[RollTideFan] Judge dismisses claims against Alabama president

BIRMINGHAM, Ala. -- The remainder of Mike Price's $20 million lawsuit over
his firing as Alabama's football coach was thrown out Thursday, with a judge
dismissing claims against the university president.


While Price alleged he was wrongly fired without a hearing and then denied
an appeal, U.S. District Judge Scott Coogler ruled Price could not collect
from University of Alabama President Robert Witt.


Coogler, who ordered Price to pay the costs of the case, dismissed most of
Price's lawsuit last month when he ruled the university was immune from
being sued over the termination.


At the time, Coogler also said Witt was immune in his official capacity on
most counts, but did not rule until Thursday that Witt could not be sued on
any of the remaining claims.


Price attorney Steve Heninger did not immediately return a telephone call
seeking comment, but Price could appeal.


Witt issued a one-sentence statement saying he was pleased to have reached
closure in this lawsuit.


Price was fired in May after questions arose about his drunken behavior at a
golf tournament in Pensacola, Fla.


Price, who was hired from Washington State last year to replace Dennis
Franchione, admitted being heavily intoxicated at a topless bar. But he
contended his actions did not warrant dismissal.


Price, who had a seven-year, $10 million deal with Alabama, never signed his
contract with the university -- a key fact that Coogler said prevented Price
from proving he was defrauded.


In the lawsuit, Price was seeking $10 million in compensation and the same
amount in punitive damages.


Price filed a separate lawsuit seeking $20 million over a Sports Illustrated
story about his trip to Pensacola. That case is still pending.

Hawkins denies he implicated UT's Fulmer

Former University of Tennessee walk-on Rommie Hawkins spent most of the day
Thursday traveling around Knoxville to various media outlets in an effort to
clear his name.
Hawkins signed a written statement at the News Sentinel - and later at
television and radio stations - in which he denies charges that he
implicated UT football coach Phillip Fulmer in actions that would result in
NCAA violations.
Alabama attorney Thomas Gallion suggested Hawkins provided incriminating
testimony at an Oct. 7 meeting in Memphis in front of his co-counsel,
Phillip Shanks, as well as a private investigator. Gallion said the
investigator signed a sworn affidavit to that effect, and he read that
affidavit on the air on Paul Finebaum's Birmingham, Ala., radio show on Oct.
16.
Gallion said he would shield Hawkins' identity for legal reasons, but he
later referred to him by his first name on Finebaum's show.
Hawkins said he was present at an Oct. 7 meeting, but he was there to
discuss a book he has been working on the past two years.
Hawkins' first clue that something was amiss came when he turned his cell
phone on upon arriving back in Knoxville on Tuesday from a vacation in
Jamaica.
It said I had 29 messages, and I thought, 'That's a record,' '' said
Hawkins, who traveled to the Caribbean to celebrate a friend's 40th
birthday. Before I had a chance to check the messages, my father called me
from Memphis and said, 'The (expletive) has hit the fan.' ''
Gallion, who represents Ronnie Cottrell and Ivy Williams in various suits
involving their dismissal from the Tide's football staff in 2000, had fans
of both Alabama and UT on edge with his interview with Finebaum.
According to Gallion, the affidavit also stated that ex-Vol and current NFL
agent Tim McGee was involved with money wired to an intermediate party
(Hawkins), who in turn had supposedly confessed to passing the money along
to players and their family.
Gallion also said the affidavit stated that Fulmer had knowledge of a
$50,000 line of credit for former UT standout John Henderson, and that UT's
all-time leading rusher Travis Henry received $30,000 in improper benefits.
Fulmer immediately denied the allegations and threatened a lawsuit.
McGee said he was puzzled by the charges; he had dinner with Hawkins on Oct.
14, and Hawkins made no mention of a pending investigation involving UT or
the NCAA.
Hawkins said he boarded a plane for Jamaica on Oct. 15 - one night before
Gallion's radio appearance - with no idea his name would get pulled into yet
another round of allegations involving the two schools.
The meeting I had with Phillip Shanks was to discuss my book,'' Hawkins
said. But they were constantly asking me to tell them something about
Phillip Fulmer.
At one point I stood up and walked out of the meeting. I said, 'What you
want, you can't get. What you want, I don't have.' ''
Hawkins said there was no note-taking, no video recording and no signed
affidavit at the meeting. The parties in attendance, other than himself, his
attorney and Shanks, were all bodyguards.
When told later Thursday of Hawkins' denial, Shanks responded: That is just
preposterous. There are witnesses who heard him say it.
Hawkins said he believes this was all part of a grand scheme.
This was all set up by Logan Young,'' Hawkins said. Shanks represents him,
too.''
Young is a Memphis businessman and prominent booster who was associated with
Alabama during an NCAA investigation of the Albert Means recruiting scandal
which ultimately led to the Crimson Tide program being placed on probation.
Hawkins said the parties from Alabama knew he would be leaving the country,
and he suspects that had much to do with the timing of Gallion's public
statement last week.
Hawkins said he tried to reach both Shanks and Gallion, but each time he or
his lawyer got through, they hung up on us.''

