Diana,You may consider getting one with a powerful word processor so after the cave map is drafted the trip report can be written in conjunction with it. Then you can take the map and trip report and jump right into editing the rest of the Texas Caver articles for the next months issue. What do you think? Jacqui Press Release 112th DistrictAttorney’s Office On September 14, 2015, aCriminal Bench Trial was held before the Honorable Judge Pedro Gomez, Jr.concerning the two count Indictment against Adam William Garcia-Gallegos fordamaging the Sonora Caverns on May 24, 2014. Garcia-Gallegos was indicted witha two (2) count Indictment on September 9, 2014 by the Sutton County GrandJury. One count alleged that Garcia-Gallegos knowingly removed natural itemsfrom a cave and the other count alleged that he knowingly destroyed, defaced,marred or harmed the surfaces of a cave. Garcia-Gallegos pleaded “guilty” toknowingly removing and “not guilty” to knowingly destroying, defacing, marring,or harming items of a cave. Evidence presented duringthe bench trial included a 17 year old eyewitness who observed Garcia-Gallegosbreak a stalagtite [sic] during theirtour. Louise Ingham testified that she asked Garcia-Gallegos to empty hispockets and he pulled five items from his pocket. Testimony from Ingham andBill Sawyer confirmed that four of the items were debris that could have beenfound alongside the trail, but the fifth item was freshly broken from withinthe cave. Sawyer and the eyewitness were able to find the location from whichthe stalagtite [sic] had been broken.Testimony was also presented by Sawyer concerning the process and costs whichwill be necessary for repairs to restore the stalagtite [sic]. After hearing theevidence, Judge Gomez found Garcia-Gallegos guilty of both counts and sentencedhim to seven hundred and thirty (730) days in the State Jail Division of theTexas Department of Criminal Justice, suspended for five (5) years on community supervision. Seven hundred and thirty(730) days is the maximum sentence for a state jail felony and five (5) yearsis the maximum for a probated sentence on a state jail felony. Judge Gomez alsoordered Garcia-Gallegos to pay $9,480.00 restitution for the repairs. Therestitution must be paid within thirty-six (36) months to Gerry MayfieldIngham, who is one of the owners of the Sonora Caverns. The Sonora Caverns hasbeen owned by the Mayfield Faamily for five (5) generations. During her testimony,Louise Ingham stated, “Our Family opened the Caverns to the public foreducational purposes and to allow people to enjoy the natural beauty of thecaverns.” Laurie English, 112thDistrict Attorney, stated, “The Sonora Caverns represent a precious naturalresource that must be protected and preserved for future generations. Theremoval of even the smallest items from the Caverns damages the integrity andbeauty of this natural wonder.” The law concerning damageto caves within Texas was modified in 2007 and the penalty was increased from amisdemeanor to a felony after the Sonora Caverns sustained damage to the “Butterfly”which was the premier feature of the Caverns. The Ingham Family and the SuttonCounty Attorney, Dib Waldrip, were instrumental in getting the penalty raisedto a state jail felony. That is a nice news story and quite the volunteer turnout, nice work.Unfortunately however the historical background given the reporter was not correct. The bats were not eliminated from the Ezell's Cave by the installation of the recently removed cave gate but were excluded when a previous owner placed a steel plate over the entrance in the early 60's because of fear of liability suits. The property was sold to the Nature Conservancy in the late 60's with substantial help from the SWT Grotto. Through the 70's the Nature Conservancy tried several different methods of trespasser and vandal control with varying success. If you are interested in the history of Ezell's Cave read through Nature History of Texas Caves page 94 - 99. There were several attempts made to reintroduce bats into the cave after the steel plates were removed and it was an open entrance but there was no success, the bats were not interested in staying. In the early 80's the Edwards Aquifer Research and Data Center At TSU was ramping up the research portion and hired Dr. Albert Ogden. Ezell's Cave was an ideal monitoring location of the aquifer, however the instruments that Dr. Ogden was placing in the cave were suffering vandalism and therefore loss of data. The Conservancy was approached about paying for a gate but it wasn't until two students that were trespassing fell down the entrance climb and were injured requiring rescue the Nature Conservancy agreed to have a gate installed. After the Conservancy agreed to install a gate a meeting was held with Dr. Merlin Tuttle at the Wyoming NSS convention and then later when he was visiting central Texas (prior to BCI moving to Austin) a meeting was setup with the local Nature Conservancy staff and the several local San Marcos caver volunteers for Dr. Tuttle and the Conservancy biologist to recommend and review a design. Everyone agreed that it should work for the bat ingress egress, it was open enough to not disrupt the surface water flow into the cave, and tight enough to stop trespassers from entering into the cave. The gate was constructed and installed as designed by bat experts at the time. In the last few years several small (maybe tricolor) bats have been seen and reported in the cave in the winter.
