Debian GNU/kFreeBSD has native ZFS now:

As Alan Cox pointed out years ago ZFS is toxic due to the software
patent lawsuits between NetApp and Oracle (then Sun). NetApp has now
escalated this by forcing CoRaid to withdraw their Etherdrive Z-series
NAS product based on ZFS.

I believe NetApp already tried to sue Sun for the same infringement
and lost. Also, I doubt anybody could endangered by using ZFS (plus its
linux port) internally; NetApp is essentially trying to target resellers
because they pretty much lost against Sun.

As Brad Figg commented earlier, we will only take filesystems into
Ubuntu from the mainline. There has been a lot of discussion about ZFS
on the mailing lists and, in general, it is a non-starter due to
litigation and patent licensing. As a result, we are unable to to
anything until that is
SoZFS-Fuse doesn't cut it and Native ZFS support not going to happen
because of licensing issues then what about HP advfs
For those that don't know advfs, its very similar to ZFS and if you ask
me it rocks!!! (and having used ZFS and advfs I think advfs was
better!).

- It's not CDDL that leaves developers and users exposed to possible patent
violation claims, it's GPL that does this. CDDL protects developers and users
against such claims.
- GPL calls licences with such a protection against patent violation

Given that Sun and NetApp have ongoing patent litigation over ZFS it is
probably not wise for any Linux vendors to consider pushing it into the
kernel.

I do not see how this is such a big licensing problem - the CDDL and
GPL-2 are incompatible but this just means the verbatim ZFS code will
never be accepted into the *mainline kernel*. Ubuntu has a specific
solution to this - the ubuntu directory in the kernel tree, which
holds stuff like

I got a taste of ZFS with Solaris and PC-BSD, and I must say, I can't
get that taste out of my mouth!
While I found PC-BSD, as a whole, to be relatively immature as a usable
desktop OS (a great effort, though, not quite there yet), and
OpenSolaris to be the same, only with surprising less ZFS
Until ZFS is accepted upstream, into Linus's tree it is unlikely that
this will be considered for inclusion into Ubuntu. Your best bet is to
work with upstream developers and convince them to include ZFS.

Can I suggest rather than ask here for ZFS support those who wish to see
it included go and lobby Sun for a GPL compatible release of the full
code base please ?
As Alan Cox wrote in July when asked if the release of the GRUB code
meant ZFS could now be implemented in the kernel:
No we can't.
Alan Cox mentioned that No we can't. The GPL ZFS bits don't include the
various methods that would violate the patent so there is no grant.
Couldn't we just use the GPL ZFS source code in GRUB to create a
minimalistic implementation of ZFS that did not violate any patent, yet
would be more useful
I am currently running 2.6.27, but it still does not have ZFS support.

The Ubuntu Kernel Team is planning to move to the 2.6.27 kernel for the
upcoming Intrepid Ibex 8.10 release. As a result, the kernel team would
appreciate it if you could please test this newer 2.6.27 Ubuntu kernel.
There are one of two ways you should be able to test:
1) If you are comfortable
In favor of a native ZFS.
This implementation should also be marked as important. You wouldn't
believe the number of users who would benefit from this...

Just another voice for wanting native, bootable, ZFS filesystem support
in Ubuntu.
I have tried the FUSE version, and besides it not being maintained, it
is VERY slow for small file updates.

There would also be no protection against Sun's patents on ZFS if
we were to expand that into a full implementation.
To the contrary: While the CDDL protects any developers (and users) from
patent claims by both SUN and all software/license users, GPL-2 does
not. Any user of the linux kernel
Read-only access would be better than nothing.
Then at least people would be able to access the data on their ZFS partitions.
Aff, patents ruin the world. :(

Sun has released some ZFS code under the GPLv2 for the GNU GRUB bootloader.
That code could be used to create an (limited) ZFS implementation for the
kernel.
Or you could talk to Sun and convince them to dual-license it under the
GPLv2.

Previously we have not been able to have ZFS support due to it being
licensed under the CDDL and the kernel under the GPL.
Sun have contributed ZFS support to GRUB under the GPL license. We could
now use that code to implement support for ZFS in the Linux kernel.