Sorry for not responding quicker, I have been sick for the past few days
Here is why I think we are a young team this year..

Start at the most important position QB...we have a Soph. which didn't get
the playing time he should have last year as a Fr.
RB is fine, but we started a Soph. at FB also in Greg McClain. Then behind
him is Fr. Tim Castille.
WRs are good and senior-laden, but our starting Center is also a Soph.

Move to the defensive side and we see our line is OK to start, but after the
starters nobody else has any experience...and we all see what happens when
we try to play our DL all game long. :-(
Garth is starting and is a Fr. and Tatum (Fr.) is playing now also.
Roach is a Soph. and starting MLB.
DeMeco Ryans started at LB and is a Soph. also.
Wortham is gone. Daniels is gone.
Our best corner is a Soph. (Charlie Peprah)
Roman Harper (supposed to have been a strong point) is also a Soph.

What else you want?
The guys that we do have which are Jr.  Sr. don't have alot of playing time
due to Fran playing the starters in such heavy doses and so you could make a
case for some of them being young.

He could have been both, Devonna. Depending on the source of the
information and the year of the publication. There's usually a player,
or two almost every year who changes numbers from the previous year when
a number they like becomes available. That usually happens very early in
a career, though.

It's UT Week in TitleTown ladies and gentlemen.

You know the best thing about Daniel Moore paintings?
Even though they do a beautiful job capturing the
moments most associated with the game they represent,
they also evoke memories of the moments leading up to
these plays that were often as big (if not bigger)
than the actual game winning plays themselves.
There's no 'Goal Line Stand' if Don McNeal doesn't
appear from nowhere to stop Penn State receiver Scott
Fitzkee at the one two plays earlier.
There's no 'Kick' from Van Tiffin if Greg Richardson
doesn't drag the Auburn defensive back halfway across
the field in an effort to get out of bounds to stop
the clock.
There's no 'Block' by Thomas Rayam in Happy Valley if
Tide defenders don't stop Blair Thomas inches short of
the goal line moments before.

The funny thing about plays like these is that when
they happen, when you're there in the stands and you
see them, or when you're at home watching the game on
television, they seem so large, so defining, that
you're sure you'll be singing the praises of the men
responsible for years to come. But those thoughts are
brief. They get caught up in the wave of emotion that
follows when the field goal is good, or blocked, or
the touchdown scored, or the end zone protected. It's
the kicker or quarterback that gets carried off the
field, and rightfully so, but it's the guy that made
the touchdown saving tackle, or the key block to open
up the hole, that makes Alabama football so damn
wonderful.

So damn wonderful.

Football is a team sport. It is a drama that is played
out over the course of an hour, but it's made up of
quick moments that turn goats to heroes.
It's moments like these that etch the names of Alabama
football players in the aura and tradition that makes
this program so special.

I bring all this up because I was thinking about Stacy
Harrison earlier today.

Do you remember Stacy Harrison?
He played defensive back at the Capstone in the early
90s. Wore #1. He was a solid performer. Not that big.
Not that fast. At the beginning of the 1990 season he
had taken his share of heat, just like every other
player that wore Crimson and White. Bama had a new
coach and had lost three games (by a total of eight
points). The games they'd won were not that impressive
(victories over Vanderbilt never are). The offense was
too conservative, the defense couldn't stop anybody.
In fact, they couldn't even stop a high school team
(insert Lee Corso reference here). Alabama was
expected to roll right over and die against a superior
team from Knoxville that year. The coach would be run
out of town, Bama would suffer a losing season. All
hope was lost.

