista was due to come out and then charge for an upgrade.
Did I mention they charged me for two upgrades when I went from version 7 to
version 9?

I am really considering trying out the Windows Vista software when and if I
get a new computer. Right now my computer is still okay, but the 1 MB of
RAM definitely isn't as good as it used to be when I am multitasking. I can
also use a much bigger hard drive now that I am downloading older television

I have to concur with Joan. I have been a Dragon NaturallySpeaking user

shockingly good.

Hi all,
Unless it has changed in last couple of years, getting someone on
disability is not as easy as you may think.
It takes a paper trail with creditable medical evidence that has to show
proof that test , treatment, and types of medicine that you have been on .
Then you have to go to your pharmacy and get a print out for at least a year
to
show you have been taking it. Don't tell me you can't afford it and give
up ,Years ago before Medicare started helping, I was working through the
RXcompanies helping the honest people get their medicine..

You show a 10 year working history and people don't realize how
important this is. It could be very strong evidence on your case.
Let me try to clear up some of the things that people believe. Till about
1995 anyone who had the above evidence for alcohol, or drug use and could not
function did get on SSD . . New laws were passed and really shook up the
way people could get on. No longer could they receive a monthly check.
Their
cases were looked up and evidence gathered and hundreds lost their funds.
They have to show a primary illness that would meet the laws, and then the
alcohol / drugs might be on the application,It is true that a ( pickled
liver ) that show advanced stages might win.
Now about fat people..Their weight is a issue, but there is so much
more. How do they walk, breath ( sleep study ) , take care of their body.
ride, grocery shop, and take care of their homes and family. They often get
terrible rashes that leak fluid, and causes pain.
When you go before the administration law judge and the independent work
specialist you have to prove that the clients chart is complete of all
evidence .You question the client about the medical history and then the
work
history. I would have always made contact with the employer and would have
testimony that show about their job history and what it entailed. Then the
specialist would speak to the judges about his questions, and then I could go
on
and on, but I got off track so forgive my visit to the after years.

service officer and provide back pay. She'll now go before a jury and

trial judge, unless the State Department relents first.

In its 2-1 decision, issued Friday, the U.S. Court of Appeals for the
District of Columbia Circuit ruled that Adams has a case against the State

Department. Most significantly, the D.C. circuit court ruled for its
first time that laws that protect people with disabilities from discrimination

cover sexual relations. The ruling overturns a trial judge who'd
dismissed Adams' case.

At the risk of stating the obvious, sex is unquestionably a significant
human activity, one our species has been engaging in at least since the

biblical injunction to 'be fruitful and multiply,' appellate Judge
David Tatel wrote.

Tatel concluded that sex is the kind of major life activity that
Congress considered when it passed the Rehabilitation Act in 1973. The law,

like the better-known Americans with Disabilities Act, prohibits
discrimination against people with disabilities.

Lawmakers defined a disability as an impairment that substantially
limits a major life activity. Courts still struggle to explain what that

means. Last week, for instance, the D.C. appellate court determined that
sleeping is a protected major life activity.

Walking, seeing and hearing, among many other activities, likewise have
been identified as major.

The new ruling comes from what's sometimes called the nation's
second-highest court, meaning that many lawyers will be parsing its words.

As a basic physiological act practiced regularly by a vast portion of
the population, a cornerstone of family and marital life, a conduit to

emotional and spiritual fulfillment, and a crucial element in intimate
relationships, sex easily qualifies as a major life activity, Tatel wrote.

A State Department spokeswoman said the department was still reviewing
the decision.

Amen Eric and thanks. But I know of people who meet those guidelines and
don't have licensed plates, placards or receive benefits from CMS. They don't
have scooters or wheelchairs. They don't have crutches or canes. To some,
they don't appear to be, but are medically certified.

Then you have those, who I know are lazy and bloated with meds that use
scooters and segways to get about. Oh, they also have all the bells and
whistles
too. License plates and placards. Have mercy on them.

By the way what is a disabled person? Who makes that judgement?
What is a person with a disability and who makes that judgement?

Do doctors make the judgement? Does CMS make that call? Does the license

Certainly, not me.

It wasn't so much as what he said but how he said it ..and his views are not
shared by most others in that forum.
I also retract that last thing i said in my post here ..i mainly just am
interested in getting the opinions of other disabled people on this. Not
really asking you to join my fight ...but i wont discourage it either if
someone wants to voice something .
The man totaly judged me as useless at the mere mention of a chair. and yes
..i'm appalled. It isnt the views of all finns .
I really dont want to go there ..i love my country and dont care to leave it
. It's been very good to me . But this is a matter of the heart ...and well
..i'm going for that reason alone.
I dont think i blame him for not wanting people to come in and leech his tax

We American have a way of telling other countries how to lead their lives,
government and establish their laws. Maybe that is why we are often
considered Ugly Americans as we travel abroad. When you leave the
protection of American soil, you also lose the protection of the Americans With
Disabilities, along with many other laws of our country.

