[RollTideFan] Judge snuffs lawsuit vs. NCAA, Fulmer because of jurisdiction

2004-08-02 Thread kurtrasmussen
http://www.usatoday.com/sports/college/football/sec/2004-08-02-fulmer-suit_x.htm?POE=SPOISVA
Judge snuffs lawsuit vs. NCAA, Fulmer because of jurisdiction
TUSCALOOSA, Ala. (AP) A state circuit judge Monday dismissed the
defamation lawsuit filed against the NCAA, Tennessee coach Phillip
Fulmer and others by former Alabama signee Kenny Smith, citing a lack of
jurisdiction.

Circuit Judge Scott Donaldson of Tuscaloosa did not rule on the merits
of the case, but sided with defendants' claims that the Alabama court
lacked jurisdiction because the allegedly defamatory comments were made
in Tennessee.

Smith's attorneys contended the suit needs to be heard in Alabama
because that's where the allegedly damaged parties reside.

The suit was filed against the NCAA, Fulmer, NCAA investigator Rich
Johanningmeier, NCAA spokesman Wally Renfro, NCAA President Myles Brand,
the American Football Coaches Association and Tom Culpepper, a
recruiting analyst. It asked for $40 million in damages.

It is a good day for the coaching profession and the NCAA system of
self-governance, Fulmer said in a statement. I have been confident all
along that we did what was right, the system would work, and it has.

We're not totally surprised by the court's ruling, said Tuscaloosa
attorney Delaine Mountain, who is representing Smith and his family. We
knew it was a very close question.

He said no decision had been made on whether to appeal.
The lawsuit stems primarily from a statement Fulmer made to
Johanningmeier in 2000 that Smith's mother, Vicki Smith Dagnan, was
having an affair with an Alabama assistant. Summaries of that interview
became public in January as part of the criminal case against former
Alabama booster Logan Young in Memphis.

Kenny Smith, a lineman at Stevenson High in northeast Alabama, failed to
qualify academically after signing with Alabama and later went to Tennessee.

Alabama Football Fall Practice Preview
By Mitch Dobbs
Date: Aug 2, 2004

With just over a week remaining until the beginning of fall football practices, the
University of Alabama released its preseason practice schedule on Monday.

Rules allow up to 105 players to report next Monday, although Alabama might hold a
spot for Ezekial Knight, who is awaiting test results to see if he is qualified to
enroll at UA. The 105-man roster is expected to be released this week.

On Monday, Augst 9, the squad will have photo and video mug shots made, be issued
equipment and lockers, and some will be obligated to attend a press gathering at the
football complex later that day. The squad will practice for the first time Tuesday
afternoon, August 10.

Classes for Alabama’s second summer session end on August 11th, and final examinations
for the term will wrap up on the 13th of August, an important date for Anthony Bryant,
who must fulfill graduation requirements this summer in order to be eligible for his
final season. And it’s not unusual for a few players to have academic work that must
be completed.

Another milestone will take place on Saturday, August 14, when coaches get to see
their players in full pads for the first time. The Crimson Tide will begin with
two-a-day practices on the following day, and continue every other day until August
23. In a rule that was in place for the 2003 season, a team may not have consecutive
days of two-a-day practices. Scrimmages dates have not yet been released.

The first day off for the Tide players will be on August 28th, 18 days into fall camp.
On Sunday, August 29th, the squad will begin game week preparation for the season
opener against Utah State, which kicks off at 6 p.m. on September 4, 2004.

After Alabama’s opener with Utah State, the Tide players will practice from 8:45-9:30
PM on Sunday. Monday will be the squad’s off day. Tuesday through Thursday the squad
will practice in the afternoon.

Among players who will not be on the 105-man roster are John Parker Wilson and Drew
Davis, who were greyshirts and are expected to re-sign in 2005. Defensive linemen
Lorenzo Washington and Brandon Fanney will attend prep school and are expected to
re-sign next year as well. Nikita Stover, Kevin Hamilton and Jeramie Holifield will go
the junior college route will be re-recruited in two years.

