The media no longer seems so interested in ID cards and the National Identity Register, as it is widely accepted that a majority of the public now oppose them. But many may be surprised to hear that, despite public opposition and the current economic climate, Labour still wishes to proceed with the scheme.  


Within the last two weeks, a number of statutory instruments relating to ID cards have been passed (or perhaps rubber stamped by order of the executive) through Parliament, much to the regret of the Lords. 


The ID cards scheme has been slowly but surely expanding, more recently relying upon a lack of media coverage and the misconception that it has been scrapped. On 25th November last year, the first compulsory ID cards were issued to foreign nationals. Since then, the Home Office has been trying to set up further compulsory trials; though whilst the scheme has been growing, it has suffered a number of setbacks, such as protests from airport workers and their unions opposing trials at Manchester and London City airports, and the Governments problems in finding contractors to produce the technology. 


These setbacks have forced the Government to rethink its strategy and push back its plans to later dates. This month the Home Office announced the ID cards scheme would no longer be compulsory. It has also decided to delay ordering the necessary equipment for producing the cards until after the next general election, although this is perhaps because the government isnt able to find many companies willing to take on a scheme that may very well be scrapped within a year.

The logic of providing assistance to developing countries is to help them
adopt expansionary policies in a time of economic downturn. Yet the IMF is
forcing countries in financial distress to pursue contractionary policies -
the mirror image of the stimulative policies carried out by the rich
countries (and supported by the IMF, for the rich countries).
The Fund's loans since September 2008 to countries rocked by the financial
crisis almost uniformly require budget cuts, wage freezes and interest rate
hikes. The first nine 'IMF loans to countries affected by the crisis clearly
demonstrate that the IMF is still prescribing pro-cyclical policies of
fiscal and monetary policy tightening,' says Bhumika Muchhala of the Penang,
Malaysia-based Third World Network. 'The Fund's crisis loans still contain
the old policy conditions of cutting public sector expenditures, reducing
fiscal deficits and increasing interest rates - which is the stark opposite
of the expansionary, stimulus policies being supported in the G20
countries.'

 NEW DELHI – Veteran Indian classical singer Gangubai Hangal, who battled
caste and gender prejudices to establish a career that spanned more than
seven decades, died Tuesday after being briefly hospitalized for respiratory
problems. She was 96.
Hangal was put on a life-support system Monday night after her condition
turned critical, her doctor, Asho Kalamadani, told Press Trust of
India newsagency. Her grandson Manoj Hangal was quoted saying she died
early Tuesday.
With her powerful, deep voice, Hangal was often described as more gifted
than most male singers of her time, and people had trouble matching her
strong vocals with her small frame.
She was one of the most well-known singers of Khayal, a style that belonged
to the Hindustani, or north Indian, school of classical singing.
She was born on March 5, 1913, in the southern state of Karnataka and
trained under Sawai Gandharva, a respected guru.
She remembered how upper caste people used to come to her concerts when she
was invited to peform and after wards when food was served she has to sit
seperately.  She had a strong voice which  make people assume sometimes her
as a man,there she makes an impact on feminine singing standards, where
shrill   and effiminate voice is the only consideration for female singers.
Born into a family of boatmen, considered low caste in Hinduism's complex
caste structure, Hangal battled that prejudice as well as the notion that
singing wasn't an appropriate profession for a woman of her generation.
She died in Hubli, a city in Karnataka state, where she lived, PTI reported.
She is survived by two sons.

Mumbai Bollywood actor Shiney Ahuja’s lawyer on Tuesday gave a new
angle to the case, claiming that the victim of the alleged rape
belongs to a lower caste, which is aggressive” in nature. During a
hearing on the actor’s bail plea filed before a sessions court, lawyer
Shrikant Shivde contented that Shiney hails from a “respectable”
family and was wrongly implicated in the case.

Elaborating his version of “consensual sex”, Shivde argued that if
Ahuja had tried to rape the victim, she could have “definitely”
resisted. “She belongs to a lower caste, which is aggressive by
nature, and she wouldn’t have submitted herself so easily. They are
known for being aggressive,” Shivde said.

Shivde also contented that the victim had concocted the story of
alleged rape and it is highly doubtful. “Rape cases can be easily
concocted. It’s hard to prove them and even harder to defend. Prima
facie, the case has become a little doubtful. Why didn’t the victim
try to run from the crime site, if she had not relented to his sexual
advances,” Shivde asked.

