As an aside, even for public safety users, a PtP link under the 4.9 GHz
rules is only temporary and/or secondary to any multipoint use.

Is the 4.9 link a dedicated BH from one of the towers terminating at the City 
agency? If so then it's legit.

If it's a link from one tower to another that feeds a switch which feeds the 
City Agency AND any other commercial traffic then it's not legit.

Only state, county and municipal entities can be a 4.9 GHz license holder.
Non-governmental public safety organizations can use the spectrum under
the umbrella of a license holder.  For example a private ambulance service
can request the use of 4.9 GHz from a county sheriff's department who is a
license holder. 

There is NO provision for the use of 4.9 GHz outside of public safety.  A
private, non public safety company cannot use the spectrum in any way even
if they are providing service to a government public safety agency.

I realize they can't - but the public safety group thinks that they
are.

The public safety group is only a user - they gave them tower
space in exchange for a couple of PTP links on 4.9, but the
public safety group is concerned.

I really guess I did not make myself clear enough.

I - and the people asking - totally understand that they cannot use the
4.9 for anything other than public safety.

They were given the equipment for some PTP links
in exchange for providing the company free space on their
towers.  The company provided the equipment, set it up, and
is maintaining it.

The concern is - how does this technically unknowledgable
public safety group ensure that only their traffic is going out over
the 4.9 system.

As Jerry suggests - investigate!

Who is the system licensee? It should be a public safety agency or 
critical infrastructure provider. Ask their techs about the link. Follow 
up (if needed) with a very polite letter to the Chief of the agency 
requesting information and advising him of the legal uses of the link. 
Do your own research first so you can provide the Chief with accurate 
information and education.

I have no idea what the equipment is that they are using but it may be
possible to turn off the equipment at the end points and then maybe, if
the equipment on the tower by chance has an activity light, to see if it's
passing traffic.  But it's all ify.  

Is this company also providing the broadband access or are they using from
one of the customers end points?  If from the customer site, just turn off
the remote sites and see if the gateway is passing traffic maybe.  It's all
a maybe.

I really guess I did not make myself clear enough.

 I - and the people asking - totally understand that they cannot use the
 4.9 for anything other than public safety.

 They were given the equipment for some PTP links
 in exchange for providing the company free space on their
 towers.  The company provided the equipment, set it up, and
 is maintaining it.

 The concern is - how does this technically unknowledgable
 public safety group ensure that only their traffic is going out over
 the 4.9 system.

 Only state, county and municipal entities can be a 4.9 GHz license 
 holder.
 Non-governmental public safety organizations can use the spectrum under
 the umbrella of a license holder.  For example a private ambulance 
 service
 can request the use of 4.9 GHz from a county sheriff's department who is 
 a
 license holder.

 There is NO provision for the use of 4.9 GHz outside of public safety.  A
 private, non public safety company cannot use the spectrum in any way 
 even
 if they are providing service to a government public safety agency.
