The incentive is not the almighty dollar, that's for sure... As cliché as the I do it for myself thing might sound, it's pretty much true. Right again Pete. :-) Why do you think I do my podcast Clint? Because I ENJOY IT. Why do I write my little online soap opera I have Clint? Because I ENJOY IT. Why do you think I run a video blog of stupid people Clint? Because I ENJOY IT SEE THE HUMOR IN THE STUPIDITY OF OTHERS (when there is humor to see of course :-) ). I think he's just confusing doing stuff out of enjoyment with doing stuff for a living. Good, then in a world without copyright, what I'll do is I'll just watch for what you're creating and as soon as I see something I like, I'll call it my own and commercialize it. Work for hire is bad enough, a world without copyright is anarchy, and the people who would be getting screwed the most would be the ones creating works. It's a good point to make in the case of the artists vs. the record labels. But do you honestly believe it would be anarchist if someone thinks that a simple song such as HAPPY BIRTHDAY should be made public domain? C'mon Clint.. What you're missing is that copyright is necessary to give people the incentive to keep creating, because I guarantee the first time I took what you did and made a fortune on it that was rightfully yours, your motivation to be creative would certainly be impaired. Ask some people who have had famous works taken away from them under work for hire clauses and see how they feel about trying to make a living as a creative person. Only difference is Clint, we're not talking about just any ordinary piece of work here. We're talking about a song that's just as universal (if not more so) around the world as Jingle Bells. Big difference dude. That's not to say copyright is a perfect system. You're right. It's not. There are many issues with it right now that need to be resolved so that the public's freedom's are protected. It's certainly better than the alternative though. And just what would that be in your mind Clint? Anarchy? C'mon. You're not giving the American people enough credit. Sure, a middle ground needs to be reached. I am not a Freeplay Music user. If I were, at this point I would consider such a letter to be a Cease Desist order, take down the offending music, and let them take me to court if they really needed the $200. That's my opinion as well Steph. Besides, you can't get into trouble (at least with FPM) over something that's no longer linked to your site, though the IA may have a few choice words. But even then, they would just assume avoid litigation themselves simply by removing the offending the files and send you an email reminding you of *their* TOS (if they don't ban you outright). Erin wrote Hey all, I hate to be keeping this discussion lingering around but wanted to let everyone know what's going on. In regards to what Stephanie wrote, and what others have said on and off list to me.. I've started to wonder if maybe I am being too apologetic about this whole thing. (Truth is, I've always been that way, and am quick to take blame and apologize for things in order to keep peace and avoid confrontation). You're not being overly apologetic. In fact, if anyone needs to apologize, it's me for seeming to be complacent (sp?). Anyway, after talking extensively with my husband about this.. we have decided not to pay the entire amount to Freeplay Music. To be fair, I am going to offer to pay for the music as if it were pro-rated for a year. This afternoon, I will be taking down all my videos containing complete selections of Freeplay Music (6 in total). They will still be on the archive, but I will be requesting they be removed from there as well. Anyone know who best to contact at IA to do this? Could IA get in trouble as well for continuing to host them? I would hate for that to happen. I'm seriously considering not even linking to the podcasts I've done so far using their music (which is just about every single one of them), but leaving the posts up as they go into what was covered on each show. I keep wrestling with myself as to if I am doing the right thing or not... but I have heard from more people who are of the opinion that I should not pay. I would gladly pay the money if 1)they didn't make it so easy for people to make a mistake. You don't even have to read the terms in order to download the music. Even when you do read the terms, anyone could make the mistake of reading Private Non-Commercial Use (Non-revenue generating or associated) and stop there, thinking they were safe. In my opinion, a much better way of making sure people weren't abusing this is to have someone register on the site and have them actually check a box that says they agree to terms. 