However, Shivde agreed to have seen the medical report that says
traces of semen were found in the vaginal smears collected by the
doctors. “Some of the tests have proved that sexual intercourse had
occurred. So we are not refuting that part. We are just contending on
the allegation that the victim was raped,” said Shivde.

The prosecution, however, opposed the actor’s bail plea stating that
the medical and forensic reports supported the charges against the
actor. “Medical report is strong enough to nail the accused. Though
the victim had no external injury, the medical report supports our
case that sex was forceful,” said special Public Prosecutor R V Kini.

Ahuja’s lawyer said that the actor was ready to stay away from Mumbai
till chargesheet is filed. “If the court feels that my client would
try to tamper with the evidence and influence the victim, he wouldn’t
mind staying away from Mumbai and Raigad where the victim hails from,”
Shivde told the court.

Shivde was replying to the prosecution’s argument that Ahuja would try
to intimidate the victim and witnesses as he hails from an influential
family.

 Dear Dr. Manmohan Singh ji,

 I write to draw your attention to a report in The Indian Express today
 which gives details of the charge sheet filed by the CBI last week in a
 Kochi court, in the murder case of a nun, Sister Abhaya. I was shocked
 and outraged reading the report and I am sure that anyone who read it
 would have the same reaction. The language used in the charge sheet
 against an accused, Sister Sephy is obscene, vulgar, unscientific. It is
 an affront to the dignity of women, it is insulting to the woman
 concerned and also reflects a perverted mentality. The language used in
 the charge sheet against a female accused invites criminal action
 against the officials concerned under laws pertaining to protection of a
 woman’s dignity, against harassment as also against obscenity.

 Unfortunately in many cases concerning women, including victims of rape,
 the language used by investigative agencies is often highly offensive.
 In this case it is the accused who is the victim of the CBI’s
 objectionable language. I support all efforts to bring the guilty
 persons to book and bring justice to the murdered nun. While holding no
 quarter for the accused I request you to send a strong message to all
 investigative agencies that minimum standards of respect to the dignity
 of women will be protected. If the premier investigative agency of the
 country can use such objectionable language, what can women expect from
 local investigation officers.

 I request you to enquire into the matter and if the report of the charge
 sheet is correct, to ensure disciplinary action and prosecution under
 the relevant section of the laws against the officers concerned.

 I enclose the details of the charge sheet from press reports.

This is not limited to the case. Please see the critique raised by
Brinda separately. It is about the obscene language used by the
investigating agency and does not take a stand on the merit of that
particular case. By any means, this is objectionable. I hope, you have read
the NIE news to see the wordings used in the charge sheet.

Examination (by doctors) revealed that her pendulous breasts were suggestive
of vigorous fondling during sexual intercourse...

How could this be called scientific and decent? You don't have to commit a
crime against womanhood, just to prove that Sr. Sephy is guilty. Do it with
logic.

Kenney,

The left leaders, especially the CPI(M) leaders where supportive and active
behind Abhaya's father. Action council patron was late PC Cherian Madukkani,
ex-municipal chairman of KTM municipality. VN Vasavan MLA was always with
Sr. Abhaya's father. Brinda herself had intervened in this case in support
of Abhaya's cause.

This is but a totally different thing. Don't mix the case and the language
of the investigating agency. Keep them separate and think.

 Born into a family of boatmen, considered low caste in Hinduism's complex
 caste structure, Hangal battled that prejudice as well as the notion that
 singing wasn't an appropriate profession for a woman of her generation.
 She died in Hubli, a city in Karnataka state, where she lived, PTI
 reported.
 She is survived by two sons.

Rape As An Instrument Of Politics

UP Congress is on a high these days. After Congress Chief Rita
Bahuguna’s infamous words on rape, the debate started that chief
minister Mayawati said the same things to the then chief minister Mr
Mulayam Singh Yadav after she visited the Maderasa in Allahabad where
some Muslim women’s were raped. Why were the channels running it for
the whole day. Was it an effort to douse the flames created by the
brahmanical sophistry? Is it just a slip of tongue or the very
psychology of our political class which use victim as a tool to score
a political point?