Somebody forgot to tell Stacy Harrison.
With :48 seconds left in a 6-6 ballgame Tennessee
lined up for what would be a game winning field goal.

Bama had blown yet another game.
Somebody forgot to tell Stacy Harrison.
Somebody forgot to block Stacy Harrison.

The painting shows Phillip Doyle booting the game
winning field goal, but if you look closely, standing
on the sidelines you see #1, and you remember. You
remember that winning big games in big settings is
about big time players stepping up and making big time
plays. It's about never letting down, never taking a
play off. It's about holding the block for one second
longer than you usually do or laying out for that pass
that's usually out of reach. It's about patience and
pride and determination. It's about wrapping up. It's
about staying focused. It's about respect.

And it's about guys that fight hard enough, stay with
it long enough, and believe in themselves and the guys
around them enough that they find themselves in the
right position, at the right time, to make the tackle,
or get out of bounds, or block the kick.
I was determined to block that field goal. There was
no way I was going to let Alabama lose.
No way.
No way.

All Alabama did after that game (a game that was
supposed to mark the end of life as we know it) was
win 35 of their next 39 ballgames.
This is the Third Saturday in October. That means
something folks. It meant something to our
grandfathers. It meant something to our fathers. It's
sacred. It's pure. It's beautiful. It's Crimson and
Orange. It's Bryant and Neyland. It's Alabama and
Tennessee.

And I love it.
I love it.
I love it so much I can't stand to think about it
because all I want to do is get up, hand in my
resignation, fill up the gas tank, put on my 'Nothing
Sucks Like A Big Orange' t-shirt and make that
wonderful drive down the road to the most beautiful
campus in the land, walk to the Quad and yell at the
top of my lungs: I HATE TENNESSEE!
And I'm going to die if it doesn't hurry up and get
here.

This is a chance to make things right. It's a chance
for some guy in a Crimson jersey to put disappointing
seasons and losses behind him and do something.
It's why I'm sitting here thinking of Stacy Harrison.
It's a chance to become part of Alabama lore.

 Here is why I think we are a young team this year..

 Start at the most important position QB...we have a Soph. which didn't

 the playing time he should have last year as a Fr.
 RB is fine, but we started a Soph. at FB also in Greg McClain. Then
behind
 him is Fr. Tim Castille.
 WRs are good and senior-laden, but our starting Center is also a Soph.

 Move to the defensive side and we see our line is OK to start, but
after the
 starters nobody else has any experience...and we all see what happens
when
 we try to play our DL all game long. :-(
 Garth is starting and is a Fr. and Tatum (Fr.) is playing now also.
 Roach is a Soph. and starting MLB.
 DeMeco Ryans started at LB and is a Soph. also.
 Wortham is gone. Daniels is gone.
 Our best corner is a Soph. (Charlie Peprah)
 Roman Harper (supposed to have been a strong point) is also a Soph.

 What else you want?
 The guys that we do have which are Jr.  Sr. don't have alot of

I bring all this up because I was thinking about Stacy
Harrison earlier today.

Do you remember Stacy Harrison?
He played defensive back at the Capstone in the early
90s. Wore #1. He was a solid performer. Not that big.
Not that fast. At the beginning of the 1990 season he
had taken his share of heat, just like every other
player that wore Crimson and White. Bama had a new
coach and had lost three games (by a total of eight
points). The games they'd won were not that impressive
(victories over Vanderbilt never are). The offense was
too conservative, the defense couldn't stop anybody.
In fact, they couldn't even stop a high school team
(insert Lee Corso reference here). Alabama was
expected to roll right over and die against a superior
team from Knoxville that year. The coach would be run
out of town, Bama would suffer a losing season. All
hope was lost.

Somebody forgot to tell Stacy Harrison.
With :48 seconds left in a 6-6 ballgame Tennessee
lined up for what would be a game winning field goal.

Bama had blown yet another game.
Somebody forgot to tell Stacy Harrison.
Somebody forgot to block Stacy Harrison.

