i don't see you getting the car.  i'd contact ebay and see what they say
about this.

do you live nearby?  ebay contends that their deals are valid contracts so
why not avail youself of the local courts to cause this guy some difficulty?

I know the issue is getting some money back for paying for the CarFax, and
the annoyance of dealing with a guy like this, but on the bright side, at
almost $10,000, another one will come along soon.

Actually no - I've been looking for one with the Stability Control
option on Ebay and Craig's List for the last 15 months. This was the
first. It may be quite a while until another comes along.

I've seen cars listed on ebay with an also for sale locally/subject
to prior sale disclaimer.  If that was not in the listing I'd be
annoyed, but probably would not take it any farther than leaving
negative feedback.

That's too bad you lost of the exact car you were looking for.  Here, those
prices are what, or even a little more than what a indie dealer would
charge.  Have you gone around to dealers in your city as told the dealers to
keep an eye out for what you're looking for?  I got tired of looking at so
called mint cars from CL, so just told them to watch for what I want and
call me when they see it.  I got a few calls and it got me much closer to
what I'm looking for, without all the running around.

Maybe Sunil could hook you up with something.
Seems like he's got a friend at the Columbus dealership and
can get older cars somewhat near trade-in. 

If you are in NW Ohio and willing to travel a bit, I can give
you the name of a used car dealer who goes to 2-3 auctions a
week and you can have him call you when he sees what you want.
He charges $500 over his cost. IIRC you pay MI taxes (6%) which
are applied to your Ohio use tax when you title it in OHio.

That price looks pretty good based on prices I see on Craigs List - there 
are 2 S500s here - one is a '01 S500 at $18k firm and also a '02 S500 for 
$21999.  Don't know about all the options but MB tends to come pretty well 
loaded.

Maybe there's another one out there for you.  I suspect the only recourse 
you have is reporting them to eBay - since the warning saysa bid is a 
contract to buy whatever   I would hope the contract works both ways -

Reading the ad the guy sez that its relisted b/c original winner
couldn't execute quickly, implying that that person is some kind of
jerk for not playing fair and THEN  sells it out from under you as the
high bidder?  Bogus.

I'd guess there are ways to make this more difficult for the seller,
but would probably be twice the hassle for you and that in the end
negative feedback is all you've got.

My take: at least he refunded your deposit without any fuss.  It's
probably a blessing in disguise, based on his behavior the car more
than likely was misrepresented in the listing anyway.

When I was in college, I drove cars to/from auctions for cash. There
were weekly ones in Manheim and Butler, Pa.  Man, you never saw so
many sharks in one place! A real feeding frenzy. Those crooks would do
anything to a car and say anything they could make up to get it to
sell. At the time, the going rate for clock work was $50 per car.
They brought your car back in 20 minutes with whatever mileage you
wanted showing on the odometer.

I've had better luck buying from people that make an honest living.

Ooooh a 126 or 124 is not good enough, or heaven forbid a C class :-)

Anyway, there is a paragraph on that auction about this being a 
contract.blah blah blah
However in the real world ebay don't care about anything but their 
commission and about all you can really do is leave negative feedback.
How much do you think you have lost by this deal not going through? Is 
it worth kicking up a stink?
I suppose you can write to the seller demanding compensation and start 
making noises about lawyers and such, maybe you'll get lucky.
But don't leave negative feedback until the seller has told you to take 
a long walk on a short jetty, or words to that effect. Once you dump 
negative feedback, the relationship will have soured somewhat.
If it makes you feel any better, something like S500 would cost well 
over AU$30,000 over here unless it was in really bad shape.

Yes but is it possible to wind back a digital odometer?
I know the 123's are pretty easy to do, that's why it pays to look for 
service history.

Well, thinking it through again, yes when the hammer drops you have the 
right to purchase that car for that price. You do not own the car as 
such but entered into a contact to purchase that car, I suppose it could 
be argued that the seller now has to produce a equivalent S500 for 10K, 
or you could sue him for the difference in price when you buy another 
similar one.
But like I said earlier is it worth the hassle and you will need legal 
advice in this regard and you would need to get a NY lawyer and not an 
Ohio lawyer, unless this is covered under federal law.
Guess someone came along with more than 10K for it and the seller 
conveniently forgot about the legally binding contract part.
One of the problems I see with taking something like this to court is 
that the judge might see this as trivial and view you as wasting his/her 
time and as such go against you. That is the problem with judges, you 
can get some good ones or you can get some real idiots.
My sister recently had a court action with her ex over a couple of 
properties in Sydney and the judge said in so many words that this 
matter was trivial, a couple of properties worth AU$500,000 may seem 
trivial to a fat cat judge but to us little people that is a big deal. 
Even though my sister provided thorough documentation that her ex 
contributed less than 10% towards the mortgage payments he still 50%. 
Basically the judge was not interested in the facts and applied the 
standard.
Unfortunately the law is made by the rich for the rich. Don't believe 
the BS about the law being equal and fair.

I think maybe the digital clock had come out. The ones with painted
numbers that flipped over - that was shortly after the invention of

I asked that question a while back and the answer was basically yes,  
if you know what you are doing you can program in any number you  
want.  In some respects maybe easier to pull off than tampering with  
a mechanical odo without leaving any traces.