Well, if you have seen some surveys on these channels, then a majority
of Indians have send roses to Rita Bahuguna. I think this is there way
of doing Gandhigiri on channels and feeling happy that ‘some one’ had
the guts to take their ‘cause’. Justifications are there that Ms
Bahuguna meant something else but if you see the whole social history
and later on the post independent India’s socio-political climate,
then one should not wonder that word rape has become a political
instrument and the person who is victimized is tortured more by our
actions and deeds.

And I call it mindset of a pervert society. A society which is full of
fear from openness and which shows its strength through masculinity.
Is not it strange that the victim of rape violence is asked to cover
her face and live in indignity and hide while the perpetrators roam
around with shouting slogans and taking shelter under various taboos.
And this is what I call brahmanical mind beautifully exposed by Dr
Mulk Raj Anand in his epic novel ‘Untouchable’, as how a priest of
temple try to allure a girl Gulabo who is a sweeper in the temple to
enter into the sanctum-sanctorum of the temple where she is normally
prohibited to enter and then try to molest her. As soon as the girl
retaliates and condemn him, the Brahmin priest shouts ‘polluted...
polluted... blaming the girl for polluting the temple by entering into
its sanctum-sanctorum.

The responses of both the UP government and the rival political party
are according to their power base. But the way the whole script is
being played showed that the even the women politicians play the
script largely written according to the code of Manu Dharm Shastra, a
code which degraded them and made them an object of ‘pleasure’.

No one knows the plight of those women who become victims and in whose
name these political dramas are enacted. The script changes and
politicians takes over and make it like a Bollywood scene where the
aim of the director is not to really show injustice but to give more
‘material’ to our bruised and unsatisfied male egos, something to
watch.

Our responses have been crude and humiliating and when this rhetoric
comes from women then it become more painful. So, it is a country
where the laws are made in such a way where the victim is more
victimized and those who do it walk with their head high.

Just as section 377 was set aside by Delhi High Court, many of the
activists, including those claiming to work for social justice, felt
that by allowing the homosexual to do things according to their
choices would amount to breaking of our social relations and that we
are a society based society and individuals do not matter.

Why individual should do not matter? How can a society be developed by
killing an individual. Dr Ambedkar said about Indian society: ‘The
Indian society does not consist of individuals. It consists of
innumerable collections of castes, which are exclusive in their life
and have no common experience to share and have no bond of sympathy.
Given this fact, it is not necessary to argue the point. The existence
of caste system is a standing denial of the existence of those ideals
of society and of democracy.”

Once we understand this feeling of Dr Baba Saheb Ambedkar, we can
easily analyse the root cause of our structural problems influenced by
the brahmanical social order where for different set of rules and
punishment meant for different communities. Therefore a rape committed
by a Brahmin would definitely not attract the same punishment as done
by some other community.

The atrocious laws and social taboos in our societies have turned
against individuals and those who challenge to live according to their
own life style face the brutality by the society. One should not
therefore be amused about our whole marriage system and how it is an
event to ‘celebrate’ and show your ‘strength’ and ‘power’ in the
village rather than being an entirely private event of a few. And
there are communities and traditions when you celebrate the first
night ‘victory’. Also, communities have their way defined how to find
the next morning whether the girl was a virgin or not.

It is therefore not ironical that during a mass marriage ceremony in
Madhya Pradesh that the doctors were called to testify the girls after
two of them developed

Statement on the NHRC report on the alleged encounter at Batla house

On 20th May, the Delhi High Court, acting on a petition filed by the
People’s union for democratic rights and Anhad, had asked the National
Human rights commission to conduct their own inqury into the alleged
Batla House encounter of September 2008 and give a report upon it.
This order of the High Court was made after the High Court was shown
reports of four independent organisations into the encounter,
including the report of PUDR, the Delhi union of journalists, the
Jamia Teachers Solidarity group, all of which seriously questioned the
version of the Delhi police regarding the encounter. These reports and
the petition filed by the PUDR had pointed out several specific
problems with the version of the Delhi police. In particular, the
following questions were raised about the version of the Delhi police.