2)The name, in and of itself, is misleading. For most ways this music is used, it isn't free at all. You see the name Freeplay Music and can immediately start downloading. Not a great idea if you ask me. I ranted on this on my podcast earlier today (which BTW will NOT have the open close I normally attach to each show) and an idea hit me that if they were to charge a ONE-TIME flat fee $5 (or whatever the minilum value of a Money Order is nowadays) per track download REGARDLESS OF USE, they'd make a fuckin' mint. I mean, think of it this way, how many times do you have to pay for a gallon of milk at the grocery store before they actually consider it yours to leave with? Answer - ONCE - At the checkout counter. When is the next time you pay for milk? Answer - WHEN YOU GET ANOTHER GALLON. I've NEVER seen ANY business charge me for something more than once. Anyway, not that anyone will probably care... but a lot of my most recent videos will exist no more. I will probably try and fix them and eventually re-vlog them, but I'd rather be focused on posting some new content for now. Same with my podcast. I can't replace those, but I'll certainly break the links to all the affected podcasts. The others however will remain. Additionally, you may have noticed that I also write a text-based Internet Soap Opera (I included that when signing with my All Blogs signature even though its not really a blog). Recently, I started a collection of various theme music (which can be accessed via the show's message board) for the open and close of the show plus other various occasions as they occur. Well, as a result of your experience with FPM Erin, the first thing I did was to restrict access to that section to me and me only (as well as the board's host should FPM somehow contact them). This way I don't have to rebuild it. I can just simply change the links. I will however remove the files as well from my Comcast storage space though as then this way even if Admin access is bypassed somehow, the links will be broken as no file will be found. But that's NOTHING compared to what I face with my podcast. :-( If someone from IA can get

Based on yesterday's videoconference, looks like we like the idea of raising money for kids somehow, kids and media. It isn't that we podcasters don't like the idea of doing something for charity. It's just that there are technical issues which, like it or not, simply cannot be avoided. And since we're talking about using video, this brings about more issues. I never said on the podcasters group that a Podcast-A-Thon wouldn't work (though admittedly I did use those words, which was a poor judgement on my part). What i was aiming at was the fact that it would have to be done differently than the original poster had thought. I basically said that about the only way it would work was if there was a centralized place with a lot of bandwidth for one to upload their podcasts (a.k.a KYOURadio.com, which would be prime for something like this assuming Viacom would be interested in pitching in) and for people to subscribe to the feed and download podcasts. OTFS, unlike us podcasters, there is no place like KYOURadio.com type of website for us video bloggers to utilize (I don't count the IA because it would be useless in a time sensitive environment/situation). This needs to change. Jay, any chance that MNN might somehow step up to the plate to fill this void? Steve G. or Ryanne, what about Boston area CA TV? Would they be interested in stepping up? I wished I could've jumped in on yesterday's video conference (even if all I can do right now is audio only till I get a better, more updated cam), but alas, I digress... [videoblogging] Podcast/Video Blog Compatibility Issues
Hi everyone: This is probably much along the same lines as Josh Kinberg's post in the podcasters Yahoo! Group, but what I'm thinking what's needed next is a podcatcher that's like FireANT interface-wise, but can play podcasts AS WELL AS video blogs. Not sure if the FireANT devs have thought of this (please feel free to clarify guys :) ), but I'm thinking that, when it comes to aggregators and associated software, the podcasting movement and the video blogging movement will eventually have to, at least to some extent, merge into one. There's little to no question at all that the two movements basically have the same goal. That is to BECOME the media. But one of the areas where podcasters and video bloggers part ways is in the area of software development. This needs to change IMO. I suppose what I'm really getting at is that what's needed is to *standardize* the development of software. Unless there's some developing going on behind the scenes, I doubt iPodder will have an embedded player until iPodder 3 is released. So I'm thinking it's more likely that FireANT will probably be equipped with full support to play back podcasts before iPodder 3 comes out (Please feel free to correct me on this Josh, Eric, Steve or whoever :) ). I say this because all FireANT really needs is an option to download podcasts in a seperate directory than it does videos AND an automagic feed checking feature which will, if allowed by the user, download podcasts AS WELL AS video blogs into said directories like iPodder does (It probably already has this for video blogs, though since I don't really watch video blogs as regularly as much as I listen to podcasts, I really can't say for sure either way) and it's good to go as THE ULTIMATE podcatcher/video blog aggregator. This discussion is also taking place on the podcasters group as well, but I figured I'd post over here so people here can add their $.02 worth as well. :) Just a few thoughts :) Pat Cook Denver, Colorado AS PAT'S WORLD TURNS - http://aspatsworldturns.blogspot.com/ PAT'S REAL DEAL BLOG - http://patsrealdeal.blogspot.com/ PAT'S PODCAST - http://patspodcast.blogspot.com/ PAT'S VIDEO BLOG - http://patsvideoblog.blogspot.com/ DUMBASS IDIOTS VIDEO BLOG - http://dumbassidiots.blogspot.com/ AGAINST THE STORM (Online Soap Opera) - http://againstthestorm.blogspot.com/ RSS Feeds Available On Each Page YAHOO!
