It is called escaping the single quotes, and it is one of the features that makes
working with dbs so easy in CF.
But sometimes you don't want it to.
replace your #where# with #preserveSingleQuotes(where)#

I have a variable I build before
the most obvious answer is to not write anything to the db until they have
confirmed all is correct. Just pass the form fields through to the next
page...