The painting shows Phillip Doyle booting the game
winning field goal, but if you look closely, standing
on the sidelines you see #1, and you remember. You
remember that winning big games in big settings is
about big time players stepping up and making big time
plays. It's about never letting down, never taking a
play off. It's about holding the block for one second
longer than you usually do or laying out for that pass
that's usually out of reach. It's about patience and
pride and determination. It's about wrapping up. It's
about staying focused. It's about respect.

And it's about guys that fight hard enough, stay with
it long enough, and believe in themselves and the guys
around them enough that they find themselves in the
right position, at the right time, to make the tackle,
or get out of bounds, or block the kick.
I was determined to block that field goal. There was
no way I was going to let Alabama lose.
No way.
No way.

All Alabama did after that game (a game that was
supposed to mark the end of life as we know it) was
win 35 of their next 39 ballgames.
This is the Third Saturday in October. That means
something folks. It meant something to our
grandfathers. It meant something to our fathers. It's
sacred. It's pure. It's beautiful. It's Crimson and
Orange. It's Bryant and Neyland. It's Alabama and
Tennessee.

There's no 'Goal Line Stand' if Don McNeal doesn't
appear from nowhere to stop Penn State receiver Scott
Fitzkee at the one two plays earlier.
There's no 'Kick' from Van Tiffin if Greg Richardson
doesn't drag the Auburn defensive back halfway across
the field in an effort to get out of bounds to stop
the clock.
There's no 'Block' by Thomas Rayam in Happy Valley if
Tide defenders don't stop Blair Thomas inches short of
the goal line moments before.
   
The funny thing about plays like these is that when
they happen, when you're there in the stands and you
see them, or when you're at home watching the game on
television, they seem so large, so defining, that
you're sure you'll be singing the praises of the men
responsible for years to come. But those thoughts are
brief. They get caught up in the wave of emotion that
follows when the field goal is good, or blocked, or
the touchdown scored, or the end zone protected. It's
the kicker or quarterback that gets carried off the
field, and rightfully so, but it's the guy that made
the touchdown saving tackle, or the key block to open
up the hole, that makes Alabama football so damn
wonderful.
   
So damn wonderful.
   
Football is a team sport. It is a drama that is played
out over the course of an hour, but it's made up of
quick moments that turn goats to heroes.
It's moments like these that etch the names of Alabama
football players in the aura and tradition that makes
this program so special.
   
I bring all this up because I was thinking about Stacy
Harrison earlier today.
   
Do you remember Stacy Harrison?
He played defensive back at the Capstone in the early
90s. Wore #1. He was a solid performer. Not that big.
Not that fast. At the beginning of the 1990 season he
had taken his share of heat, just like every other
player that wore Crimson and White. Bama had a new
coach and had lost three games (by a total of eight
points). The games they'd won were not that impressive
(victories over Vanderbilt never are). The offense was
too conservative, the defense couldn't stop anybody.
In fact, they couldn't even stop a high school team
(insert Lee Corso reference here). Alabama was
expected to roll right over and die against a superior
team from Knoxville that year. The coach would be run
out of town, Bama would suffer a losing season. All
hope was lost.
   
Somebody forgot to tell Stacy Harrison.
With :48 seconds left in a 6-6 ballgame Tennessee
lined up for what would be a game winning field goal.
   
Bama had blown yet another game.

complimentary. Lee Baker has been a staunch defender of Marsh, for
example. I believe our long, lost ScR was as well. This is the first
thing I've read that made Marsh look to be less than honorable that
wasn't just an opinion of someone.

 had taken his share of heat, just like every
 other
 player that wore Crimson and White. Bama had
 a new
 coach and had lost three games (by a total
 of eight
 points). The games they'd won were not that
 impressive
 (victories over Vanderbilt never are). The
 offense was
 too conservative, the defense couldn't stop
 anybody.
 In fact, they couldn't even stop a high
 school team
 (insert Lee Corso reference here). Alabama
 was
 expected to roll right over and die against
 a superior
 team from Knoxville that year. The coach
 would be run
 out of town, Bama would suffer a losing
 season. All
 hope was lost.

 lined up for what would be a game winning

The funny thing about plays like these is that when
they happen, when you're there in the stands and you
see them, or when you're at home watching the game on
television, they seem so large, so defining, that
you're sure you'll be singing the praises of the men
responsible for years to come. But those thoughts are
brief. They get caught up in the wave of emotion that
follows when the field goal is good, or blocked, or
the touchdown scored, or the end zone protected. It's
the kicker or quarterback that gets carried off the
field, and rightfully so, but it's the guy that made
the touchdown saving tackle, or the key block to open
up the hole, that makes Alabama football so damn
wonderful.
So damn wonderful.

