Everyone,

I've gone through the U.S. Code material as published by congress, and
it seems to me that most video game companies are well within their
right to ask for a waiver.  Here's a paste of the most relevant
section:

‘‘(h) COMMISSION FLEXIBILITY.—
‘‘(1) WAIVER.—The Commission shall have the authority,
on its own motion or in response to a petition by a manufacturer
or provider of advanced communications services or any
interested party, to waive the requirements of this section
for any feature or function of equipment used to provide or
access advanced communications services, or for any class of
such equipment, for any provider of advanced communications
services, or for any class of such services, that—
‘‘(A) is capable of accessing an advanced communica-
tions service; and
‘‘(B) is designed for multiple purposes, but is designed
primarily for purposes other than using advanced commu-
nications services.
‘‘(2) SMALL ENTITY EXEMPTION.—The Commission may
exempt small entities from the requirements of this section.

Basically, the FCC is allowed to give waivers to when the advanced
communications services are not the main product.  Keep in mind that
advanced communications services is pretty narrow, and basically
boils down to real-time chat in various forms.

Graphics and cool looking visual effects are what most modern games
are about; the ones that do have chat, usually only have it as an
incidental feature to the actual game play.  In short, you can play
the game without chat, but you can't really chat without playing the
game.

To give three quick examples:

- Facebook has games and advanced communications services.  However,
the main point of Facebook is the communications services, not the
games.  Facebook should not get a waiver.

- World of warcraft is a game and has built in advanced communications
services.  However, the main point of WoW is the real time graphical
aspect of the game, not the chat service.  The WoW publisher and
server maintainers should probably get waivers.

- Skyrim is a graphical game with a lot of quests and quest text.  It
is single player and has no advanced communications services even
though it does make heavy use of text.  Because of this, the game
isn't covered by the law, and doesn't need to request a waiver or add
accessibility features (rather, it doesn't have to add accessibility
features as a result of this set of laws.)

In addition, congress added a guideline that makes a lot of sense:

‘‘(j) RULE OF CONSTRUCTION.—This section shall not be con-
strued to require a manufacturer of equipment used for advanced
communications or a provider of advanced communications services
to make every feature and function of every device or service acces-
sible for every disability.

This basically says that not every feature must be accessible, which
is particularly relevant to games like Alter Aeon, which have both a
graphical interface and pure text-based interfaces for the visually
impaired.

I definitely agree with the AFB that the FCC should take a very close
   look at this; but it's pretty obvious to me that it makes sense for a
lot of game companies to get waivers for their products.

Keep in mind that congress simply provides guidance for the FCC; the
FCC makes its own rules, as long as it doesn't conflict with what
congress mandates.  The proper place to make your voice heard would be
to send your concerns to the FCC when the FCC is requesting public
comment on its proposed rules.

Actually, Go is Chinese. Shogi is a Japanese game which is fairly
similar to Go. As far as I know, neither one has an accessible
counterpart, which kind of sucks. Still, I could be wrong.

one of my favorite board games growing up was Flip Flop Go. It sounds
familiar to these other games but you kept score of each piece you 
turned


over. You had to put your piece where one of your pieces was on the 
other


end and flip all those between. then you got a point for each one you
flipped. But you also have two that said stop on them which meant your
oppponent could not flip any in the row with that chip on it. The board
had a counter for each of the two players to keep score.

The answer is no.

There is an othello, aka reversee game which has similar rules in quentin 
C playroom, seee http://audiogames.net/db.php?id=Quentin+C+playroom and 
also a stand alone game produced by someone called moral mike,  though 
unfortunately the audiogames.net db entry for that one got deleted through 
a site error, though you can find the developers' own site on 
http://members.multimania.co.uk/moralmike/downloadothello.htm


I know othello is sort of to go what draughts is to chess, but that is all 
there is in that line thus far, though as accessible othello games are 
obviously doable, presumably if a developer was familiar enough with the 
rules of Go he/she could write an accessible version without too much 
trouble, though just as with the recent discussion about mahjong, I'm not 
sure if any of our devs know enough about the game unfortunately.

I've noticed that on old games you could using timing more. I mean like you 
could count so many times and you, for the most part, would know by playing 
it, what to do after a certain amount of blocking moves for example. Like in 
punch out for the nentendo.

the thing that i have notice is today games are not as easy for a blind 
person to play. yesterday games are easy for a blind person to play.  let 
me explain this.  for an exsample in the mortal kombat games for you have

stuff.  in the wrestling games you have to go throuugh the story season 
mode to earn money to unlock different stuff. with the mortal kombat games 
from the past the only thing to do to unlock different stuff is to do 
button codes.  and with the wrestling games you didn't have to go through 
a story mode you just went through a tournament mode.  in the today 
wrestling games you got to readd some messages to select things and if i 
can't read it then it does me no good.  that is why i will be playing old 
fighting games because the sound efects that a blind person can tell 
somewhat his character and the computer is doing.
the football games are the same way to.  i will play audio games more then 
i will play my old games that i have on my computer on my super nes 
emulater.  since people on this list have told me that they will help me 
with the menus on the games i need help with i will be looking for help 
soon.

Hi Folks,
I was cureious about this Eternal Darkness game and did a google on it.
Here is a review:
There have been quite a few attempts at video games based upon 
Lovecraft's Cthulhu mythos, but they never seem to make it to the market. 
Although Eternal Darkness is set within its own little universe, it 
borrows heavily from the mythos, and Lovecraft's influence is readily 
apparent.
The game begins when your character, Alexandra Roivas, decides to 
investigate the mysterious circumstances surrounding her grandfather's 
death at their ancestral mansion. Through an absolutely brilliant plot 
device, the player is able to take control of many of Alex's ancestors 
from ages past and several other characters from all over the world. Each 
of these chapters help the player piece together the mystery and reveal 
the hidden agenda of a group of extremely powerful and malevolent 
entities.