  1. If these boys were killed in a genuine encounter, how did the
17-year-old boy Sajid have four bullet holes on the top of his head,
which could only happen if the boy was made to sit down and shot from
above.
  2. How is the skin peeled off from Atif’s back? This was clearly
visible in the photograph taken before his burial which is annexed to
the PUDR petition. Obviously Atif had been tortured before being
killed.
  3. How are the other blunt injuries on the bodies of the boys
explained by the police version of the encounter?
  4. If the police knew in advance (as they claimed) that these boys
in the flat were the terrorists involved in the Delhi and other bomb
blasts, why did Inspector Sharma go in without a bullet proof vest?
  5. How could 2 of the boys escape from the flat which had only one
exit (two doors next to each other) and from a building which had only
one exit?

It was expected that in these circumstances, the NHRC, would conduct
its own investigation into the matter. The report dated 20th July 2009
of the NHRC given to the High Court on 22nd July, however shows that
far from conducting any investigation into the matter, the NHRC has
merely relied upon the Police reports for their report. They have not
even examined or investigated the above questions which were squarely
raised in the PUDR petition on which the High Court order was issued
to the NHRC. They have not even examined Saif, the third boy picked up
by the police from the flat, nor even any of the witnesses of the
Batla house area who had deposed before the People’s Tribunal. They
have just swallowed the police version hook, line and sinker. And this
is despite the fact that there has been no independant police
investigation or even a Magisterial enquiry into the encounter as
mandated by the NHRC’s own guidelines.

It is extremely unfortunate that the premier Human Rights Body set up
to investigate Human Rights violations is becoming a rubber stamp for
the police. The same attitude of the NHRC was evident when the Supreme
Court asked the NHRC to investigate allegations of Rape and Murder
against the Salwa Judum. The NHRC send a team of essentially police
officers who spoke mainly to the local police and other officials and
gave a white washing report.

The time has come to seriously reexamine the manner of appointment of
members of the NHRC and its powers. The present system of appointment
by a committee of Prime Minister, Home Minister, Speaker and Leader of
Opposition etc. is not working satisfactorily. All of them seem to
want a toothless and tame body which will not question those in power.

Since the NHRC report does not address or answer the disquieting
questions raised by the several independent fact finding reports about
encounter, it is therefore essential that there be an investigation
into the encounter by an SIT appointed by the Delhi HIgh Court.

[GreenYouth] Concerned Citizens' Response on NHRC Report on Batla House Encounter

On 20th May, the Delhi High Court, acting on a petition filed by the
People’s union for democratic rights and Anhad, had asked the National
Human rights commission to conduct their own inqury into the alleged
Batla House encounter of September 2008 and give a report upon it.
This order of the High Court was made after the High Court was shown
reports of four independent organisations into the encounter,
including the report of PUDR, the Delhi union of journalists, the
Jamia Teachers Solidarity group, all of which seriously questioned the
version of the Delhi police regarding the encounter. These reports and
the petition filed by the PUDR had pointed out several specific
problems with the version of the Delhi police. In particular, the
following questions were raised about the version of the Delhi police.

  1. If these boys were killed in a genuine encounter, how did the
17-year-old boy Sajid have four bullet holes on the top of his head,
which could only happen if the boy was made to sit down and shot from
above.
  2. How is the skin peeled off from Atif’s back? This was clearly
visible in the photograph taken before his burial which is annexed to
the PUDR petition. Obviously Atif had been tortured before being
killed.
  3. How are the other blunt injuries on the bodies of the boys
explained by the police version of the encounter?
  4. If the police knew in advance (as they claimed) that these boys
in the flat were the terrorists involved in the Delhi and other bomb
blasts, why did Inspector Sharma go in without a bullet proof vest?
  5. How could 2 of the boys escape from the flat which had only one
exit (two doors next to each other) and from a building which had only
one exit?

It was expected that in these circumstances, the NHRC, would conduct
its own investigation into the matter. The report dated 20th July 2009
of the NHRC given to the High Court on 22nd July, however shows that
far from conducting any investigation into the matter, the NHRC has
merely relied upon the Police reports for their report. They have not
even examined or investigated the above questions which were squarely
raised in the PUDR petition on which the High Court order was issued
to the NHRC. They have not even examined Saif, the third boy picked up
by the police from the flat, nor even any of the witnesses of the
Batla house area who had deposed before the People’s Tribunal. They
have just swallowed the police version hook, line and sinker. And this
is despite the fact that there has been no independant police
investigation or even a Magisterial enquiry into the encounter as
mandated by the NHRC’s own guidelines.