Football is a team sport. It is a drama that is played
out over the course of an hour, but it's made up of
quick moments that turn goats to heroes.
It's moments like these that etch the names of Alabama
football players in the aura and tradition that makes
this program so special.
I bring all this up because I was thinking about Stacy
Harrison earlier today.
Do you remember Stacy Harrison?
He played defensive back at the Capstone in the early
90s. Wore #1. He was a solid performer. Not that big.
Not that fast. At the beginning of the 1990 season he
had taken his share of heat, just like every other
player that wore Crimson and White. Bama had a new
coach and had lost three games (by a total of eight
points). The games they'd won were not that impressive
(victories over Vanderbilt never are). The offense was
too conservative, the defense couldn't stop anybody.
In fact, they couldn't even stop a high school team
(insert Lee Corso reference here). Alabama was
expected to roll right over and die against a superior
team from Knoxville that year. The coach would be run
out of town, Bama would suffer a losing season. All
hope was lost.
Somebody forgot to tell Stacy Harrison.
With :48 seconds left in a 6-6 ballgame Tennessee
lined up for what would be a game winning field goal.
Bama had blown yet another game.
Somebody forgot to tell Stacy Harrison.
Somebody forgot to block Stacy Harrison.
The painting shows Phillip Doyle booting the game
winning field goal, but if you look closely, standing
on the sidelines you see #1, and you remember. You
remember that winning big games in big settings is
about big time players stepping up and making big time
plays. It's about never letting down, never taking a
play off. It's about holding the block for one second
longer than you usually do or laying out for that pass
that's usually out of reach. It's about patience and
pride and determination. It's about wrapping up. It's
about staying focused. It's about respect.
And it's about guys that fight hard enough, stay with
it long enough, and believe in themselves and the guys
around them enough that they find themselves in the
right position, at the right time, to make the tackle,
or get out of bounds, or block the kick.
I was determined to block that field goal. There was
no way I was going to let Alabama lose.
No way.
No way.
All Alabama did after that game (a game that was
supposed to mark the end of life as we know it) was
win 35 of their next 39 ballgames.
This is the Third Saturday in October. That means
something folks. It meant something to our
grandfathers. It meant something to our fathers. It's
sacred. It's pure. It's beautiful. It's Crimson and
Orange. It's Bryant and Neyland. It's Alabama and
Tennessee.
And I love it.
I love it.
I love it so much I can't stand to think about it
because all I want to do is get up, hand in my
resignation, fill up the gas tank, put on my 'Nothing
Sucks Like A Big Orange' t-shirt and make that
wonderful drive down the road to the most beautiful
campus in the land, walk to the Quad and yell at the
top of my lungs: I HATE TENNESSEE!
And I'm going to die if it doesn't hurry up and get
here.
This is a chance to make things right. It's a chance
for some guy

wondering if anybody could help me out. Recently I discovered that a number of 
files on my computer were infected and I had to delete them. In the course of 
this cleaning I lost my file with Yea Alabama on it. Tis is the version like is 
played on the jumbotron at BD. It has the elphant stomping at the begining and a 
big elephant "wail" leading into the fight song. If anybody could e-mail it to

Enough is enough. Now that the gasoline has been tossed on the 
Alabama-Tennessee football rivalry, the dirt dug up and cases made by 
over-the-top supporters and lawyers, somebody with some clout needs to 
step in and call a cease-fire.

Maybe it falls on the shoulders of Southeastern Conference commissioner 
Mike Slive. Or perhaps it's the job of the university presidents.

Alabama fans have long contended that Tennessee boosters Roy Tennstud 
Adams and Karl Schledwitz helped put the Crimson Tide on a five-year 
NCAA probation with accusations that former Memphis area recruit Albert 
Means was paid to sign with 'Bama.

