Hello Rajender Sir, I totally agree with the observations made by you .Yes you are right in suggesting that we must stress on the implementation of the laws .But the point which I want to make is that at this point of time there is serious lack of adequate legal provisions which give protection to the disabled persons in specific circumstances .The fact of the matter is that the ill treatment given to the disabled persons is not still recognized as an infringement of his right to live a dignified life .In my view if we have expressed provisions at least we would have a proper mechanisms established wherein the harassment of the disabled in public places accessing public amenities could be dealt with .To make my point more clear before the enactment of the domestic violence Act though there existed remedies to deal with it in other laws too but they proved inadequate to give protection to the women and the need was felt to codify the law to establish proper mechanism to deal with it.Moreso the incidents of domestic violence received recognition of being something illegal in the common parlance only after the enactment of the aforesaid law. Even in case of offences like sati people developed the consciousness that they were doing something illegal and immoral only after it was declared an offence by law The fact that there are huge number of cases of harassment with the disabled people despite the remedy available under the ordinary laws spell out the need for a separate law with a proper mechanisms...Enactment of a separate law will in no circumstance will deprive us of the remedies existing in the ordinary law but would only strengthen the protection available therein because than only the people in general and the legal community in particular including the judges ,the lawyers and the Human Right activist would give the desired attention it deserve .I however do not agree with you that a separate law would isolate us from the mainstream .Yes you are correct that we cannot include all the circumstances but every codified law suffers from this lacuna .more so this plea should not be taken to suggest that codification of the law should not be done .At least some form of defined law is needed. Your suggestion regarding the remedy available in the consumer court is a good one, I also agree with the remarks made by you with regards to the CCPD.And yes you need not feel sorry for expressing your views .We are only having a healthy discussion on the issue .Thanks . Hi Akilesh ,I really don't think that the sections you mentioned would apply in these cases .However the point which I wanted to raise was that there is no specific law which would declare these acts as offences .You may be aware that the Parliament has enacted a statute for SC/ST namely the Protection of Civil Rights etc I don't remember the exact name .This was done to make the provision under Article 17 more effective which deals with untouchability .I am of the view that if we are provided protection under the Constitution than it would make such acts of harassments an act infringing the fundamental right .Apart from this I had argued that a separate law should be enacted where there would be specific provisions defining the offence ,providing penalty ,making provisions for protection offecers to deal with such issues etc as has been done in the above mentioned Act. Hello friends , In view of the responses of the members on the issue I would like to say that Constitutional protection to the disabled is inevitable .The Constitution is the basic law of the land ,I am surprised that the founding fathers of the nation made every effort to make the best and the most detailed Constitution in the world ;it gave protection to SC/St ,Women,OBcs but forgot to mention disability as a ground while drafting important Articles like Article 15,16 etc. .True the protection of Article 21 is available to the disabled people but in very few cases the court has invoked this Article in matters affecting the disable community .coming to this particular issue of harassment I strongly feel that there is little sensitization among the people regarding ill treatment given to the disabled people .Sorry if it offends anyone but most of you would agree that people in general do not consider the ill treatment given to any disabled person as something against law ,something illegal or as an act invoking criminality .Even the disabled person in general accepts the behavior and does not complaint .It is well known fact that people would treat you as you would allow them to treat you.Akilesh I really do not remember what provisions in IPC you are mentioning ,even than I strongly advocate constitutional protection and a separate law too like the protection of civil right in case of SC and ST .Legal experts would recognize the need and the urgency of such a Constitutional protection .Dinesh you are right to point out that we are a minority and politicians do not take us seriously but somewhere we as community has failed to make our voices felt .There is a strong need for a pressure group to lobby for the issues affecting the disabled .We should work for political empowerment of the disable community if we want any significant change in our state of affairs .There is also a need for political representation of the disabled people ,we should demand reservation in the Parliament and the state legislatures .One member has suggested some modalities for organizing the disabled people on the matter of demanding Constitutional protection they are good and worth considering .However we need continued and planned strategies for the struggle Thanks.. Hello , In view of the recent harassment cases by the airlines with the disabled people, I would suggest that it is high time that we demand Constitutional amendment for protection under Article 15. Such instances must be declared an offence and must be penalized .We must strive for a statutory protection somewhat on the same lines as provided to SC/ST. Such acts are violation of the civil rights and civic liberty of the disable people and should be considered an infringement of the right to live with dignity under Article 21 of the Constitution, If the right to travel abroad can come within the purview of the right to life than such acts also amount to violation of the Human Rights of the disabled people. There must be protection officers with power to take action on complaint and the power to take action suo moto .Not to say that such legal provisions would cure the problem but it will certainly create awareness and may also act as deterrent .This will make such instances an issue of Human Right violation and sensitize the people. with referance to the above mentioned issue raised by shrinivas sir .hello Sir ,I am glad