It seems (not 100% confident yet) that this is fixed now. It might be Ubuntu updates but I also changed video settings: I replaced agpgart with NvAGP to get suspend/hibernate working. Maybe that also fixed this issue since I haven't seen the low graphics mode warning about during 8 bootups now.