It is extremely unfortunate that the premier Human Rights Body set up
to investigate Human Rights violations is becoming a rubber stamp for
the police. The same attitude of the NHRC was evident when the Supreme
Court asked the NHRC to investigate allegations of Rape and Murder
against the Salwa Judum. The NHRC send a team of essentially police
officers who spoke mainly to the local police and other officials and
gave a white washing report.

The time has come to seriously reexamine the manner of appointment of
members of the NHRC and its powers. The present system of appointment
by a committee of Prime Minister, Home Minister, Speaker and Leader of
Opposition etc. is not working satisfactorily. All of them seem to
want a toothless and tame body which will not question those in power.

Since the NHRC report does not address or answer the disquieting
questions raised by the several independent fact finding reports about
encounter, it is therefore essential that there be an investigation
into the encounter by an SIT appointed by the Delhi HIgh Court.

Bollywood actor Shiney Ahuja’s lawyer on Tuesday gave a new angle to the
case, claiming that the victim of the alleged rape belongs to a lower caste,
which is “aggressive” in nature. During a hearing on the actor’s bail plea
filed before a sessions court, lawyer Shrikant Shivde contented that Shiney
hails from a “respectable” family and was wrongly implicated in the
case. Elaborating
his version of “consensual sex”, Shivde argued that if Ahuja had tried to
rape the victim, she could have “definitely” resisted. “She belongs to a
lower caste, which is aggressive by nature, and she wouldn’t have submitted
herself so easily. They are known for being aggressive,” Shivde said.

 Gates Jr. from being arrested for entering his own home.

 Note to all police officers in Cambridge, Massachusetts: if you

 breaking into a house that turns out to be his own home then please,
 please make sure it is not Henry Louis Gates Jr.

 To say the Cambridge force had egg on its face on Tuesday does a
 massive injustice to the scale of its embarrassment. One of its
 sergeants had arrested, handcuffed and locked in a cell for four
 hours, arguably the most highly respected scholar of African-American
 history in America.

 Prolific writer, TV presenter, director of Harvard’s WEB Du Bois
 Institute for African and African American Research, friend of Oprah
 Winfrey — the list of Mr. Gates’s connections and achievements goes
 on.

 But when Mr. Gates returned last Thursday to his leafy Harvard home
 from a trip to China filming his latest TV documentary, he was, well,
 just another African-American man seemingly engaged in nefarious
 activities.

 It was the early afternoon when Mr. Gates (58) reached his house in a
 taxi . The front door had been damaged and he could not get in, so he
 entered through the back door, disabled the alarm and then again tried
 to push open the front door with the help of the (North African)
 driver.

 A (white) woman walking by saw an African-American man trying to force
 the door and leapt to the kind of assumptions that Mr. Gates has
 chronicled over many years. She called 911, and then hapless Sgt.
 James Crowley turned up. By then Mr. Gates, settling back home, was
 calling Harvard’s property section to report the faulty door. Sgt.
 Crowley asked him to step outside as he was investigating a report of
 a break-in. “Why, because I’m a black man in America?” Mr. Gates
 asked, according to Sgt. Crowley’s police report, refusing to leave
 his front room.

 Asked to prove it was his own home, Mr. Gates showed his Harvard ID
 and local driving licence. In return, Mr. Gates asked Sgt. Crowley for
 his name and badge number.

 In his report, Sgt. Crowley said Mr. Gates accused him of being a
 racist police officer and told him he had no idea who he was messing
 with. The officer wrote that when asked Gates to step outside again,
 he was told: “Ya, I’ll speak with your mama outside.”

 “I was quite surprised and confused with the behaviour,” the sergeant
 said. He called officers from Cambridge and Harvard’s own police. Mr.
 Gates was arrested for “loud and tumultuous behaviour”.

 Later, Mr. Gates said he was “appalled that any American could be
 treated as capriciously by an individual police officer”. “There are
 one million black men in jail in this country and last Thursday I was
 one of them,” he told the Washington Post. “This is outrageous and
 that this is how poor black men across the country are treated
 everyday in the criminal justice system. It’s one thing to write about
 it, but altogether another to experience it.”