that you raised this issue .constitutional protection is important for the disabled community ,however it is more important to improve the grievances redressal mechanism for any legal protection to be effective .the Judges and the legal community needs to be made more sensitive to the disability issues and the disability laws ,the public in general and the disabled in particular needs to be made more aware about their rights .So far your suggestion for reservation for the disabled in the parliament is concerned I feel that reservation for the marginalized section in legislature has been instrumental in promoting empowerment of that community and ensure their participation in democratic proces.Further it shall provide us an effective means to voice our concern on the issues affecting us .The politician’s and the public servants are apathetic to the disability issues as we are the microscopic minority and do not account for the vote bank ,further we are not a strong and organized political group .We lack any strong political leadership or any political organization to lobby for the important issues ..political representation and active participation in politics will surely improve the condision.As far your third issue of non-implementation of the reservation for the VI in the jobs is concerned it Is ironical to note that despite so many years of a statutory provision for the same the policy of reservation has remained on paper in many states and even at the union level as there is huge backlog of jobs and still more backlog are created every year .A few NGOs like the NFB has done some work in this direction at the union level but no worthy efforts at the state level exists .the reason for this is that the NGOs are weak in the states .We as a community only fight for small concessions and benefits and when it comes for the issues like employment the fight is mostly by the individual who gets affected .If this is the reality than it is suggested that lets do whatever we can do in our individual capacity say for instance the experts on the group can use the internet to raise the issues ,the lawyers and the NGOs can file cases for filling up the backlog and contempt cases if the backlog is not filled .I know of one judgment of Allahabad high court where the court stayed further appointment till the vacancies for disabled are filled up efforts for taking such judgments should be made the .It is high time that we as a community work for our legal and constitutional rights if we cannot do this for ourselves no one else would .thanks. Hello members ,the question should we state the fact of our disability is not only a value judgment question ,we need to analyze it in the real world situation .So far my opinion is concerned I prefer to state the truth though I take pride in being a differently abled person I still accept my limitation with grace .It is my humble submission that we must present our so called disability not as our inability but our ability to do things differently So we can reveal the fact in such a way that the so called disability is presented as one of our quality to do things differently ,if we choose to reveal the truth than we must take care to specify our abilities to do things differently .Now let’s consider the fact of life .I always aspired to be a civil servant so it was always required to mention about my disability my experience with where ever I applied is mostly negative .I had to fight by way of legal proceedings in case of MPPSC ,and UPSC for my rights as a citizen of this country .More so MPPSC disqualified me on the very ground of being a VI and.stated the ground as a cause of my disqualification in my mains mark sheet and did not allow me to even participate in the interview .In one other PSU firm in the interview I realized that the employers were determined not to take VI under any condition ..In one of the private college where I applied I was not called even for the interview despite having a very good academic record and being a NET and JRF qualified .I think our country has not reached to a level of sensitivity where the employers are not prejudiced against disabled persons .As a community we must analyze as to how many of the potential employers will even call us to the interview despite knowing about our disability. I hope that the members will analyze the issue based more on the facts and the reality .further we as a community must find ways to sensitize the potential employers about our abilities ,we can prepare videos showing some VI performing some jobs considered normally out of the reach of a blind person and upload them or create a repository which would help us in three ways ,1 it will help to sensitize others ,2 it would help other VI in learning techniques on how to perform a particular task and would assist the teachers in developing skills in his blind pupil. . hi friends, I happen to read the new PWD ACT for the first time, I think that the chapter on employment particularly in relation to reservation needs to be more stronger .There should be some provisions to ensure that the establishments do comply with the provisions for instance the disability court must have the power to stay the appointment where the scheme of reservation have not been followed .IT should also have the power to stay any further appointment in case there is a huge backlog. There should be an equal opportunity commission to monitor reservation for every recruitment exam in the government. There should be a procedure to complain to this commission if the scheme of reservation has been not complied with and the commission should proceed to prevent any noncompliance .The establishments could also be asked to get prior approval from the commission before conducting any recruitment exam. There should be strong provision for transparency and the candidates must have the right to ask for the cutoff marks, their own marks, and the reasons for nonslection in case there is prima facie noncompliance with the scheme of reservation There could be some sort of penalty for noncompliance. The article 16 of the constitution also needs to be amended to include the ground of disability the definition of establishment must include within it the legislature and the judiciary so that there is reservation for the PWD in the legislature and the judiciary. There must be some provision relating to a National commission for the PWD like in the case of ST,SC. Further it is my concern that these courts must not be another stage in the heirchy of the courts thus in some cases their decision must be final and appeals must be allowed on strong grounds .We need to make the courts really powerful and effective if at all the ACT is to do any good to us .Help me to take issues to the concerned persons.
