Re: [RBW] Re: Stolen Rivendell on ebay

2012-05-30 Thread Taylor

Annoyingly enough, the police have been incredibly slow following up about
this, and at this point I'd be pretty sure it has either been sold or
otherwise disposed of. If anyone sees anything matching this description
pop up again, an email or post on the list would be appreciated.

I'd take a guess that the ebay seller may have realized it was stolen and
ended the auction early without a sale. No feedback has been posted on the
transaction.

Renter's insurance normally covers it. Call your agent and ask.

Homeowner's insurance also covers it - in my case I checked and they
cover the loss even if the bike is not at home when stolen.

One thing to make sure of is what type of coverage you have via renter's
insurance. Some policies offer replacement value, which covers you for
the cost of replacing your bike with a like bike at current prices (minus
deductible, of course). Other policies will only cover you for the initial
cost of the bike minus depreciation (and deductible). The first type of

been obtained through commission of a theft offense.

 (B) It is not a defense to a charge of receiving stolen property in
violation of this section that the property was obtained by means
other than through the commission of a theft offense if the property
was explicitly represented to the accused person as being obtained
through the commission of a theft offense.

 (C) Whoever violates this section is guilty of receiving stolen
property. Except as otherwise provided in this division, receiving
stolen property is a misdemeanor of the first degree. If the value of
the property involved is one thousand dollars or more and is less than
seven thousand five hundred dollars, if the property involved is any
of the property listed in section 2913.71 of the Revised Code,
receiving stolen property is a felony of the fifth degree. If the
property involved is a motor vehicle, as defined in section 4501.01 of
the Revised Code, if the property involved is a dangerous drug, as
defined in section 4729.01 of the Revised Code, if the value of the
property involved is seven thousand five hundred dollars or more and
is less than one hundred fifty thousand dollars, or if the property
involved is a firearm or dangerous ordnance, as defined in section
2923.11 of the Revised Code, receiving stolen property is a felony of
the fourth degree. If the value of the property involved is one
hundred fifty thousand dollars or more, receiving stolen property is a
 felony of the third degree.

[RBW] Re: Stolen Rivendell on ebay

2012-05-14 Thread Imladris
Looks like this is a felony of the 5th degree under Ohio law (that is,
being in receipt of stolen property and having reasonable cause to
believe so).

2913.51 Receiving stolen property.
(A) No person shall receive, retain, or dispose of property of another
knowing or having reasonable cause to believe that the property has
been obtained through commission of a theft offense.

Amended by 129th General Assembly File No. 29, HB 86, § 1, eff.
9/30/2011.

Effective Date: 10-29-1999

See 129th General Assembly File No. 29, HB 86, §4.

As much as an experiment as anything I wrote to the seller asking him
about what size the bike for sale is.  S/He responded within just a few
  minutes:

  *Dear quality_trader,*

Hello quality_trader, the frame is a smaller size, the rider was of a
smaller stature (he stood at about 5'4). I can get another measurement for
you. 54-55cm is what we listed as the frame's size.

I am *quality_trader*.  So we can see that s/he is claiming to know the
  history of the bike.

I very much appreciate the people that notified me about this. Going
to try and get it back through official channels before doing anything
  crazy.