Gameplay is very smooth. Holding down one controller button allows you to 
lock on an enemy target, and with a flick of the control stick you can 
aim at specific body parts. Some baddies fall when they are decapitated, 
some you have to take apart limb by limb before they will fall. As with 
most third person games, camera angles are fixed and sometimes 
problematic, as you may find yourself being disembowled by some horror 
just off screen.


Combat is relatively well balanced, and the puzzles in the game find a 
way to be interesting without being terribly difficult. the graphics are 
quite good, many monsters can be on the screen without any noticeable 
slowdown. The monsters themselves are quite detailed and look great, but 
they don't vary a whole lot towards the earlier part of the game.


The magic system is very cool. You must find runes of power hidden 
throughout the game (often inside of monsters). Each rune corresponds to 
an alignment, an effect, and a target. By mixing and matching the runes, 
you can create many different spells. There's also a large variety of 
mundane weaponry to collect and to toss a beating with.


Each of the characters you control seem to have their own strengths and 
weaknesses. Some are excellent melee fighters, some excel at throwing 
spells. Some have a ton of health, while others are quite fragile.


By far the coolest aspect of the game (and the part that perhaps owes 
more than a little to Chaosim's Call of Cthulhu roleplaying game) is the 
sanity system. Everytime you undergo something hideously supernatural, 
you lose a little bit of your mind as you struggle to grasp the 
situation. This manifests as hallucinations, both visual and audial. You 
may get an unexpected phone call, or have a horrible vision of your own 
demise. This effect is truly very creepy. I've already had statues come 
to life and watch me cross an empty hallway. I've seen walls bleed, and 
bugs crawl across my television screen. There are several ways to regain 
your sanity, but sometimes it's just fun letting it fall a little bit to 
see how creepy things can really get.


the sanity meter makes the game. when you face certain zombies they lower 
your sanity level; you can regain some of it back by killing them- but 
not all. once you're near the end of your sanity blood will start 
dripping on the floor, the camera angle will be tilted and the background 
effects become more spooky.


Resident Evil may have been an inspiration for Eternal Darkness, but it 
is a poor comparison. This game is truly a wonder to experience, and 
definitely a killer title for the GC. It's worth every penny.

game developer to create a line of horror games along the same lines as

[Audyssey] help with chillingham organ

Hi,
I need some help with the organ in chillingham if
anyone can help. I scared the organ lady away and got
the broken key and the book to repair it. So I put the
key back, but I don't know what to do next with it. I
see that I can play it, but I'm assuming that there's
a certain pattern that I'll have to play, but I don't
know what that is. 
Also, is there a walk through for this game?

I just finished this game. I loved it. A lot of
background sounds and plenty of people to talk to. My
only complaint, well there's two. The first is that
it's too short for my liking. The second is that it's
a cliffhanger, and I have no earthly idea when volume
two is coming out. grin
I have a question for you though.
Where'd you buy private detective school. I e-mailed
code factory, and they sent me a phone number. But I
can't call over seas. Do you know where I can buy it
in the U.S.?

[Audyssey] problem with bavisoft

Hi,
My father purchased 2 games from bavisoft. They took
his money, and he has yet to receive either game. He
ordered it about a month ago. He e-mailed them and
they haven't responded. He also called the number on
the website and it's a wrong number. The person who
answered was rather rude. I guess they get calls a
lot. g
Anyway, I was wondering if anyone else has had
ordering problems, or knows of a way to contact their
sales department?

 communications styles.  By excel-based, I mean the

Well you're not supposed to fight him. If you do, and
won't get a second chance if you have to flee. You
should answer the question he poses. And if you chose
not to answer, you should get another chance when you
go back to him.

hi,
you should equip your weapon first. you can have a
weapon and a shield, unlessyour weapon requires two
hands.
If youclick on the specific weapon in your inventory,
or the question mark link abave a weapon in a shop for
sale, it'll state that you need two hands if that's
the case.

[Audyssey] accessible final fantasy games

I friend of mine was telling me about a hand held
fishing rod that he used to have that would actually
feel like you were fishing and would tell you what
you've caught and so on. I was wondering if anyone
knew if this product was still being sold, and if so,
where might I purchase it?

 shoot. I often wonderd how
 fast that game could get, or if it had an ending,
 since I think the
 furtherest I got was I think level 16.

[Audyssey] Monty's revenge

I just played the bayta, and I love it. I can't wait
for the full release. There is one thing that's
bothering me though, when the enemies sound like they
are still ahead of you, and then all of a sudden, they
are attacking you. I'm on the easy level, so I don't
think it's just my reaction time. 
I don't know if othrs have mentioned this. But I love
this game so far.

 but I think we all 
 should be involved in this idea. A while back us
 developers created a 
 list for ourselves called the agdev list. However,
 in it's own way is a 
 closed list just to developers.
 I'm wondering if all of us would like creating a
 newby programming list 
 on audyssey for all those who are interested in
 wanting to learn how to 
 program accessible games. It could even become a
 part of the audyssey 
 site as a resource center for college students,
 interested blind gamers, 
 etc...
 I know Richard has been putting together some stuff
 similar, and perhaps 
 we can hammer out some ideas what to do about this?
 I  feel the current programming thread is a bit off
 topic for this list 
 as we really only talk about existing games, but we
 may want to branch 
 off to a new list so all can freely talk about the
 specifics of game 
 programming.
