With my list moderator/owner hat on.

I have confirmed that only the list moderators and the infrastructure
team have direct access to the subscription lists.

The evidence available points to the e-mail addresses having been
harvested either by parsing one of the list archives or simply by virtue
of being a subscriber to the list. There is no evidence that the
subscriber list was accessed directly.

The action taken has been to make clear (both publicly in this thread
and privately elsewhere) that this was not acceptable and should not be
repeated. An assurance has been given that this will not be repeated.

At this point, I think the matter can be considered closed.

To add maybe a final note to this thread :

From further analysis, it seems that in order to send these undoubtedly spam emails, 
Gurkan seems to have used the services of an organisation which, according to their own 
website at least (http://mailchimp.com/legal/privacy/) is taking some steps to insure that 
their lists of recipients would not be spread further.

Whether this was intentional or not, that is to his credit.

As an information professional, I feel however that I should add that this is far from 
being the general case, and that in my experience it happens frequently that such 
recipient lists are subsequently copied, re-distributed, re-sold or "leaked" to other 
related-or-not entities, even by organisations which very ponderously /pretend/ otherwise 
on their public website (or in public hearings, for that matter).

lists, using my free time to try to help others.


It annoys me in general when I receive unsollicited advertisement emails.
It annoys me all the more when these unsolicited advertisement emails come from someone 
who obviously used an email address scraped (or worse) from a list to which I participate.
And even more so when it turns out that the person at the origin of it is someone who 
should be aware of at least some ethics commonly accepted in the Open Source world.


I did not choose to be on your marketing list.  Why should I have to inconvenience myself 
by "opting out" of it by sending some email to someone or something I do not know, at the 
risk of my email appearing on even more such spam lists ?

(Do you happily click on all the "unsubscribe" links that you receive ?)

So please, since you were the one to put me on that list against my will, take the burden 
yourself of unsubscribing me right now.


In any case, if the objective was to gather favorable potential customer attention, the 
reactions so far on this list should have shown by now that the result is rather negative.
On this type of list that was quite predictable, which doesn't speak very well for your 
marketing team's sense.

And you haven't helped your case by your own reactions so far.

Since this correspondence will stay in the list archives, maybe it will help deter others 
in the future.  Aleluia.


Note also that if the objective was to advertise your capacity to provide professional 
help for matters related to Tomcat, there was a better way to do that all along :

So to sum up you created a mailing list somehow, and then sent an
unsolicited email to a list of people. Now you demand that they
unsubscribe from your mailing list. You also feign that you can't
understand why people are complaining. To turn this on its head, how
about this. If each person on this list, decides that you might be
interested in something (I don't know a site selling a little blue
pill lets say for example), and added your email address to a mailing
service. Then when you complain about all the unsolicited email, we
can tell you "well we thought that you might be interested" and
"Anyway, I closed the discussion from my side! If you are really
feeling bad now because of receiving such email from me, please
unsubscribe the list." How would that make you feel?

Just because you are bored of this topic, doesn't mean other people
are. We are upset that somebody has spammed us. We want satisfaction.
Some kind of apology would be a start. Owning up to how created the
mailing list with emails might help. That way may be we can try to
prevent it from happening again.

Gurkan, that seems to be an issue - people did not choose to be subscribed
to your marketing list, they did choose to be on the Tomcat Users list :)

In your defence, I am a Tomcat Users list subscriber, and I did not get
mail from your marketing list :)

projects. Its solely related with my marketing team in which how you get 
emails. If I thought that it will be a spam, would I put my email address to 
sender? I think no! We thought that you can benefit from this email.

and make sure I can trust the link so I'm not just feeding a spammer.  I

ASF hopping on the bandwagon.  If this is going to be the new norm for
ASF I may have to rethink my list subscriptions.

With my list owner hat on again, I'd just like to make it crystal
clear that this spam was not sent by the Apache Tomcat community or
any other part of the ASF.

While the individual who sent the e-mail is a member of the ASF and is
active in a number of ASF communities, the individual was acting as an
representative of their company. They were not acting on behalf of the
ASF.

While the ASF recognises that it is possible for spammers to scrap
e-mail addresses from ASF mailing lists, it is ASF policy that the
lists of the subscribers to ASF mailing lists are kept private.

FYI.

This e-mail has triggered a number of complaints across the ASF, not
just on this list. With my list moderator hat on I'm trying to find out
exactly what happened and I'll update the list as I have some useful
information to report.

So far, I can confirm that the e-mail is not a forgery and that it was
sent by Gurkan Erdogdu who is the Chair of OpenWebBeans and a member of
the ASF.

I am currently attempting to discover how the list of recipients was
compiled.