It is also pretty common with the human population that what we don't
understand, we fear. And that which we fear, we reject. I personally
don't know the person in Finland who has chosen to respond to your posted
question in a Finland newspaper. Actually, I don't know you that well,
with all due respect. I do know that long before July of 1992 there were
many people in this country that felt the same way and would have responded to
your posting in an American Newspaper in like fashion. That is purely...
human nature. Granted, its not very nice, but very human.

For me personally, I choose my battles here in the USA. I'm not going
to go abroad and tell those in another country that I wish to enter their
country and live as I did in Good Ole USA. To some personalities, it is
considered baiting and you will received some emotional responses as you have
witness.

Could you possible imagine someone in South America, in a wheelchair,
posting in an American Newspaper inquiring about Quick Entry into the United
States. I would imagine the very same kind of response as you witnessed in
Finland.

I wish for you the very best and much success in your endeavor to live in
Finland. But I won't hop the International Band Wagon and challenge those
in other country about their laws and practices. I sincerely hope that you
and your new spouse will do well and that you will find a rewarding occupation
while a member of the Finland Population. But getting involved in your
argument... no thanks.

(2) Disability. The term disability means, with respect to an individual

the major life activities of such individual;
(B) a record of such an impairment; or

(b) Rules of Construction. Nothing in subsection (a) shall be construed to
exclude as a qualified individual with a disability an individual who

and is no longer engaging in the illegal use of drugs, or has otherwise been
rehabilitated successfully and is no longer engaging in such use;
 (2) is participating in a supervised rehabilitation program and is no

not limited to drug testing, designed to ensure that an individual described in
paragraph (1) or (2) is no longer engaging in the illegal use of drugs.

Several years ago my husband and I began talking about how our government
has its nose into EVERY SINGLE THING regarding a person's life.

When trying to describe this to other people they will automatically
think... 'Well, perhaps but they still have not gotten into person's
bedrooms and what privately goes on the there'. Wrong on many levels. But
for one... what many of us need is 'considered' illegal in most states. I
am talking about digital stimulation = sodomy to one degree.

Then someone may try to defend that because it is necessary or required by
a nurse, etc. etc. etc. But, again, who is to decide what exactly is this

WASHINGTON — A South Carolina breast-cancer survivor has beaten the State
 Department and

convinced judges in Washington that the inability to have sex is a
 disability protected under federal

 anti-discrimination laws.

The new appellate-court ruling gives Piedmont, S.C., resident Kathy E.
 Adams another potential shot

at serving overseas. More broadly, the ruling cracks open the courtroom
 door for additional legal

challenges by those who are sexually incapacitated.

I think it's a major victory for former cancer patients, and for anyone
who has had their sex life disrupted, Adams' attorney, David H.

The ruling overturns a trial judge who'd
 dismissed Adams' case.

At the risk of stating the obvious, sex is unquestionably a significant
human activity, one our species has been engaging in at least since the

biblical injunction to 'be fruitful and multiply,' appellate Judge David
 Tatel wrote.

Tatel concluded that sex is the kind of major life activity that Congress
considered when it passed the Rehabilitation Act in 1973. The law,

like the better-known Americans with Disabilities Act, prohibits
 discrimination against people with disabilities.

Lawmakers defined a disability as an impairment that substantially limits
a major life activity. Courts still struggle to explain what that

means. Last week, for instance, the D.C. appellate court determined that
sleeping is a protected major life activity.

Walking, seeing and hearing, among many other activities, likewise have
 been identified as major.

The new ruling comes from what's sometimes called the nation's
second-highest court, meaning that many lawyers will be parsing its words.

As a basic physiological act practiced regularly by a vast portion of the
population, a cornerstone of family and marital life, a conduit to

emotional and spiritual fulfillment, and a crucial element in intimate
relationships, sex easily qualifies as a major life activity,

  Precisely W.

Several years ago my husband and I began talking about how our government has
its nose into EVERY SINGLE THING regarding a person's life.

When trying to describe this to other people they will automatically think...
'Well, perhaps but they still have not gotten into person's bedrooms and what
privately goes on the there'. Wrong on many levels. But for one... what many
of us need is 'considered' illegal in most states. I am talking about digital
stimulation = sodomy to one degree.

Then someone may try to defend that because it is necessary or required by a
nurse, etc. etc. etc. But, again, who is to decide what exactly is this term
or that term when it comes to the law.

Ziek Heil!, Ziek Heil!, Ziek Heil!, Ziek Heil!, Ziek Heil!, Ziek Heil!, Ziek
Heil!, Ziek Heil

What is a person with a disability and who makes that judgement?

Do doctors make the judgement? Does CMS make that call? Does the license
bureau declare by issuing special license plates and placards? Who is a single
source responsible for passing judgement and making that call?

Certainly, not me.

I knew this would happen. now any company that hires a fridged secretary
can say they hire handicapped people. Don't forget to give them a parking
permitt so their genitals don't fall off in the parking lot. When I started
seeing fat people being listed as handicapped I knew this crap was on the way.
As soon as anyone at work mentons her handicap shes back in court for sexual
harrassment. Our legal system has turned stupidity into an artform. Our schools
have made it mandatory, and our politicians are the poster children. Next year
all ugly people will be called handicapped. I'll be double dipping.