 As news spread of the arrest, friends and colleagues rallied to Mr.
 Gates’s side. He was offered the legal help of Charles Ogletree, a
 Harvard law professor and friend of Barack Obama.

 Lawrence Bobo, a Harvard sociologist, rushed to the station and drove
 him home after Mr. Gates was allowed out on $40 bail.

 Within hours of news breaking of the arrest, the Cambridge police had
 dropped all charges. The force said the “regrettable and unfortunate”
 incident should not be seen as demeaning the character and reputation
 of Mr. Gates or the character of the police. Mr. Gates is fond,
 though, of quoting an observation from Bert Williams, an early 20th
 century African-American entertainer: “It’s no disgrace to be

closing down. I really wonder why this is about South Africa.

And if you really think, a name (without any address) and the country
name would make it for a signature petition to CARE ABOUT KIDS IN
AFRICA (look at the rascist tone of it), let me tell you it doesn't
work like that.

 massive injustice to the scale of its embarrassment. One of

 sergeants had arrested, handcuffed and locked in a cell for

 hours, arguably the most highly respected scholar of
 African-American
 
 history in America.
 
 
 
 Prolific writer, TV presenter, director of Harvard’s WEB
 Du Bois
 
 Institute for African and African American Research, friend
 of Oprah
 
 Winfrey — the list of Mr. Gates’s connections and
 achievements goes
 
 on.
 
 
 
 But when Mr. Gates returned last Thursday to his leafy
 Harvard home
 
 from a trip to China filming his latest TV documentary, he
 was, well,
 
 just another African-American man seemingly engaged in
 nefarious
 
 activities.
 
 
 
 It was the early afternoon when Mr. Gates (58) reached his
 house in a
 
 taxi . The front door had been damaged and he could not get
 in, so he
 
 entered through the back door, disabled the alarm and then
 again tried
 
 to push open the front door with the help of the (North
 African)
 
 driver.
 
 
 
 A (white) woman walking by saw an African-American man
 trying to force
 
 the door and leapt to the kind of assumptions that Mr.
 Gates has
 
 chronicled over many years. She called 911, and then
 hapless Sgt.
 
 James Crowley turned up. By then Mr. Gates, settling back
 home, was
 
 calling Harvard’s property section to report the faulty
 door. Sgt.
 
 Crowley asked him to step outside as he was investigating a
 report of
 
 a break-in. “Why, because I’m a black man in
 America?” Mr. Gates
 
 asked, according to Sgt. Crowley’s police report,
 refusing to leave
 
 his front room.
 
 
 
 Asked to prove it was his own home, Mr. Gates showed his
 Harvard ID
 
 and local driving licence. In return, Mr. Gates asked Sgt.
 Crowley for
 
 his name and badge number.
 
 
 
 In his report, Sgt. Crowley said Mr. Gates accused him of
 being a
 
 racist police officer and told him he had no idea who he
 was messing
 
 with.. The officer wrote that when asked Gates to step
 outside again,
 
 he was told: “Ya, I’ll speak with your mama
 outside.”
 
 
 
 “I was quite surprised and confused with the
 behaviour,” the sergeant
 
 said. He called officers from Cambridge and Harvard’s own
 police. Mr.
 
 Gates was arrested for “loud and tumultuous
 behaviour”.
 
 
 
 Later, Mr. Gates said he was “appalled that any American
 could be
 
 treated as capriciously by an individual police officer”.
 “There are
 
 one million black men in jail in this country and last
 Thursday I was
 
 one of them,” he told the Washington Post. “This is
 outrageous and
 
 that this is how poor black men across the country are
 treated
 
 everyday in the criminal justice system. It’s one thing
 to write about
 
 it, but altogether another to experience it.”
 
 
 
 As news spread of the arrest, friends and colleagues
 rallied to Mr.
 
 Gates’s side. He was offered the legal help of Charles
 Ogletree, a
 
 Harvard law professor and friend of Barack Obama.
 
 
 
 Lawrence Bobo, a Harvard sociologist, rushed to the station
 and drove
 
 him home after Mr. Gates was allowed out on $40 bail.
 
 
 
 Within hours of news breaking of the arrest, the Cambridge
 police had
 
 dropped all charges. The force said the “regrettable and
 unfortunate”
 
 incident should not be seen as demeaning the character and
 reputation
 
 of Mr. Gates or the character of the