Now allegations are flying that several former Tennessee players were 
paid by a sports agent while in Knoxville and that UT coach Philip 
Fulmer was involved with a $50,000 line of credit for former UT player 
John Henderson. These allegations are coming from two Alabama alums, 
attorneys Tommy Gallion and Philip Shanks.

All right. It's time to call it even and move on. If not, we could be 
looking at a replay of the Southwest Conference fiasco of almost two 
decades ago, where squealing on one another reached ridiculous levels. 
And we all know what happened to the Southwest Conference.

Right now, the SEC remains college football's most passionate locale, 
its schools on pace to attract six million fans this fall. But the 
league also has no equal when it comes to institutions on NCAA probation 
or under a cloud of suspicion.

One of the great things about the Southeastern Conference is our fans 
and our support -- the importance of college football,'' Slive said. On 
occasion that exuberance goes over the top. What we'd ultimately like to 
do is channel it on the field.''

Slive, on the job less than two years, smartly deputized a task force to 
look into cleaning up the SEC and has a frequently stated his five-year 
goal of having every conference school free NCAA sanctions. But when 
allegations are floated, such as the work of Gallion and Shanks, the 
boss remains adamant that the schools thoroughly investigate and report 
back their findings.

The latter should be comforting to the loquacious attorneys representing 
former Alabama coaches Ronnie Cottrell and Ivy Williams, who spend as 
much time publicly trashing Tennessee's Fullmer and his football program 
as lawyering to their clients. Gallion and Shanks were born bleating 
Roll Tide. Their fathers were Alabama classmates of Paul Bear'' 
Bryant. And Shanks is reputed to own the biggest and best collection of 
Alabama sporting memorabilia.

Nor is the timing of their leaking of affidavits and dirt on Tennessee 
mere coincidence. The plan for months has been to deliver a truckload of 
trash on the eve of Saturday's game in Tuscaloosa.

If they want to open a cesspool, they got it in their own backyard,'' 
Gallion argues. And Alabama people are tired of this [expletive].''

So the attorneys have sued everyone and anyone with a hand in an NCAA 
probe that cost their clients their jobs and reputations. Meanwhile, on 
Oct. 7, their Tennessee offensive got the ammunition it so desperately 
sought when Rommie Hawkins, a former Tennessee walk-on, showed up 
with his lawyer for a three-hour debriefing in Shanks' office.

We kept hearing reports about Tennessee being not just dirty but 
filthy,'' Shanks told SI.com after the meeting. We never could prove it 
till Tuesday night.''

Sports agent Tim McGee, a former star receiver at Tennessee, once 
employed Hawkins, Shanks said. During the meeting with Hawkins, Shanks 
said, he also saw bank records detailing payments made by CSM, McGee's 
Ohio-based firm, to former UT players Henderson, Travis Henry and Fred 
Weary.

According to the most damning allegation, Fulmer sat in on a meeting in 
early 2001 in which plans were discussed to get a $50,000 line of credit 
for Henderson. It was expected at the time that Henderson, fresh from 
winning the Outland Trophy, would enter the NFL Draft, but instead he 
returned for his senior year before being drafted in the first 
round of the 2002 draft by the Jacksonville Jaguars.

Fulmer has called claims of his involvement ridiculous'' and has 
threatened to sue Gallion. McGee and Henderson also deny any wrongdoing.

But Shanks says he jotted down enough information from his meeting with 
Hawkins to begin subpoenaing records from two Tennessee banks. And a 
supportive affidavit has already been released from a security 
consultant'' who attended the Oct. 7 meeting. So it'll be interesting to 
see what other evidence is produced.

But this organized investigation to bring down a rival, even if the work 
of a handful, only further tarnishes the SEC's image.

Clearly, it's sad when you have ethical conduct issues, academic fraud 
and these issues in college athletics,'' says John Gerdy, a former SEC 
assistant commissioner.

its commitment to NCAA rules compliance since the 1999 infractions case.

As a result of these mitigating factors, the committee did not impose 
all of the presumptive penalties for major violations specified in NCAA 
bylaws, nor did it impose the penalties for repeat violators. [...]

decades ago, where squealing on one another reached ridiculous
