The problem is your use of --delete-excluded [...]
I have simplified the code that handles --delete-excluded so that it only
affects non-merge rules that have no side(s) specified. Thus, the filter
merge doesn't turn into a server-side rule, its un-sided excludes do. This
should fix this

I think the email list is fine the way it is now. Many of the bugs
reported aren't actually bugs but questions or misunderstandings of how
rsync is supposed to work. In many cases the only difference between a
bug report and an email list question