[RollTideFan] Eddie Robinson

*Disease traps former Grambling coach in silence
http://sfgate.com/cgi-bin/article.cgi?file=/news/archive/2004/08/02/sports1659EDT0383.DTL
**
*- MARY FOSTER, AP Sports Writer
Monday, August 2, 2004

(08-02) 13:59 PDT GRAMBLING, La. (AP) --
Eddie Robinson shuffles into the room, hunched over a cane -- a shadow
of the charismatic coach who made little Grambling State University famous.

Then he catches the eye of a visitor, and a familiar smile lights his
face, just as it always has.

I feel good, Robinson said, before drifting off into silence.
The smile is almost all that remains of one of the greatest coaches in
college football history.

Once the most ebullient of men, Robinson has become quiet and distant as
Alzheimer's disease isolates him from all that was once important to him.

We tried to watch the Bayou Classic -- he founded that game, said
Robinson's wife, Doris, referring to the annual game between Grambling
and archrival Southern played at the Superdome in New Orleans. But he
couldn't stay with it.

Robinson, 85, now sits quietly, answering questions with short replies
or looks of consternation.

He retired in 1997 as the winningest coach in college football history
with 408 victories at Grambling. Shortly after his 56-year coaching
career at the historically black school ended, symptoms of the disease
began to show.

He just didn't feel too well, Doris said. Then it was like he was
just slipping away. Every day a little more was gone.

These days, Robinson lives in a gray twilight. His wife of 63 years and
his son are the only things that break into his conscience.

This is the hardest thing I've ever gone through in my life, Doris
said. We had such a great marriage. We did everything with such
enthusiasm. We had our kids, we had his football, and he took me with
him all the way.

Doris is still with the man she fell in love with when they were
eighth-graders in a segregated school.

Robinson was selling newspapers and shining shoes to make money when
Doris' aunt, on a visit to what was then called the Louisiana Negro
Normal and Industrial Institute, spoke to the school's president about
her niece's fiance. The school needed a coach, and she suggested
Robinson for the job.

Robinson scraped together the money to go to a coaching school in
Chicago. Then he returned to Grambling and gave the football program and
the little town an identity.

When I go to conventions, everyone knows about Grambling because of
Coach Rob, said Jean Smith, a longtime Grambling resident and friend of
the Robinsons. Now that word about his condition is out, people ask
about him.

There was more to Robinson's career than his incredible record
(408-165-15), however.

James Harris played quarterback for Robinson from 1965-69, before a long
career in the NFL as a player and then an executive. He is now vice
president of player personnel for the Jacksonville Jaguars.

Most players that played for him truly felt he is the person outside
their families that influenced them most, Harris said. You always hear
about the football players he turned out, but he turned out a lot of
doctors and lawyers and college graduates. Because of him, a lot of men
can support families better because they got educations.

Robinson spends his days in the red-brick house he and his wife built in
1953.

He still comes to the table for meals, but he wants to go right back to
bed, Doris said.

The couple's son, Eddie Jr., visits every day, helping his father walk
around the house or taking him for car rides.

He just gets tired quickly, the younger Robinson said.
People still visit the Robinson house almost daily -- fans, reporters,
former players.

Most times they can't see him because he's in bed, Doris says. People
still want him to autograph things, but he can't do that any more.

The Robinson house is still full of memorabilia: pictures with players,
coaches, Alabama coach Bear Bryant and President Clinton. Enough to fill
two 18-wheelers has been put in storage. There's been talk of a museum
for years.

We're hopeful, Doris says. The state said they were going to build one.
One memory, at least, remains for Robinson.
He always wants me with him, Doris said. We still sleep together.
Sometimes he calls me during the day: 'Babe, come here, I don't feel
good.' And when I get there, there's nothing wrong. He just wants me
there. So I lie down beside him and stay there.
